I sold a White Louis Vuitton Suhali Fabuleux purse to Michelle Wendell - Chic Little Devil on e-bay. She said she never recieved it and got her credit card to reverse the charge. Now I'm out the money and she has the purse! Retail its worth over $4000.
After winning the purse on e-bay Michelle stated via e-mail, over and over again that she did not want me to get insurance or tracking when I shipped it to her. Fortunately I had UPS package the purse and I purchased insurance for the full purchase price. Once I got confirmation of delivery from UPS I contacted Michelle Wendell - Chic Little Devil and she said she never got it. Then I never heard from her again.
The next thing I know Paypal informs me there is a dispute against me! This is still being "reviewed" so I don't have an outcome yet, but I don't think ebay or paypal is being aggressive enough in their investigation of Michelle Wendell - Chic Little Devil.
Bottom line...this woman is a fraud!! I have all of my documents and am prepared to take legal action against her.
This was the first item I ever sold on e-bay and I will NEVER but or sell anything through them again.

Hi,
I have complete sympathy with everyone who's had a problem with Michelle Wendell. I had a similar bad experience with her. I live in the UK and bought an item through her eBay store, which I never received. Each time I emailed her, she promised to track the item, but then never got back to me. This went on for weeks. At one point, she even told me the item had not been despatched until 3 weeks after I'd paid for it, so I took her word on it and continued to wait. Eventually, she stopped replying to my emails. Because I'd waited so long, I'd unwittingly missed the 45 day deadline to claim my money back through Paypal ($146). Having lost my money and with Ms Wendell now ignoring my emails, I felt it was reasonable to leave her negative feedback. She responed by leaving untrue negative feedback for me, claiming I hadn't got in touch with her to say the item hadn't arrived and that she was completely unaware there was a problem!! Then she tried to pursuade me that if I agreed to withdraw the negative feedback I'd left, then she'd refund me in full (but she said I had to withdraw the feedback first). I didn't believe her, so refused. Her emails then became verbally abusive and rude. I eventually managed to get the feedback she'd left for me removed by eBay under their 'defamatory feedback' rule (although eBay didn't make it easy - I had to go to my local court and get a statutory declaration of defamation!).
Even though I explained my situation to eBay and Paypal, providing proof of payment and correspondance with Ms Wendell that proved my side of the story (she couldn't provide proof that she'd sent the item), it took over a year before eBay eventually agreed to refund me the money.
Ms Wendell always claims to have evidence to support her version of events, but she never actually seems to provide anybody with this proof in any of the cases against her; instead she just keeps on telling lies on top of lies in the face of overwhelming proof against her. She also keeps going on about her 98% positive feedback but, as she states herself, she has such high sales that 2% of negatives actually represent a substantial number of customers and amounts to thousands of dollars worth of sales, not to mention the fact that her negative feedback percentage would actually be higher were it not for the number of negatives that get retracted by buyers desperate to get a refund.
I'm really glad that the eBay seller in Canada's case was found in her favour. Like the other buyer from the UK, I would urge everyone who's had a problem with Michelle Wendell to file a report at the LA city attorney's office, and also email Paula Rockenstein, through the links she has kindly provided above.

I really feel for your frustration. I too was a victim of Michell Wendell but in a sense that I purchased Items from her and for her to send me papers instead of clothing. We are getting together because it seems like she likes to rip canadians and others off. There's another victim of her's that referred me to the district courst of Santa Monica which is the district where she resides and you can file a compalint with them and also here's the attorney's email address and contact info. Keep all your documentations that will back you up because after 2 years I've also kept mine (all the emails and envelope that she sent me with the custom's form that she filled out stated the contents are "documents"). here's what the lady from the UK gave me. good luck:

As for the person who wrote #7, thank you for the level head!! :) For a minute i thought i was the last person on this green planet speaking in ADULT, rational terms!
Judi Kempf (seller who refuses to just take the correct actions), please re-read every word I have said above in my 2 rebuttals. It is proof-positive that you have lied more than once and that you are seriously making some deluted or emotionally-charged statements and decisions. This is a cut and dry factual situation, and i feel just as screwed as you probably do, after not getting the bag and having to pay more to get it elsewhere!!!!!
The chargeback was filed for NON-RECEIPT with amex. I know that for a fact, I called and filed it. Rather that translated to paypal I do not know, as I did not file a paypal claim, it was an Amex chargeback. I have no idea by what methods amex reports the info to paypal. I also know that the confirmation codes I gave you from amex are 100% correct and verify that the chargeback was for non-receipt and that they are providing re-issuance of the letter stating that it was closed in my favor. NOW I SEE WHY!!! not my signature!!! I have been with amex and they KNOW!! i have invited you several times (via direct email and also here) to email or call me so that we can call amex together and they can verify for you personally that the chargeback was filed for non-receipt and that is was closed in my favor. you would rather hold on to your lies and inaccuracies than just call and get it straight???? they could and would immediately give you the FACTS for godsakes!!!!
I have been really empathetic with someone ( judi kempf ) who has been NOTHING but crappy and accusatory toward me (i even offered previously to help), and it has done nothing other than backfire in my face and test my patience.
I have decided that no matter how much I try, you can't reason with someone who is not willing to reason back. and you can't try to be open minded when someone is not being open-minded in return, so.......
I am DONE with this completely. As my final step, when i receive the letter re-sent from Amex stating that the chargeback was closed in my favor (CLEARLY b/c that is not my signature), I will scan it and send to you (judi) and post it on here. THAT IS THE LAST THING I AM DOING TOWARD THIS.

Someone who does the amount of business on E-Bay that is indicated, both buying and selling, should perhaps re-think their policy on retaining records that pertain to charge-backs, credits, disputes etc.
The buyer indicates she did not keep the letter from her credit card company because the decision was in her favor. This seems like a poor, if not foolish practice. The credit being issued can be reversed for several reasons; any business-person should know this fact. While the letter may not have been important to the buyer, it certainly would be important to legal council if such action should be required. Keeping it seems prudent - if not imperative, especially since the dollar amount involved is quite substantial.
Does it not seem questionable that the buyer admits to instructing the seller to ship the product as cheaply as possible, without INSURANCE or any form of protection for BOTH BUYER AND SELLER? I question the motive behind the buyer instructing the seller to do so; fortunately the seller had the proper mind-set, had the item professionally packaged, insured it for the full value and appears to have retained all records to substantiate packaging, shipping, insured amount and receipt by "someone" --- verified by signature.
Emotions run high in these situations. In this case the seller appears to have proof-positive the package was delivered. The buyer denies this is correct. The obvious 'next step' is for the seller to initiate a claim through the shipper so proper handling and confirmation of delivery can be investigated. Simply complaining in a public forum will do little to recover the cost of the item in question.
Insurance exists and should be taken advantage of without delay. Being a "Power Seller" suggests the buyer is well versed (SHOULD BE WELL VERSED) in both the shipping and insurance aspects of business. Transfer of ownership and can only be made when payment is received and retained. Obviously the seller has not retained payment and per her own statements it is clear the BUYER is not out-of-pocket once-cent. Someone received this item; now is the time for cooperation, not name calling.

Attached is a copy of the Paypal dispute that I was informed Michelle Wendell filed...READ... "Buyer claims that the item was damaged on receipt or is signifcantly not as desribed".
NOW as you can see by the many rebuttals Michelle Wendell has written she claims she NEVER got the purse and NEVER signed anything from UPS.

LIE #3 BY YOU: you keep claiming that that chargeback is still being reviewed and might go in your favor. that is also a LIE!!! i just called american express. the chargeback was closed on 2/2/2010 in my favor. the case id for the chargeback was #JT49819. they sent me a letter verifying it was closed in my favor. today i called them and asked them to re-issue the letter (i receieved the first one but did not keep it since the case is closed in my favor and no further action is needed). Then i can scan the closure letter and post it on here asap. they said it should be 7-10 business days but could be sooner. the case id for this call and the re-issuance of the chargeback closed letter is #K211543. feel free to call me today, i will give you my cell number privately if you email me via ebay. we will call amex together and verify this fact!! amex is 1-800-528-2112. anything to shut you up.

LIAR FRAUD RIP-OFF
UPS CONFIRMED DELIVERY AND HAVE HER SIGNATURE!
Michelle Wendell is a LIAR, a FRAUD and RIP OFF artist....our case is still under review by paypal and credit card company....I stand by my story. Just look into her past and see how many people have filed complaints against her!
UPS packaged the bag (in front of me and many other people in the store) and confirmed that Michelle Wendell signed for it upon delivery!
She has made NO attempt to contact me or to reply to any of my messages until today when I told her that I found a trail of her fraud and now it's going to catch up to her! Look at all the complaints against her!
I will not stop until this woman gets what she really deserves! JAIL

As far as this site, I make it a very strict practice not to respond in this forum to people who bring up ebay tiffs that are fixable or already taken care of (i make direct contact with the customer instead and make it right). i do this for 2 reasons.....
1. we sell over 70 items per day on ebay, and purchase over 10 items per day on ebay. that is over 2,100 items sold per month and over 300 items won per month on ebay!!!
2. as you can clearly see if you look at our ebay store feedback (www.chiclittledevil.com) 991 out of 1,000 individuals report VERY VERY positive feedback all around! :) we have repeat clients of 11+ years the LOVE us, as you can see, and we work hard for them. i also have clients i have been buying from for over 10 years, luxury and vintage designer goods!!
With 11+ years as an ebay powerseller, i am a legitimate and honest buyer, i pay for all my wins right away. i always use paypal so i am protected. as far as a seller, i value ALL clients a ton. Service is super important to me!
But, my policy is NOT to engage crazy people in mud-slinging matches.
in this case, it is TOO MUCH TO IGNORE, AND I AM QUITE FURIOUS AND I'M GOING TO STAND UP FOR MYSELF!! THIS IS A LIE AND THIS PERSON IS 100% IN THE WRONG. I DID NOT GET THE BAG, I HAD TO BUY IT ELSEWHERE, AND NOW SHE IS MAD THAT A FILED A CHARGEBACK AFTER NOT GETTING IT OR BEING TAKEN CARE OF!!! RUDE!!!
I won a bag on ebay from this woman. she had never had one transaction at all on ebay, so i was hesitant (and should have trusted my gut), but the bag looked cute in the photos and seemed authentic. i asked for shipping the cheapest way possible to save money since it's international (me in the USA, her in CANADA). as you can see, this is the FIRST and last time this user has ever even used ebay!!
i NEVER NEVER NEVER got the bag. i waited weeks. i asked her twice, and i told her twice i did not get it. she denied what i was saying. i really wanted & needed the bag, and after waiting weeks, i actually had to buy the bag from another seller for more money!! so this actually ended up costing me more financially b/c i did not have the trust to buy another one online. i have the RECEIPT for purchase from the consigner!!!
my ebay powerseller manager marie advised me not to hound this person about "where is my bag" and that my last option would be to file a chargeback. they said that going back and forth with her was not going to go anywhere if the bag was indeed stolen, that is if it was ever delivered in the first place as the seller tries to claim!!
THE CHARGEBACK WAS DECIDED 100% IN MY FAVOR and i can provide the letter from my credit card company stating that fact. That is probably why this person is mad. The reason the chargeback was decided in my favor is because the bag was never receieved by me and I never signed for it!!!! It's that simple. It was thoroughly investigated!
I AM HONESTLY 100% IN SHOCK THAT SHE EVEN SENT THIS!!!! THE NERVE!!! I THOUGHT SHE WOULD BE APOLOGIZING TO ME BECAUSE I DID NOT GET THE BAG I HAD PAID FOR!!!!!!! INSTEAD SHE IS BEING RUDE AND VINDICTIVE ABOUT IT.
WHAT'S REALLY SAD IS THAT WE COULD HAVE WORKED TOGETHER TO FILE A CLAIM IF YOU HAD JUST ACKNOWLEDGED WHEN I TOLD YOU I DID NOT GET IT!! YOU SAY THAT YOU "PURCHASED INSURANCE" SO WHY DIDN'T YOU JUST ASK ME AND WE COULD WORK JOINTLY TO FILE YOUR CLAIM??? AND YOU POSSIBLY COULD HAVE FOUND THE BAG SO I DIDN'T HAVE TO SPEND MORE MONEY ON ANTOHER. UPS ADVISED ME THAT IF IT WAS NOT INDEED DELIVERED TO ME, THEN IT WOULD GO BACK TO SENDER. FOR ALL I KNOW YOU HAVE IT, and that's why you didn't want to file a claim. if you are serious about being an adult and not slinging mud, email me privately and we can file a claim with this insurance you say you bought. i will be asking you to keep it 100% civil however!!
IF ANYONE SHOULD BE FILING A RIP-OFF THING IT'S ME!! If my credit card company and paypal had not defended me in this case (thank god they did) i would have been stuck with a $2000+ bill for something I never got!!
