I gave this company $561.00 to advertise my timeshare.  A few days later, I called the company requesting cancellation and the representative told me no.  The rep. said they don't give refunds. Conveniently, this conversation was not recorded.  I called two or three weeks later to talk to someone else about a refund and they said it was too late.  Two weeks after that, I sold the timeshare back to the resort and got an upgrade.

I sent the settlement papers to "Butyatimeshare.com" and they refused to honor the refund.  The company said it stood behind the "Money Back Gurantee" if I sold the timeshare myself.

Lewis, the rep, said it was a transfer not a sale.

This company is taking poor struggling people's savings.  This is wrong and fraudulant.

Hello Kristi Johnson,

After reviewing your complaint, it is unfortunate that you feel we have not upheld our Money Back Guarantee.  We pride ourselves on Customer Service and you were offered a fair solution in order to help you.  You did sign up to advertise your timeshare in hopes of finding a Buyer.

Our system shows me that you contacted us nearly 30 days after signing on with our company.  The cancellation policy was explained to you several times.  Later in the same month, you stated that you sold your timeshare for a price that would qualify for our Money Back Guarantee.  You submitted the paperwork showing your timeshare was transferred back to your resort to help consolidate the debt on the existing account.

I explained our Money back Guarantee to you, as you may have not have reviewed it prior to contacting us.  You did not sell the timeshare, but simply traded it to your resort to eliminate your debt.  This is if one were to trade in a car to purchase a new vehicle.   You are not selling the car.  The paperwork would acknowledge a Trade In value for your new purchase and that credit would be applied to your new loan for your new vehicle.

Our Money Back Guarantee applies to an owner who successfully sells their timeshare in any way other than our services.  This means the owner can sell the timeshare on their own, through a Broker, or even another advertising company.  The agreement clearly states, however, that trading a timeshare back to the resort does not qualify for a refund.

You do still own a timeshare.  And we have offered to salvage your account by modifying the advertisement to reflect your new ownership.  We will even continue the marketing at no further cost.  Instead, you declined our offer in hopes of using a lawyer to help recover fees.

I really do hope that this better explains why a Trade-In does not qualify for our Money Back Guarantee.  We at BuyATimeshare.com are still hoping to help you with your new timeshare membership.  Please feel free to contact us anytime.  We will enable the existing account at no additional charge to you, in hopes of helping you in the future.  If you have any further questions or concerns, please contact me directly at 800-640-6886 x 6103.

Sincerely,

Luis Villeda
