Bay Ridge Nissan John Paul, Jermaine, Mino, Mitch, Leo V. i was sold an unsafe 2005 jeep laredo, cash ($18,000) 2 days later on my very first ride, on the F.D.R. drive, the front, right axle broke and the tire fell flat. no accident occurred but i could have Brooklyn, New York

I purchased a jeep grand cherokee laredo from bayridge nissan in brooklyn on 06/09/11.  On 06/11/11, two days after picking up the car i was taking my first trip. 

While driving southbound on the F.D.R. Drive, between 34th street exit and 23rd street, the front right (passenger side) axle broke and the tire fell flat, which forced the 4,500 pound vehicle toward the right wall on the highway.  Luckily myself nor anyone else was hurt, but that is not the point.

I was sold a vehicle that was guaranteed (in the contract) to be safe.  Clearly, this was not a safe vehicle.  I do not want others going through what i went through because the next person won't be so lucky.

Bayridge Nissan is claiming no liability. Reason is becasue the tire did not detach from the vehicle, but that is all symantics; the tire was useless at that point.  I towed the vehicle right back to the dealer and currently am $18,000 down, with no vehicle.  

How can an incorporated, certified dealer get away with something like this.  Lives could have been lost.  The whole transaction was iffy and I never got all the paperwork for my vehicle.  They will not return calls.

they claim zero liabilty, but upon my arrival, immediately took both towing receipts (NYPD and AAA), so you know, this is NYC on the most used highway, no shoulders.  The law here says any used vehicle has a 60 day warranty on it, this occurred 48 hours after purchase.  the contract says that this car is classified as a used car and is GUARANTEED (key word) to be safe, blah, blah...the same disclosure that is on most used car contracts.  they think i'm stupid and don't know my rights...i'm not taking this lying down.  I've got all my ducks in a row.  as soon as i get these pictures on the computer i will post them.  a couple of hours.

   It's very unusual for a dealer to put something like that in a sales contract.  Usually used vehicles are sold "as is" to buyers who do not bother to have the vehicle checked out.  That insulates them from responsibility for problems that arise after the sale.

   What exactly does your contract say?   How long did they guarantee the vehicle to be safe?  You may have some recourse, depending on the wording of the contract.
