Hi I usually make my payments on time. On the occasion when I do make a late payment I get harassed in a strange way.
I have, in the past notified CashCall that I was not going to be able to make my payment on time. That the payment will be a few days late. I tried to make arrangements, but they say ' when our computer system has you scheduled, there is nothing we can do to stop the payment from hitting your account.'
So I make payment arrangements with them to pay it a few days later. So they hit my account. I get my usually $30 NSF fee. Then I usually get an email from Cash call saying that the will automatically deduct this from my account, usually a day after I make the arrangement. I call back. I say I already have made arrangements to MoneyGram them the payment. The tell me again, once it is in the computer system, there is nothing they can do to stop it from hitting my account.
So if I would have made the arranged payment a day earlier, the automatic computer payment will hit my account anyways, charging me another $30 NSF fee. I call CashCall back and ask them why were arrangements made for me to pay via MoneyGram, if the computer system was going to automatically deduct this from my account. They told me they have 3rd parties trying to collect the payment also, and that they are commission based so most of the time they disregard any notes on the account. Here is where the harassment start.
On the day that the computer automatically takes the payment out and is reflected by my balance, I start getting calls again to call CashCall to make my payment. I call CashCall up and notify them that the payment was made and the money is already taken out of my account. Then say, again, that there is nothing that they can do, that the computer will still be auto-dialing my number to make arrangements to make the payment.
I get 2-4 call per day, every day for about a week. I keep telling them that the money is already out of my account and to stop calling me. The tell me that the just took me out of the auto-dialer and that I will not receive any more calls. I still get calls, every day. If I notify CashCall that a payment is made, and taken out of my account, can they still keep calling me 2-4 times a day for payment? That does not seem right to me.

A cease communications request under the provisions of the FDCPA only applies to THIRD PARTY debt collectors.
Cash Call is collecting for themselves with their own in house employees. This makes them a FIRST PARTY creditor, and exempt from the provisions of the FDCPA.
The ONLY way to stop these fools is to hit them hard. Make them see it your way.
1. IMMEDIATELY close any bank accounts that they have access to, and re-open new ones AT A DIFFERENT BANK! This is very important.
2. Change your email address,or block them as SPAM, and do the spem complaint.
3. Change your phone# to an UNLISTED one, and never again call them from that phone, as they can trap the # even if it is private/unlisted.
4. Any mail you get from them, mark "DECEASED" across the front of it, and drop it in a big blue mailbox. This is my favorite.
Now that you have gained TOTAL control over these freaks, you have 2 choices.
1. Ignore them until they sue you.
2. Wait a few months and then walk into one of the offices and sit down with a manager and put a payment plan in writing. DO NOT give them any of your new banking or phone info, etc. YOU set the terms. Not them. Pay them ONLY with money orders.

You may want to take a close look at that. The rules for collection are different for the original company and a third party collection agency. Yes if you tell the third party not to call you they can not call and many other rules. however as you owe the money directly to cash Call, they have more leeway in contacting you.

Send a Cease Communication letter. They can only contact you one time after you've sent it and that is to acknowledge that they have received it. Send it certified w/a return receipt. I've been told this by the FTC. File a complaint. They will give you a complaint number. Although they can't inetervene, they will take your report. The number for the FTC is 1-877-382-4357. They referred me to the The state Consumer Affairs Division's number is 1-800-952-5225. Check with an attorney also. I have put in a couple calls to find out what rights I have. I can't believe they let these people do this kind of harassment and get away with it.
