My husband and I refied through Ameriquest in Feb. 2001. The closers rushed us through the process like cattle on the slaughtering market. My husband is a legally blind senior citizen who recieves Social Security and the closers knew this. My husband decided, out of sheer frustration, to stop making mortgage payments. He's tired of being ripped off! The equity in our home is nearly gone now and Citiresidential has tacked legal fees, defaulted escrow fees and who knows what else on to the defaulted amount.
A few months ago they returned a payment and recently informed us that we are not eligible for their hardship repayment plan. Our mortgage payment constitutes 85% of our monthly income and we have been forced to file chapter 13 in the hopes of saving our home. This is the second time we have been forced to file chapter 13 because of their predatory lending practices. We opted out of the class action suit to keep other legal options open to us.
We do not have the money to retain an attorney but are desperately in need of one that will help guide us or offer advice. My husband bought our home in 1972 and to date has paid over $300,000.00 for a home that was originally valued at $2300.00. We did not refinance just to sell our home a couple years down the road, we refinanced in order to keep our home for the rest of our lives! Is there anyone who is in a similar situation that may have advice as to what we can do?

Joe,
Thank you for your contact info concerning Peggy Weldon of the Minnesota Attorney Generals office. I spoke with her and she is going to contact Citi Residential on my behalf. She did agree that my debt to income ratio is way out of context and is going to "push" them into offering me a lower interest rate. She's shooting for a 7% for me. Citi was "kind" enough to "drop" my interest rate to 11.85%. Wasn't that "sweet" of them? Ms Weldon pointed out that my very recent chapter 13 filing may put a glitch in the negotiations as she was not quite familiar with the guidelines concerning a chapter 13 case. I'm hoping that all will go well on my end. Has anyone connected with a legal "buckaroo" yet? Let me know how things are going on your end.

Please remember to ask her about the Statues, and regulations about the debt to income ratio, which I believe you stated was 85% of your income.
Again, predatory lenders have no ethics, nor compassion towards the clients they are stealing from.

Dear Ruth,
I have been working with the office of Mn Attorney General and opened a case against AMC, Ameriquest, and now CITI Residentaul Lending, which is part of CITIBank Inc.
I have been sent several papers to fill out, and from what I gather my complaint is under investagation.
My complaint is different than yours, but if you look at the ripoff reports that I posted it might give you a better idea of what I'm going through.
My Social Security number and other personal information was breached and now I have to gather all of the information needed to proceed with my case.
The first post was dated on January, 9th, 2008, and I sent another on January 10th by mistake thinking that my first post did not post per se.
If you read them you might understand the debt to income ratio that I mentioned.
I will also foreward the information needed to contact the proper people in the Attn. General's office, because when I made my first call to the office I really got the run around.

Thanks for your reply. Your Right, we need to find a way to correspond with one another. Not sure how we're going to do that but, your right, something has got to be done. I have no intention of losing our home to these thieves after living in it for 35 years! I'm contacting Lori Swanson, the attorney general for Minnesota. I'm hoping I'll be able to get some advice as to what options are open to us. I'll post my findings as soon as they are available to me. In the meantime, I'll keep working on a way for us to connect with one another.

I have considered filing chapter 7 but I'm afraid Cit Residential will "steal" our home from us through the legal system. They have access to legal resources whereas we do not. I would ask your accountant to look into citi residentual lending (ameriquest) about the debt to income ratio. 85% of an income is to high to be granted a loan.
I also want to commend you about not settling on the lawsuit, it does keep your option's open.
I'm not a lawyer, but I to am looking for a good civil lawyer to represent me in filing a lawsuit against AMC, now Citi Residentual Lending.
If I retain a lawyer I will let you know.
