My complaint in a nutshell

US Bank - Seller agreed to pay $1500 in closing costs. However, when Kevin Yacyszyn, Loan Officer at CitiMac was processing the loan his computer would not allow him to apply the full $1500 towards closing cost. He indicated, sellers could only pay up to 2% of purchase price towards closing costs for investment property. ($58,000 x 2% = $1160)

However, he had a way to get around this matter. He proposed we amend the contract to indicate the Seller would pay $1160 towards the closing cost & pay $375 for the appraisal. He even contacted Brad Harris, the realtor representing US Bank to discuss same. However, Brad contacted my realtor to advise US Bank amended the agreement because the total exceeded $1500. Thus, a new amendment was written indicating Seller would pay $1125 towards the closing cost & $375 for the appraisal.

All parties agreed to this proposal, however, on February 14, 2008, the day of closing I was advised I had to come to the closing with an additional amount of $375. Since I had already acquired a certified check for the original closing amount, the title company agreed to accept a personal check. Hence, check number 2944, was written to cover this amount. Since this is my first experience buying property by myself; I did not have my paperwork with me & I was busy at work, it never dawned on me to question the additional $375.00.

Citimac never advised me that they had denied Kevins proposal. As I mentioned, during the closing my realtor happened to notice the error. Eventually, we got Kevin on the phone who advised me he was unaware the underwriter had declined to honor the amendment of 01/25/2008. After advising him I would postpone closing until this matter was resolved, he promised me repeatedly that I would not be left holding the bag for this fee. He went so far as to indicate that either he or CitiMac would reimburse me my $375.00. I think he told me this to fool me into proceeding with the closing.

However, now the story has changed. Suddenly, its not their fault/problem. Kevin is now attempting to recover the money from US Bank, which is fine. But let them wait for their money; I have allowed CitiMac over a month to recover this money. I feel I have waited long enough. Once again he changed the original agreement, as mentioned he indicated that either he or CitiMac would refund me for the appraisal, not US Bank. Also, to date I have not heard from Kevin since his e-mail of 03/07/2008. It's now May 22, 2008 & I have yet to hear from either Kevin / Citimac!!!

I will never do business with this company again & neither should YOU!

Mrs. Marshall is flat out lying!! She was not ripped off in ANY WAY! The underlying facts of this situation are true. She did not get her money right away for the cost of the appraisal, just as she said. I was in contact with her by email or phone 4 separate times and kept her up to date on the progress. I explained to her that we, CitiMac, were trying to get the seller to reimburse her directly, since it was they who agreed to pay for the appraisal in the first place. However, we were given the "runaround" from them for several weeks, being told that "it was being worked on..." I explained that to Mrs. Marshall more ahtn once. At no time did she ever say to me that she was getting irritated, or that she was angry and was going to report us. To the contrary, she said to try and resolve it as quickly as possible and to keep her posted.

After several attempts to get the seller to pay her and getting nowhere, (and by the way, the seller's realtor, Brad Harris, who brokered the deal was about as helpful as a fence post), we realized we would just have to pay her and "eat" the appraisal fee. We immediately sent her a check for th amount she was owed. We, CitiMac were never reimbursed the money. So if anyone was ripped off, IT WAS US, NOT Mres Marshall. Her only ligitimate complaint is that it took a few months for this to get resolved. Granted, I wish that we had been able to fix this much quicker, but we were trying to get the seller to do the right thing because we feared that what actually did happen, did happen.

Mrs. Marshall was NOT ripped off!!!
