Independent Contractors: Classifying a person as independent contractor usually reduces the small business owners exposure under laws and regulations governing the employment relationship and requires a 1099 contract to be in effect. An independent contractor is not legally considered an employee of a small business however; because of this classification, the rights and responsibilities that the small business owner has toward the independent contractor are different for those responsibilities he or she has for individuals classified as full or part time employees of the business. For example, non discrimination laws apply to the employer and its employees, but not to its independent contractors.


In exchange for using the advantages independent contractors provide, the employer substantially loses the rights to control the contractor. While the employer can still control and expect results however, the employer cannot dictate where, when, or how work is to be done. Thus, the employer loses control over the work processes, tools, and work schedules by which the work is performed. The demarcation between what constitutes an employee versus an independent contractor can be ambiguous. For example a person is more apt to be considered and independent contractor when:


A 1099 contract is involved and defines the relationship between the business owner and the contractor.


Submission of an invoice for payment for services rendered to the business owner for payment.


Usually has established a Federal Employer Identification Number (FEIN).


Responsible for his or her payroll taxes.


Work on a project with a definite completion date.


Setting ones own hours.


Possessing a high degree of skill.


Using ones own tools, materials and office.


Working on relatively short projects.


The above examples are based on common law interpretations and on a list of 20 criteria used by the Internal Revenue. Misclassification of people as independent contractors can result in substantial tax liabilities and fines for the small business owner. When in doubt always consult an employment attorney.

This report was written by Monica, which is the female name for Mr. Ryan Reagan. Mr. Reagan is a transsexual man who, for whatever reason, wants to harm Business Recovery Services (BRS). So, let's address Mr. Reagan's complaint.

Mr. Reagan claims that he was an employee at BRS. This is 100% untrue. Mr. Reagan signed a contract with BRS which clearly indicated that he was an independent contractor, and not an employee. Yet, Mr. Reagan continues to live in fantasyland and wants so badly to believe that he was an employee.

BRS filed the appropriate documentation with the Internal Revenue Service (IRS), and the IRS has determined that the workers at BRS are independent contractors. Why Mr. Reagan doesn't want to accept the truth is beyond BRS' comprehension.

However, a look into Mr. Reagan's past and his decisions in the recent past may shed light onto his true character. Mr. Reagan is a convicted sex offender, and he was specifically convicted of a sex crime against a minor. He is serving lifetime probation for this crime.

In the spirit of giving people a second chance at life, BRS provided Mr. Reagan with an opportunity to work and change his life. And, what thanks did BRS receive? Mr. Reagan elected to file false claims against BRS. Now what could be worse than that, right?

Well, Mr. Reagan manages to do things worse that that. He elected to leave BRS and work for a fraudulent business opportunity called Bankcard Empire, even though he was well aware of Bankcard Empire's business practice of ripping-off the American public, and primarily the elderly, while he worked at BRS. Why did he leave? Because the person that the State of Arizona alleges is the owner of Bankcard Empire, Mr. Leslie Mersky, offered him a better deal and "took care of him."

On April 13, 2010,Bankcard Empire was raided by the State of Arizona and the United States Postal Inspector's Office. Mr. Mersky was arrested and charged with fifty-one (51) felony counts of fraud, including assorted charges of forgery, identity theft, etc. This is the type of company that Mr. Reagan seeks out and with which he wants to be associated.

Now, rumor has it that Mr. Reagan works for a company called Business Recovery Group (BRG). Although I cannot confirm this rumor, this decision would fit into his character. BRG is a company that pretends to recover money for victims of ill-fated business opportunities, but never actually recovers money. In fact, every former BRG client has stated to BRS that he/she never received anything whatsoever from BRG. In addition, rumor has it that this is another Bankcard Empire operation that could be possibly headed up by the very same Leslie Mersky (yes, he is out on bond). For the record, Mr. Mersky was convicted of the largest non-drug related money laundering scheme in United States Customs history.

On the other hand, BRS has assisted its clients in recovering over $1,300,000 from a wide variety of ill-fated business opportunities, including over $70,000 from Bankcard Empire and/or its licensed companies.
