I received a loan modification agreement from Cash Call and wanted feedback on anyone else that has received it.
PLEASE I am not looking for angry responses about how much of a ripoff the company is, that's obvious. NOR, do I want to be reminded how vulnerable I was in a time of need. Just want EXPERIENCED answer to my question.
Details:
Original loan was $2500, I was paying on time, but lost my job. Informed my bank to cancel their ECH (automatic debit) and haven't been in communication with Cash Call since middle of last year (they only had my work number - and can't remember who I put as reference).
SO, since last year, I've received numerous emails and snail mail asking for the money, additionally, I have received modification agreements stating they will lower my interest and my payments. They also asked for a "down" payment stating that will "wipe my slate" clean of any past due amounts, and that amount has loweed each month they send me a letter. They ask the payment be sent moneygram or to send a money order/check, but never ask for my checking information in the agreement (yet).
Questions:
1. Have you ever signed and returned the modification agreement and stuck to the payments?
2. Do they allow you to continue paying with money gram or mailing in a money order (they will never get my checking account information again)?
3. If you have had success with the modification agreement, do you think I could MODIFY the agreement by adding a line stating I will agree to the terms under the conditions I can pay with a money order or money gram.
Thanks for any information you can provide. I hate not paying my bills on time and although I'm working again, I can't pay the original amount but their modified amount is realistic.
AGAIN, please no nasty responses...no negativity...just answers.

They called me just today Ms. Davis (so she says her name is) offered me a 1200.00 settlement. Of course payments would be 250 a month 6 payments!
That don't add up right.
She said if I don't take it they will sue me this week for 4000.00.
I have 48 hours to decide.

Regarding modification agreement

I can help you. Don't know what State you are in (doesn't matter really) but I have experience working with this unethical company. After 2 payments in 2005 I had problems with this company and than I closed my account. Than they offered to modify the agreement and lower the amount. I signed it , faxed it back, never heard from them. Then a couple of months later they sent me a lower amount or pay off amount they were willing to do. $2500.00 total About a day before the expired deal I went to my bank and my bank called them they said nope this is at some crazy amount $4300.00.
Well, I said no way and that was it for about 1 1/2 years. Now in November 2007 they filed a small claims against me for exaclty the amount I borrowed $2500.00. This time I knew they couldn't change the amount. I went to the bank, I showed them the complaint to the amount that Cash Call said I owed $2500.00 not any other crazy amount and money order was sent by certified mail. Within 5 days of this money order they cashed it and dismissed the case.
This is how far I took it and all there threats and modificaitons mean nothing until they go to Court. That can't back out of the amount with the Court. And that is what happen to me. Cash Call is nothing but a typical scam ride. I stuck to my guns and waited for the right time and I paid back what I borrowed and not much more I knew they were not going to be able to collect on that interest.

Do Not and I mean Do Not sign any papers. I too am in the same situation that you are with this company. I actually paid money and hired an attorney to investigate this company. Everything they do is illegal. The phone calls, the loan, the way they make you sign the loan, and so on. Granite it is on your credit report and it will probaly be wrote off as bad debt, but there are ways to fight this company.
Go to BBB website and file complaints. Enough complaints could possible bring a class action law suit.
Anytime they call, answer and say I am attorney repped. You can talk to my attorney from here. I mean I am attorney repped and I told them that and they stopped calling everyday to once a week.

Sounds like they are desperate. This is good as it gives you tremendous power over them. They want your money and are playing nice to get it. Too bad for them you're not buying their BS and caving in to their demands. DO NOT sign anything. Just tell them that you like things the way they are. Keep paying them with money orders ro cashiers checks. You are correct in not giving them your bank account information. So you are smart not to write a personal check to them.
If they threaten court it's just that; threats. The amount of money involved is not worth them chasing after you. They may even say they are going to have the Sheriff come over and arrest you. Again, this is nonsense and just shows how desperate they are.
As long as you are making the payment in full every month Cash Call can get bent.
Oh, if you insist on negotiating with these terrorists make sure you get EVERYTHING in writing. If it's not in writing then it doesn't exist.
