Circle K Stores Inc. Circle K Circle K routinely denies legitimate claims. Damage caused by their sign is undeniable. Phoenix, Arizona

While purchasing gasoline at Circle K here in El Paso, TX one of their metal signs came loose from its location on the overhead structure covering the fueling stations. The sign broke out my front windshield and punctured the hood of my car, leaving a six inch hole. The sign missed hitting me by only a few feet. The clerk and the clerk's supervisor admitted they were worried that the sign was loose and might come off its mounting.

Several attempts to reach local representatives of the company went unanswered until I threatened obtaining an attorney. A representative from the regional headquarters in Phoenix then called and stated that they were not liable for "acts of God", claiming the wind caused the mishap.  He would not discuss the circumstances and hung up.  I received a letter a couple of days later denying any liability and telling me to contact my auto insurance company.

Circle K is not interested in doing the right thing, but rather they are interested in saving a few dollars at their customers expense. The damage, caused by their negligence in maintaining a safe environment, amounts to less than $1000.  

Perhaps they would rather defend a law suit.  I'm sure their risk analysis shows that most small claims, when denied, go unchallenged.  Perhaps a class action suit for th benefit of all those who have been unfairly treated by the greedy company will get their attention.
