BMT Research Services Sean Sommers Breached our contract and walked away from completing our Kitchen renovation WITH my money Calgary Alberta

We signed a comntract with BMT Research Services on September 15, 2006 to complete renovations of the kitchen and joining bathroom and installation of a fireplace. It took BMT over 6 months to attempt to complete the work and in April of 2007 Sean Somers walked away from the job despite having been paid.

BMT Research Services Inc breached the contract by refusing to complete the contracted work including the following: (1) finish framing new windows and doors, (2)complete stucco work around new windows and doors, (3) replacement of negligent installation of new back exterior door, (4) replacement of faulty door new back exterior door, (5) installation of proper bathroom sink, (6) installation of office desk drawer, (7) repair of poor workmanship of wall where BMT carelessly removed office desk drawer that was improperly installed, (8) repair of faulty pantry doors, (9) repair of scratch in hardwood floors caused by BMT, (10) satisfactory installation of side entrance tile steps, and (11) installation of fireplace mantle. Additionally, BMT has not reimbursed the homeowner for (12) purchases of bathroom paint and backsplash tile required purchased by the homeowner on behalf of BMT. Also, BMT overcharged the homeowner for the (13) installation of the back porch light, which was agreed as included in the contract price, (14) BMT grossly overcharged for the bathroom accessories which BMT directed and (15) BMT grossly overcharged for the installation of a new bathroom window, which BMT initiated.

We made several attempts to discuss the remaining issues with BMT, with each time BMT promising a certain degree of completion. The final attempt to resolve all outstanding issues with BMT was made on August 17th, via demand letter and telephone, where BMT indicated they were unwilling to complete the required work.

In November 2007 we won in Small Claims Court a settlement against BMT. Sean decided to appeal the decision and provided two affidavits in court in which he contradicted himself several times resulting in the judge denying his appeal. He is again appealing the judge's decision, thus trying to avoid his obligation. We were left lots of unfinished work and items, like our cabinet doors, which are now cracking and falling apart.
