I came into contact with Darin Michael Smith from Ft. Myers, Lee County, Florida on the 23rd of September, 2013 after seeing one of his post on "Tiny Homes" on the Internet.

I emailed him with questions concerning what he was advertising for affordable land lots and cabins in Belize and the starting of Rene's House, which was an orphanage.

He was very open and talkative promoting his â€‹farm lands  that he showed on his website as being divided in a Los Tombos Subdivision with about 40 lots consisting of 1/2 acre to 2 1/2 acres.

Not only did I review the website at www.biospharms.com where he showed the full development with plot plan, but the packet sent to me showed what was to be an established community with subdivided land lots.

I was told in an email from him that "There are many of us now. Maybe twenty families and ten singles all in total at this point. The average person is a college grad and middle to upper middle wage earner. About half have kids and most everyone plans to move in full time in 2014." (24 Sept 2013 email)  I might note now that this was incorrect. The most there has EVER been living there full time, has been about 6-7 families at the same time. 

We spoke through a lot of emails back and forth with my questions and his answers. Never once did I feel to question on his sincerity or trust for he talked a lot about being hot on fire with the work of the Holy Spirit and all that which God was doing to see this come about.

However after arriving I found there were only 2 couples and one single man living at the community. One lady had just left her home in November 2014 as she was frustrated with what she found when moving here about 6 months before me. Another property sold the same time as mine and they moved in a couple of weeks later than myself. By what Mr. Smith said, I was led to believe Biospharms was a thriving community. It was not as far as I am concerned – 5-6 other people does not seem “thriving” to me.  Over the years I have found many inconsistencies in what Mr. Smith will tell you.

The whole subdivision is not as it was presented online.  Biospharms, Inc. in Florida has nothing to do with the property in Belize and is not a registered company in Belize.  Nor is the Los Tombos Subdivision actually subdivided or registered.  As of recently, it had not even been entered to request approvals for subdivision.  This is according to the Belize government through the Title and Land Office.

One of Darin Smith’s sales pitches is that we don't have any costs for utilities for power as all is solar powered.  The website even states this.  However, there are utility bills in way of propane for the refrigerator, stove and hot water, water costs from the local water company, and cell phone and internet charges. I was told that the water was "Well there is a 5 dollar water bill. I just want to make sure we have full disclosure" (25th Sept 2013 email).  In reality it is never that low and in my opinion it is very expensive. I was told the internet tower is available at the farm but it was not for at least 9 months after moving in. You have to add an expensive solar system if you want to do more than charge your phone.  The system provided won’t even run more than 1-2 low voltage lights. To my disappointment the batteries for the solar system last only about 2 years and the invertor to make the 120 v does not last much longer. Things are not as cheap as Darin Smith claims.  He claims HOA fees, but since no one actually owns their property – how can there be a “home owners association”? It was not until January, 2016 that he set one up a functioning board of directors and HOA, and then homeowners were informed that if their HOA fee is not paid, your water will be disconnected, which is against the laws of the PUC.  You will also lose your internet connectivity and you will lose the gate code for use of the locked gate.  In other words – you will be locked out of your home you paid for! N The water and internet are owned by different companies and run according to the laws of Belize.  Darin Smith claims he can control all because owners have no rights as he and only he owns our land.  And this is true, because he never subdivided as he implied to each of us when we bought our lots.  Each homeowner paid for their own water installation to their homes and the road way by the inflated building prices which were to include the costs of development.  It has been brought to the homeowners attention that the water system did not meet the water companies regulations and is inferior with a ½” line that should be a ¾” line at minimum.

One of the main reasons I went to Belize was that Darin and Stacy Smith presented Rene's House being built as an orphanage.  I looked forward to teaching the young girls they said would be coming to their orphanage.  Things like sewing, crocheting, canning and preserving foods and painting.  The website shows pictures of young girls and is misleading.  Now Darin Michael Smith tells us that he intends on bringing girls in from the age or 13 to 18 and calls it a "half way house" to train the girls for employment when they leave. He has informed us that he is asking people in the United States of America to donate $450.00 US a month for EACH girl's support. That is $900.00 BZ for the expenses of each girl which is a lot of money for a child in Belize.

I never received the original contract or loan receipts back with his signature, despite having asked repeatedly in person and in emails for these.  I have requested the documents back with his signature but Darin and Stacy Smith have ignored my request. They only sent me "copy" documents which are not binding documents, and without their signatures. 

When purchasing my property that he was going to finance it for 4 years. I asked point blank “will I get my titles when I make the last payment”? He said yes, then the land is mine.  He never mentioned the "Quit Claim " that came about many months after the homeowners started investigating the property.  Quit Claim deeds are not used or legal in the transactions of the Belize law.​ 

It was not until November, 2014 dinner meeting that Darin Smith stated finally and due to pressure, that he "was going one way with the subdivision however I have changed my mind to another" which was to have us all sign up into a "Trust".  He would still own everything in his name, and we would be “beneficiaries. Most of us were against this.  It was not what we bought into.  We declared we wanted the subdivision completed and the Titles given to us first before discussing anything else such as the Trust he was now proposing.

To date, Mr. Smith continues to lie and lead the homeowners on, changing how he is going to own the land. He has disrupted and caused divisiveness in the community with his lies and lack of honesty.  He was responsible to do the things developers do – and should have  performed before he sold the first lot according to Belize law.

Many people have left over the past 5 years due to the stress and ill ways of how things are being done. There has been damage to some homeowners who are fighting him legally in the courts of law.

Those that moved  to Biospharms to live there full time went there trusting that they were purchasing into a Christian community of love and fellowship, and that our community would benefit not only us but the local town of Los Tombos.  Sadly, that is not the case.

Janis Fowler vs Darin Michael Smith Court Judgement

As I have previously mentioned in my past Facebook post after my Belize Supreme Court in front of Judge Sonya Young on the 20th of December, 2016, I am extremely happy with the Judge's decision and comments concerning Darin Michael Smith. Having never gone though such a dealings with this in my past, I was not aware of many things to present to the courts. One just does not say so without producing the facts in way of proof in their Witness Statement. While on the stand, I realized much of my proof was not presented and the Judge has to rule in favor of the law which I fully understand. I did not prove to the court "Misrepresentation" however, as I said, I am "happy".

I might add that the reason I am "extremely happy" is that I have possession of my property whereas those that went through Mediation have a "promise to pay" in a long drawn out time span and it is the opinion of myself, that they will never see it and will end up back in court. We will see, won't we!

I wish to give my thanks and gratitude to Attorney Steve Perera for all he has done and is doing for my situation. I feel very blessed to have met him and had him in my team.

I have attached my Judgement document for your personal viewing, if it is of interest to those who have a dealing with or following the Biospharms, Inc. aka Darin Michael Smith from Ft. Myers, Florida if you care to know the complete truth to my transaction of this matter.

For those being told by Darin Smith that I am on my way out and leaving; rest assured it will be only when I decide to sell and leave my property.

The courts have ordered the house and property mine. Darin Smith is to hold my land in "trust" because I have a small amount due to him in an outstanding loan. Only after the subdivision is complete will he give me the Belize Land Certificate and he will receive the balance of the loan owed. I wish to make another comment for those who listened to his lies; I never expected to get my property without payment in full. If you know me, then you would of realized I don't expect life to be free. Darin Smith can now stop telling everyone that I "live on his property for free".

The court has proven that he has contradicted himself in how he was setting up or selling the property to me (and others) with a subdivision via a map as evidence produced online and in hand that would receive a "Title" (not a Quick Claim deed and is an worthless piece of paper in Belize). Quick Claims never was mentioned by Darin Smith until after November, 2014 and the word started by another homeowner. Then, he changed his story to he was selling us a "lifestyle" and not a home package which he presented to the courts but then turned around and contradicted himself in doing a subdivision in the beginning.

The Judge did state that Biospharms, Inc. is not a registered business in Belize, the property is in the name of Darin Smith and the sole seller of the lands. Also, I hereby state that Biospharms, Inc. Sales, Contract and the Rules and Regulations which are on the Biospharms, Inc. letterhead is a worthless document since it is a U.S document and not a registered company in Belize nor was there ever a signature to bind said documents by the seller, Darin Smith. Therefore, Darin Michael Smith can stop sending me those HOA bills every month because he got 2 years out of me and won't get anymore.

In closing I wish to quote some of Judge Sonya Young's comments about Darin Michael Smith. She was disappointed that he did not appear in court that day because she wished him to "hear what she had to say".

Judge Sonya Young to Attorney Darrel Bradley in his final argument, ".........it is the statement of this court that the egregious behavior of the FIRST DEFENDANT! if this matter had come in another way we wouldn't be in having this kind of order. I find the defendant has acted very, very badly.......very very badly!"

JUDGEMENT HIGHLIGHTS

Take special NOTE: 
​43. ​Since both parties have seen some level of success I shall award the Claimant only half of the costs agreed. This award of costs is also a statement of the Court's view of the egregious if not illegal behavior of Mr. Smith. Section 14 of the Land Utilization Act specifically forbids the selling of any part of land without the Minister's final approval for subdivision. Such a contravention of the Act attracts a fine of $1,000.00 on summary conviction (section 7(2)).

19. The court takes judicial notice that a quit claim deed is a document which in the United States of America (where both parties originate) would give the holder a right to claim title. In Belize, however, it is a useless document, except perhaps in this case where it certainly demonstrates Mr. Smith's intention. An intention which I find was to pacify Ms. Fowler, lead her to believe that she would be receiving something of value equivalent to legal title or a right to legal title.

​20. ​Now my primary concern is, why would someone pretend to part with his legal interest in land in circumstances where he had not contracted so to do and could therefore not be compelled. Why would he even entertain a discussion on the issue, far less make "several attempts to carry out a subdivision" (as he testified and where the court appreciated from the context was reference to a legal subdivision), if he knew he had only sold a bundle of rights. I reject the notion of his Christian values being instrumental in this decision. Mr. Smith struck me as a shrewd businessman who knowingly
and impeccably organized his affairs.

​21. When he discussed solution options with Ms Fowler, he says" I have offered to resell the property allowing her to receive the monies she invested back. Other community members have offered to help her sell her property to get her monies back. "It is beyond me to even speculate what property she would be selling to get her money back. Since according to the defendants she bought nothing but a bundle of rights and a lifestyle, tantamount, in my mind, to a licence of some sort with no proprietary interests. Certainly, he could not be referring to the wooden cabin.

​23. ​Now, Biospharms Inc, is a legal entity separate from its directors and shareholders. Throughout the entire trial Biospharms Inc. seemed to be Mr. Smith's alter ego. He spoke for them both. He made no distinction between them except when he discussed the business of selling the biospharms. That, he said, was within the sole purview of Biospharms Inc. How Biospharms Inc. was able to legally sell property usage rights without owning property or having a right to do so on the owner's behalf, is also beyond me.

​24. ​When we look at the written documents presented in evidence, the purchase contract as the document is captioned is headed Biospharms Inc, and it refers to terms of financing. It reads "$17,000 down by October 8, 2013, $500 per month beginning January 1, 2004 until balance is paid in full. " Those terms are restated in greater detail in a promissory note signed by the borrower, Ms Fowler but not the lender who is stated therein to be Darin Smith. Darin Smith admitted that Ms Fowler was given financing. He stops just short of saying from whom. Now, there is no legal requirement for the lender to sign a promissory note. But by the presence of his name as lender he is accepted as the lender and only he or his assign may enforce

Darin Smith Biospharms Lawsuits Update:

It is understood that Darin Smith is going around stating that the law suits against him are being dismissed by the courts due to "frivolous" reasons or he has won the cases.  Let it be known that since the rest of those who filed their law suits, they are now being told they can not say anything negative against Darin Smith or his business Biospharms, Inc.

I wish to come forward to update the dealilngs of each suit against Darin Michael Smith in the Belize Courts.  What I state is to the best of my knowledge and thus being recorded.

1.  Cindy Carson WON her law suit against Darin Smith and after appeals the Judge still awarded Cindy Carson with her money to be returned.  Since her win in January, 2016 she to this date still has not received her money back.

2. Larry Tann WON his Mediation in that he was allowed to move their home out of the Darin Smiths lands with a buy back of propoerty under a very low rate.  Darin Smith claims to have NO money and is having to make a payment sometime in the spring of 2017.

3.  Jeremiah Allen WON his Mediation in that the "Attorneys" are now responsible in making sure Darin Smith subdivides the "Los Tambos Subdivision" as was originally shown completed. Attorney Perera offered to help Darin Smith this project since that was his expertise and Attorney Bradly advised his client to accept the offer since he would not win in court.

4.  Donald Smith WON his Mediation in that he will receive most of his money back however DArin Smith has a year to pay him back after the property is resold.

5.  John Poitier WON his Mediaiton in that he will receive most of his money back however, DArin Smith has again made some kind of arrangement in when and how he will pay this back.

6.  Janis Fowler could not come to an agreement because Darin Smith only wanted ot pay her back the original deposit of US$17,000. and charging her 2 years woth of payments ($12,000.US) as rent and then again wanting 1 year to pay this amount back.  In the Mediation Janis Fowler lowered her original asking price to a lower amount and 72 hours to be paid.  However, she gave in to 3 months for payment and Darin Smith was not in agreement.  They did not come to turms and Janis Fowler took her case onto court.

The court date was the 18th and 19th of October, 2016.  The Attorneys have turned in their closing arguements on the 25th of October and now await the Judges decsion.

Janis Fowler feels very confident in that Attorney Perera proved Misrepresentation/fraud and awaits for a positive verdict.

There is still one more law suit to be filed against Darin Smith by the first of the year.

First of Many Lawsuits Won in Belize Court

Our friend Cindy won her lawsuit today (21 of March 2016) and the case set a very important precidant for the rest of our suits! 


The judge officially declared that a QCD (Quit Claim Deed, the means by which Darin has attempted to transfer land) was unintelligable as a means of titling land.

We are very pleased with the outcome.

Happy Owner Sees it Differently

Biospharms is a wonderful place, with amazing produce and hardwood trees growing, birds singing, roosters crowing and warm sunny weather. It is quite unfortunate to see a beautiful community such as Biospharms under such undo scrutiny and attacks. There are currently two legal cases concerning the grievances of those who have posted negatively towards this great community and developer. It is unfathomable that these individuals would not have just stayed with the legal action course instead of exposing themselves to slander and libel by defaming the community and developer in social media and online.

As the Supreme Court rules, the truth about whether or not an unregistered subdivision and quit claim deeds are legal or not will prevail. The comical thing about all of this is that each of the disgruntled owners who are currently fighting, knew exactly how the community was structured upon entering into their contract. They have since been falsely convinced, by the leader of the disgruntled parties, that they will be able to get something for nothing, and have banded together to try to have something changed that they new about from the beginning.

We, who are happy at Biospharms, will continue to stand behind Darin Smith, his family and each other. We will continue to grow and harvest; pursue joy over unhappiness; and seek peace over strife. However, we will stand up strong for each other and we will battle for our community if we are forced, in an effort to show both sides of what started as a one sided story. Know once the battle is over, this place will be the amazing place God created it to be. Once the dust settles and the handful of disgruntled people either find their peace and apologize or have moved on to other things and other places, those of you looking will see a beautiful community with many happy owners who are excited for the next phase; excited to live in the peace, joy and beauty Belize has to offer.

Slanderers Hiding Their Own Criminal Backgrounds

U.S. criminals try to hide in foreign countries and it appears there are some here in Belize, who prefer spending their time complaining about those who are not criminals. These unfounded complaints against Darin M. Smith  (whom I know personally) and Biospharms are nothing more than bitter revenge on him and his beautiful family.

This attempted character-assassination is being bankrolled by a disgruntled non-resident, and John Michael Poirier (do your own background search on him) who is the acting ringleader, making personal-and-online threats, who's wife has left him (yet he continues to make complaints in her name) while instructing his "cult" followers to do the same thing.

I urge you come to Belize & see for yourself, and meet both parties in question, before listening to the rantings of a few angry, self-medicating, losers who will never be able to find happiness in this world or beyond.

Belize News Exposes the Truth to Warn Public

For those that insist the Smiths are faultless on the charges brought against them then, I ask you this.....why would someone go public and stand to be sued for slander and liability?

Perhaps those not involved should sit back and hear both sides of the story before making off the wall comments that do not involve them.

Our Vision

We are unified group of full and part-time buyers of the 'Biospharms' Inc. Christian community, in Los Tambos in the Cayo District of Belize. Since 2010 buyers have come and gone. All came for the same thing buying into the vision that Darin Smith described - an "Acts like Christian community”, affordable, self-sustaining and organic. A small handful has stayed full time. The common denominator was Christian community, and owning our little slice of tropical paradise with Belize sanctioned contracts and documents. Over time each of us has discovered, often through great resistance – that Darin Smith owns the entire 43 acre property personally, “Biospharms Inc.” of Fort Myers, Florida denies any connection, and that Darin Smith never subdivided the land as presented in maps, boundary markings, and laminated plot plans. We also discovered from the Lands Authority and attorneys, that all of our documents were fraudulent. Many over the past 6 years have left with that discovery, despite losing money that was not returned, only to have their homes re-sold.

We were loathe, as Christians to hire attorneys; Mr. Smith counted on this. Having exhausted all other means, WE are now 8 plaintiffs, (so far) suing Mr. Smith as defendant, in the Belize courts to perform, and to prevent further sales in the un-subdivided 'Biospharms' community so that more innocent people are not deceived. If successful, our hope is for refunds to those who lost so much, and a completed subdivision. Those few residents who are happy with the current arrangement should not feel threatened by what we are doing, as it will benefit them as well to be legally recognized. We were all charged a huge premium so that Mr. Smith could do a proper, approved, legal subdivision. This should not be a difficult task. All we ask is that Mr. Smith do things legally as promised and then leave us alone to live our lives peacefully and without the constant gossip, slander, and dividing that has been done to us. We ask you to realize – that there are 2 sides to every story, that we are doing all we can to bring justice and that if history is any indication, all will come out eventually.

The families in dispute with Darin Smith and Biospharms have taken a year to try to fix this problem with him.  Talking to him individually, as a group, in emails and telephone conversations is doing no good other than allowing him to come up with more ideas how to change things from the original sales agreement and contract with us.  

You have to understand that those that purchased from him a year an half ago were told one thing whereas the newer buyers ard now hearing the amended sales pitch because in my opinion, he does not wish to make good the original.  He has no more money to finish the subdivion and does not even want to admit he showed a "Los Tambos Subdivion" on his contract and website.  

In the past 2 years, had he spent the time, energy and monty on going in and finishing his subdivision, it would be complete now instead of having to fight our court battles to force him to do what was promised.

Some, who do not live there, feel we have misunderstood him and what he wanted however, it is very evident in the emails, paperwork and site what he was presenting to us.

Truth will come forth as truth and darkness will come forth as darkness.

I pray for justice to speak when the dust settles.

False Accusations

I must say these claims of biospharms and Darin Smith being frauds and scams are completely uncalled for and their reasons unjustified, if people would take the time to actually talk to Mr. Smith and learn of both sides of the story then perhaps they would see what is actually going on. I know Darin and his family personally and they are some of the most kind heartted genuine people trying to help the children and people of Belize and these fraudulent complaints are completely uncalled for as well as causing them and the people around them extreme amounts of worry and stress. Please I implore you to seek out and talk to Mr. Smith before accepting these negative reports.

I was told the internet tower is available at the farm but it was not for at least 9 months after moving in. You have to add an expensive solar system if you want to do more than charge your phone.  The system provided won’t even run more than 1-2 low voltage lights. To my disappointment the batteries for the solar system last only about 2 years and the invertor to make the 120 v does not last much longer. Things are not as cheap as Darin Smith claims.  He claims HOA fees, but since no one actually owns their property – how can there be a “home owners association”? It was not until January, 2016 that he set one up a functioning board of directors and HOA, and then homeowners were informed that if their HOA fee is not paid, your water will be disconnected, which is against the laws of the PUC.  You will also lose your internet connectivity and you will lose the gate code for use of the locked gate.  In other words – you will be locked out of your home you paid for! N The water and internet are owned by different companies and run according to the laws of Belize.  Darin Smith claims he can control all because owners have no rights as he and only he owns our land.  And this is true, because he never subdivided as he implied to each of us when we bought our lots.  Each homeowner paid for their own water installation to their homes and the road way by the inflated building prices which were to include the costs of development.  It has been brought to the homeowners attention that the water system did not meet the water companies regulations and is inferior with a ½” line that should be a ¾” line at minimum.

One of the main reasons I went to Belize was that Darin and Stacy Smith presented Rene's House being built as an orphanage.  I looked forward to teaching the young girls they said would be coming to their orphanage.  Things like sewing, crocheting, canning and preserving foods and painting.  The website shows pictures of young girls and is misleading.  Now Darin Michael Smith tells us that he intends on bringing girls in from the age or 13 to 18 and calls it a "half way house" to train the girls for employment when they leave. He has informed us that he is asking people in the United States of America to donate $450.00 US a month for EACH girl's support. That is $900.00 BZ for the expenses of each girl which is a lot of money for a child in Belize.

I never received the original contract or loan receipts back with his signature, despite having asked repeatedly in person and in emails for these.  I have requested the documents back with his signature but Darin and Stacy Smith have ignored my request. They only sent me "copy" documents which are not binding documents, and without their signatures. 

When purchasing my property that he was going to finance it for 4 years. I asked point blank “will I get my titles when I make the last payment”? He said yes, then the land is mine.  He never mentioned the "Quit Claim " that came about many months after the homeowners started investigating the property.  Quit Claim deeds are not used or legal in the transactions of the Belize law.​ 

It was not until November, 2014 dinner meeting that Darin Smith stated finally and due to pressure, that he "was going one way with the subdivision however I have changed my mind to another" which was to have us all sign up into a "Trust".  He would still own everything in his name, and we would be “beneficiaries. Most of us were against this.  It was not what we bought into.  We declared we wanted the subdivision completed and the Titles given to us first before discussing anything else such as the Trust he was now proposing.

To date, Mr. Smith continues to lie and lead the homeowners on, changing how he is going to own the land. He has disrupted and caused divisiveness in the community with his lies and lack of honesty.  He was responsible to do the things developers do – and should have  performed before he sold the first lot according to Belize law.

Many people have left over the past 5 years due to the stress and ill ways of how things are being done. There has been damage to some homeowners who are fighting him legally in the courts of law.

Those that moved  to Biospharms to live there full time went there trusting that they were purchasing into a Christian community of love and fellowship, and that our community would benefit not only us but the local town of Los Tombos.  Sadly, that is not the case.
