I ordered the free sample on Feb 9, 2004. The representative was David. I told David I did not want the automatic mailing of the product. That I would try it and if I liked it I would call back in and reorder it.

I called back in after a month and talked with Kendra at X6095. I said I would like another shipment of the product. She said that she would place me on the automatic mailing of the product. I said "no, I don't want the automatic mailing. If I want another shipment, I will call back". Kendra said okay, she would mark the account. I receive the second shipment. I decided that I did not want to continue with the product (it hasn't worked) and did not call in for any more shipments.

On May 13th, 2004, I received a third shipment in the mail. The note said that my credit card would automatically be billed. I called in and talked with James (different James than the first call) and explained that I did not want the shipment, I would send it back and I wanted a refund. David informed me that I had been placed on an automatic shipment and would have needed to call back before the delivery of the product. I explained that I did not give authorization for the automated shipment. David again said that he could not refund my money. I asked for a supervisor.

Jennifer (ID #5221) came on the line and we had a very long, difficult conversation. She kept repeating that I had been placed on the automated shipment. I asked if they recorded their calls and if they had a recording of my conversations with James or Kendra. She said they did not have recordings of those calls. I asked her if she could record our conversation so that there would be a record of my disatisfaction of how my account had been handled. She said she could not record the conversation. I asked her what the records showed of my conversation with Kendra, she said that there were no notes, but that I had called in on March 5th.

Jennifer said that I had been placed on automatic mailing from my first call with David. I responded by saying, then my call to Kendra on March 5th does not make sense. Why would I have even called back, if I did not think I needed to reorder (because I had given specific directions not to be on automatic mailings)?

Jennifer said the most she could refund would be $35.00. I said I wanted the full amount refunded. If I had any idea this shipment was about to come to me, I would have canceled it. I did not know I was on automatic mailings, till it arrived and I called in.

I asked to speak with someone higher than her (her manager or director). She said she would not pass my call on to anyone else. I asked who was above her and she would not give me a name. I asked her the name of the president of the company and she said it was Steve Worshack. I asked where he was located or his address and she said she did not know. I asked who the director was and she said Michael Johnson. I asked to talk with him and she said that he does not take phone calls. I asked for his address and she gave it to me.

We finally ended with an agreement that she would refund my $35.00, and cancel any future orders. I indicated that I still wanted the other $35.00 and would be taking additional steps get it.

It appears that they have very selective hearing and only record what they want on their records - sometimes there is no entry at all, as was the case with my conversation with Kendra.
