My son got his senior photos taken by Cady Studios in Alpharetta GA in Jul/Aug 2013. At the time of his sitting they made him sign a document (he is under 18 and no parent accompanied him) whereby he agreed to return a portfolio of pictures they send as proofs of his different poses within 30 days of receiving them. My son doesn't remember them telling him that and I was never informed by any means of my requirement to return the portfolio under that timeframe.
I received the portfolio in the mail from Cady in late Aug 2013. It took me awhile to coordinate with ex-wife and grandparents on what pictures to pick and I shuttled the portfolio (which I thought were proofs) back and forth so that we could all make a consolidated purchase. I also thought there was no timeframe to order the photos except to get it in in time to make the yearbook.
I ended up ordering in Dec 2013 and getting the photos in Jan 2014. At this time, I received an email and letter from Cady telling me I had not returned the portfolio within the 30 day terms and would be charged $99 (which time had expired 3 months prior so why did they wait so long to remind me?). Again, I had assumed the portfolio was proofs and didn't need to be returned, especially since I had ordered ~$200 of pictures.
When I realized the portfolio was not proofs and needed to be returned, I immediately dropped off the portfolio at the local office in Alpharetta GA. I emailed (multiple times) the Cady customer service manager to explain the situation and to hopefully negate the $99 charge. This, though, did not stop Cady's customer service manager from completely ignoring my requests and the charge was made.
Unbelievable for a company I already spent $200 with and had returned the portfolio (the customer service manager has informed me that they are shipping the portfolio back to me since I have now paid for it even though I don't want it!!!). I have steam coming out of my ears. It shouldn't matter how long I held on to the portfolio as long as I ended up ordering from them (I did) and then returning those photos in the portfolio undamaged (I did).
In the end, it looks like Cady has this policy to get an additional $99 out of every potential customer who sits for pictures. If not, they would have immediately understood my plight and allowed me to return the portfolio late with no charges.

Unfortunatly you were beyond the time frame to return them. This would be on both you and your child. Your child for not bringing home any of the paperwork and you for taking so long to place your order. Your "plight" is of your own doing. Why would you expect them to give you a pass when you were CLEARLY beyond the time frame. Stop looking for anyone else to accept the blame for what is YOUR FAULT!!! What you are doing is childish and immature. Behavior more in line with your child then what an adult is expected to do. Accept the fact that your kid didnt bring you the paperwork, and there was paperwork. And accept the fact that you took your sweet time. These are all issues OUTSIDE of the photo companies power. NOW that you are being held accountable for your actions you seek to find someone else to place the blame. It doesnt work that way. You should be smart enough to see when you have boned yourself. To place the blame on THEM for YOUR problems only goes to show that you really are not as mature or responsible as you like to view yourself.
The web is a media outlet, as such ANYTHING YOU POST can be used against you in a court of law. What you have done is besmirch the reputation of a legitimate business. You made a nice little attack against them when they are INNOCENT in this issue. This means that if they chose to, they can retain a lawyer and sue you for damages. You may THINK your are anonymous online but your ARE NOT!!!! All it takes is a court order and they will know for sure that YOU made this post. You might want to remember this in the future, especially if youre going to twist the truth to make yourself out to be a victim.
Cady has to assume you wanted the portfolio since you did not return them in the time frame that they requested of you. It is NOT Cadys fault and you WILL be charged the fee. People like you always amaze me with the depth of sleeze they will sink to in order to get out of what they leagally owe. These are the same people who will beg for a pass yet give none themselves.
