I went to check if I can buy a new car and trade my old one in. I explained everything about my credit, and downpayment situation to the sales person at Beechmont Toyota. I said I will only buy if they offer me an APR less than the 8.5% I am paying on my current car that I had bought from them (again at a huge rip-off for me - should have learned the first time).

They tried to sell me a car at 10.5 %! And $3,800 for my trade in, which had been vandalized and my insurance company was paying $4600 to have it fixed. I owed 12,200 on that car! They really thought that they can basically make my insurance company pay $800 to actually have me sell the car to them!!! I said I am not buying and asked for my old car's keys at which they said they had already reported it as sold to them. I am an international and a woman and I am alone in this country, and I was incredibly stupid and believed them. I reached an agreement to have it fixed at their bodyshop for that sum and trade it in to them for $5000 ($400 when you take the difference with what money they were actually going to make on solely fixing the car). They lowered my APR to 8.9% and I signed. I was going into 25,000 of debt and was ok with it, UNTIL...

My credit was checked on the Sunday I bought the car by them and on the Monday by Toyota Financial. On the following Sunday they called me in and asked me for an additional $1,500 for downpayment explaining that Toyota Financial would not approve the deal otherwise. I told them, I already had a deal worked out, signed and agreed to. And they already knew I had no additional money for this additional downpayment because I had made it CLEAR what my credit condition and downpayment money was. They sell cars every day - how come they did not notice that Toyota Financial would not approve the original deal at the original terms?

I was so frustrated I went back an hour later, left them the new car, the keys, and I told them I want my old car back, I will not be fixing it at their bodyshop and there is no deal. They are now begging me to go back and buy the new car. I am waiting for them to work out a deal, but by now I hate the new car and do not want to have anything to do with Beechmont Toyota for the rest of my life and would tell anyone who wants to buy a car, to NEVER use their services. They are incredibly inethical in their sales and at any point after the sale can come up with a change in the original deal and will try to force you into accepting it.

I am not sure what my rights are in this. I might not be able to walk out of the deal, but I am going to fight it. I do not want a car that has caused me so much trouble any more, new or not. I want my old car back, will pay it off as soon as humanly possible, never again go to Toyota for any kind of purchase and find a better dealership for my business. They have made me give up completely not only on buying from them but on anything that has the slightest association with Toyota in general.

If the paperwork (loan documents), and down-payment, that you filled out, & gave to the dealership for the.......

purchase of your NEW CAR cannot be approved by the Bank or Finance Company, then you can simply hand the keys back to the Dealership and they MUST give you your OLD CAR back, and they MUST return your down-payment!

DO NOT fill-out any NEW LOAN AGREEMENTS or they might be able to get the NEW paperwork approved. DO NOT give them anymore money towards a DOWN-PAYMENT!

The only money that you MIGHT 'lose out' on is money that would go towards a MILEAGE FEE because of MILES you put on the NEW CAR that they COULDN'T get you approved for. Check to see if you signed-off on this BEFORE they take money from you!!! If you didn't sign any MILEAGE PENALY FORM, then they CAN'T LEGALLY charge you!

THEY WILL TRY to convince you that you made an agreement to buy the car. But since you CANNOT be approved, the DEAL IS VOID!
