Chic Little Rip Off by Michelle Swindle - How does she sleep at night!
I live in the UK. I bought a 'Brand New With Tags' Aqua Suede Romp Jumpsuit from ChicLittleDevil.com / Michelle Wendell. When I received the item it was filthy, had no Romp tags just a grotty paper tag with string and some numbers scrawled on it. The straps were covered in black stains, the bottoms of the trousers filthy and dirt and marks all over it. I have taken extensive photographs of it. Item no. 280389174957
I sent it back to Michelle Wendell for a refund. She did not apologise, lied and said it had not been worn. I filed a dispute with PayPal, at the same time as declining my refund request she also said she would do a refund if I left her positive feedback!
I posted the item back on 17th December by International Signed For and Tracked / Insured up to 300 with Royal Mail. The item arrived in the US on 18th December. Unfortunately USPS have not updated the tracking details since then and refused to investigate what has happened to the item until Royal Mail contacts them. Royal Mail will not investigate until 25 working days have passed since the item was sent.
Michelle Wendell relisted the item for sale on 30th December Item No 350299375656. Prior to buying the item I had spoken to Nina Morgan Jones (who owns Romp), and have email proof from her that she made only one of these jumpsuits in this colour, which she sold to Michelle Wendell, so I could only buy it from the Chic Little Devil store on ebay, there is only one. I emailed Michelle Wendell saying since she has received it back and relisted it please could I have my refund, she lied and said she had not received it, and that she would only refund once I'd left her positive feedback...
I escalated the PayPal dispute to a claim and left her the negative feedback a lying rip-off fraud deserves.
Sadly, despite sending PayPal the emails from the designer saying there is only one of these jumpsuits, and ebay confirming that she has relisted the item for sale, PayPal tell me that this is not sufficient proof of delivery. The reason they gave - because the seller could have another counterfeit version of the jumpsuit to sell!!!! What!!! So in a few days the case will be closed and I will have lost all my money.
I have only just been able to send off the forms to Royal Mail to commence an investigation once the 25 working days have elapsed, which they advise me can take up to 90 days to complete. I have wasted countless hours and money calling USPS asking them to update the page to show they've delivered it... I must appeal the PayPal case within 10 days of it being closed or I can no longer do so, so it seems unlikely that I will receive the proof Michelle Wendell has received before the 30th December, so I will lose my money and she has successfully stolen 484 and has the filthy jumpsuit for sale again. Since I know it has been delivered, I can only assume Royal Mail will find this so I will not be able to claim the insurance either. She has told me that she will not refund me unless I remove my negative feedback - Feedback extortion (I think most of her positive feedback is fake from friends/colleagues). But why should I trust that she will do this when she has lied about everything else and can look at the Royal Mail and USPS tracking and see they have not updated it.
I reported the item to ebay as fraudulent since it is not new with tags and is filthy, but they have done nothing about it, it is still there for sale waiting for the next unsuspecting buyer to be ripped off.
I think Michelle Wendell probably has some sort of deal with her postman that he does not scan items when she signs for them...
I really think it is disgusting that both ebay and paypal support a fraudulent seller who is both a thief and a liar, and a quick look on the internet I can see tonnes of other people have been ripped off by her.
I intend to do everything I can to ruin her should I lose my money. She should be investigated by the police, taken to court and locked up! Can anyone assist me in this?

Hi, no worries, I just wanted to try to do something to help everyone else as I think I was very lucky to see my money again... I think she is ripping off more people than ever, it's just she tricks them into leaving positive feedback or changing a negative by saying she'll only refund once the positive is left, luckily I didn't believe her so my negative I think is the only one there for yonks... if you read all her positives a lot of them are really negatives, and the rest are mostly fake I think... I tried to message everyone on this website with the form and email details, but some of them don't seem to have gone through/appeared... I'd almost given up on getting my money back, but I thought I'd have a look at the Santa Monica Police online, and bingo, found the consumer complaint form and they got back to me really quickly, so I think if lots of people do the same, then maybe she can finally be closed down at some point so at least more people aren't ripped off, though it would be nice if everyone could get their money back... I have my fingers crossed for you anyway, a bag full of papers is just disgusting, at least I did get the item though it was foul and I didn't even want to try it on, the rip off ploy came when I sent it back... I think Michelle Swindle is just one very horrible person who thinks it's her right to lie and steal from people... the grovelling apology and refund I got was just because she was scared and completely embarrassed cos I knew the designer and got her to contact her and say she only made one, so if she'd relisted it that had to be it... Ebay and PayPal are shocking they just don't care... Good luck and be sure to pass the Attorney's Office details on, if we could get someone to actually paste the form link into her feedback under a negative that would be great, assuming ebay don't remove it, but I had already used my negative up before I found it... I hope maybe there's a chance you can still get your money back though if you've got all the evidence, even if it was a long time ago... x

Thank you UK for sharing your experience and what you had to do to get your money back and an appology. I was the very first one to actually post my problem here on ripoff report because i too bought 3 t bags Item from michelle but only for her to send me envelope full of papers (this was almsot 2 years ago). I tried ebay, paypal and my local police department and to no avail. I'm glad that someone like you has other leads as to how to help out those of us who needed help and for that i thank you. I can now sleep better at night knowing that she didn't get away with it. I checked her feedback lately and glad the number of people getting ripped off are lowering. It's sad to see people getting ripped off for items that they sell or buy. I took your advice and I did email the santa monica court district even though i know my statue of limitation has probably lapsed but I wanted to at least let them know that she's done this to numerous and countless people everywhere. Bravo to you and your persistance.

I sold her a purse, UPS confirmed delivery and got her signature, she's claiming she never got it and while it's still under review by paypal I don't feel they are doing enough.

I saw your posting. Ebay and PayPal don't do anything about her. If you read the final bit of my posting, you will see what I had to do, and how I did eventually get my money back. This is the Santa Monica City Attorneys Office, and they responded to me very quickly. The email address of the officer there who was dealing with it was Paula.Rockenstein@SMGOV.NET a consumer affairs specialist. The threat of action made Ms Wendell give in in the end coupled with the designer contacting her. However, Paula asked that I send her all the information anyway so that she would have it for reference if there was a pattern of this with Ms Wendell (which clearly there is)...
If you have proof that she received it, ebay and paypal should rule in your favour, my problem was that USPS never updated the website to say she had it, so in spite of the fact she relisted it and there was only one made, they ruled in her favour. Having said that they take ages, and don't give a stuff about it... Ms Wendell eventually refunded me by making a payment to me instead of refund through PayPal, so PayPal took $20 out of it as a fee... I then threatened to report them to the Ombudsman, and got a pathetic reply saying they had found that Ms Wendell had 'finally' received the item back (they knew fool well that she got it well over a month before) and they were putting 20 into my account as 'a good will gesture'...

This fraud bought an item from me off ebay then said she never got it! Lies!!!! I had UPS package and ship the item, they got her signature on delivery! Ebay and Paypal are doing NOTHING about this and her fraudulent behavior! They are still "reviewing" the matter...meanwhile I'm out the money and the item! I will do anything to to have her locked up!!!

28th January - Ms Wendell emailed me to apologise and refund my money in full for the item I bought on 23rd November. I am grateful to her for finally doing this. I achieve this outcome by filing a report with the Santa Monica Police at http://www01.smgov.net/communication/cityforms/consumer-complaint.htm
I also asked the designer to contact her. I am very grateful to the designer and the Santa Monica City Attorney's Office as this enabled me to finally get my money back and the apology I deserved. I was utterly disgusted with the service I received from PayPal and Ebay. PayPal completely disregarded the proof I submitted that the item had been delivered. They told me that the posting method I had used (which they advised me to use) - International Signed For with Insurance - was invalid because USPS failed to confirm delivery despite the other evidence and proof of posting I supplied. They ruled in favour of the seller and were quite happy to let a theft take place. They told me I could appeal the claim within 10 days (this was not true, I could not). I also don't think they do their sellers any favours by taking this stance as it allows them to be dishonest and forces buyers to take further action against the sellers, so damaging their reputation, wheras if the resolution process was fair in the first place none of that would be necessary. My advice to anyone who encounters this type of problem with Chic Little Devil or any other ebay trader, is that PayPal and Ebay will not help you, and do not care about fraud and theft on their website. Find the relevant state police website or attorney's office (the Santa Monica one had a form I could fill in) and file with them if you want your money back. The threat of legal action and police involvement is usually enough to make a seller who knows they are in the wrong refund you... As a note, because Ms Wendell sent my refund as a payment, PayPal have taken $19 off it as a fee... what a joke!!! After the service I received from PayPal and their non-existent buyer protection programme, that they should make money out of it is disgusting...

Fraud, feedback extortion, blackmail, plain theft, lies and more lies to cover up her filthy sales and a stack of fake feedback to mask her performance as a seller, some of the feedback is actually a reply to the negatives she leaves - clearly organised by herself!
I really think it is disgusting that both ebay and paypal support a fraudulent seller who is both a thief and a liar, and a quick look on the internet I can see tonnes of other people have been ripped off by her. I intend to do everything I can to ruin her should I lose my money. She should be investigated by the police, taken to court and locked up and those who support her in her rip-off business should be held to account and take responsibility.
