On April 27th I placed a $50 order with Claire's Bowtique from Facebook.  She appeared to sell great stuff, was very friendly, always answered questions quickly, etc.  About 3 weeks after placing the order she shared with me that she was really busy and it would take an extra week or two to get my custom order.  I was okay with that!  THEN she told me my order was complete!  I was super excited and waited for about 2 weeks.  NOTHING!  I emailed her and she sent me back tons of emails saying it was complete and on it's way!  So, I patiently waited.  She would make comments on her Facebook page like, "The more questions I have about shipping, the longer it takes for me to make your orders."

It has now been 10 weeks and I still have not received my order.  Now she just responds to my email with responses such as, "I will check on it" or "I will get the tracking number to you."  I have complained enough on her Facebook page that she just automatically deletes me because she doesn't want her new customers to see it.

I have begged for her to refund my money and she has refused!  (Or she will say I can get a refund if I return my package to her.  Hard to get a refund that way when she NEVER sends the package.)  She purposely lures her customers past the 45 days paypal dispute timeline to avoid the hassles with Paypal.  It was easy to believe that it would take that long for a customer order to be sent.  Amiee McCarty Sima is completely believable but you will NEVER receive your order.  I am actually going to have to file a complaint in small claims court this week.  I would not buy from her!  I have done a lot of research and it looks like she no longer sells on Etsy because of customer complaints.  She also now has a website, www.clairesbowtique.com.  Be careful!  I am guessing she sends out like 1/2 the orders she receives so she can keep referrals going!

After numerous emails with Amiee, after contacting her credit union, after contacting the police, after contacting BBB, etc... we have come to a resolution.  As of this morning, I officially received a full refund that she processed through PayPal. (Not from her Claire's Bowtique account, but I am assuming another family member.) 

Although I am not happy, I am relieved to have received a refund.  However, it does not erase the hurt my girls experienced (they really wanted those stupid tutu's).  It does not erase the fact that I didn't have the gift I had ordered for a baby shower present.  It does not erase the hours I spent begging for my product/a refund.  It does not erase the hours I spent contacting agencies trying to figure out how to get my money back.

I will be returning her personal check to her.  And I am true to my word, I promised to update if I received a refund.  I have.  However, I have to say I would not recommend purchasing from her.  To much drama!

I am not going to acknowledge Suzanne on this post this is not her post. I can gaurentee that that check will clear. I am not a scam and I would have sent you items with out last contact if you had asked me to when given the choice of a refund or  your items. YOu asked for a refund and I sent it. I do what is right and I never missed anyones birthday tutu but again that is Suzanne talking so that is not the report i am talking about. Thank you Andrea I would love for you to cash it so you can see that I stick to my word. I wish more women would show some maturity that way you have and let it be done at that. I only had to send you a check since your husband threatened to come here and file small claims after speaking with my business attorney about that he informed me that that would be the only way I was protected or by sending a money order but we talked about that. Thank you again.

Amiee,

Are you willing to state for the record, that your personal check will 100% clear the bank with absolute no doubt in your mind?  If you do, then I will cash the check next Friday when I am back in Virginia and leave you alone.  I will also announce to the whole world that I was wrong about it.  And if it bounces, then I will go from there.

Also, I will ADMIT 100% that I was wrong about your check.  I hadn't seen the check.  (As everyone knows I am visiting family and my husband is in Virginia.)  He is the one who received the check.  When I asked him about the check we received he told me that it only had a name and was check number 43.  He mistakingly was talking about a check from a friend of ours.  A mix up.  You are completely correct that the check lists both your husband and your name, etc.

I am truly sorry for writing about the check.  I shouldn't have written about the check without having seen it with my own eyes.  I was wrong and I feel silly.  Of all things, I want to be 100% honest with my experiences and I feel bad that I would write something inaccurate.  I hope that clears my mistake up. 

See- I can announce to the whole world I was wrong about the check number, etc.  I will easily announce that I was wrong about suspecting your check for bouncing.  All I want is a refund!

What? That's not a duplicate check!

First of all, that is not a duplicate check. It is the register page where you input a written record of your transactions- YOU write that. A quick look at the "real" check you posted shows different spacing and placement for fields like the signature and what-not if doubts remain.

Secondly, aren't you supposed to refund the payment form issued? Are laws different in your state? And you can issue her a Paypal refund via the 'send payment' option. Remember that's how you refunded mine? I thought it would turn out being another of your little games and since it was a payment you initiated, versus a refund transaction, you could claim it was for something you purchased/never received and get the monies back; luckily you wrote in the notations that it was a refund (the picture I posted on my rip off report where you threaten to 'charge me' if I don't remove your name from rip off report and blame me for not noticing you were doing the refund wrong...even after I did notify you days earlier on rip off report). So you see, you can refund her via the payment option in paypal- I don't understand what the deal is because you've done it before.

I don't know if you set out to intentionally scam people or if you just grew too quickly but since you are a business owner/consumer/mother, I don't comprehend why you can't understand why we are irate.

I'd venture saying you would be pretty ticked if you purchased something from someone and they strung you along for weeks. You get tired of hearing lies. Think about if someone ruined a special day or event for your daughter. I've read those heartbreaking posts on YOUR Claire's Bowtique page from the mom who says her daughter waited and waited for the tutu for her birthday party. Honestly Amiee, if you had to wipe your daughter's tears because she was heartbroken and her birthday ruined because of someone else's indifference, you would not be a happy camper.

What's more? You seem to think that if you refund someone then the issue has been corrected.

A refund is not a courtesy, it is a requirement. It is the law. If you cannot produce what you sell, you must refund the money otherwise it is called theft. Why shold consumers be happy with refunds?

Clearly people want items- and things for their children at that. As customers, we are doing your shop a courtesy by offering our patronage; we pay you in advance, offer blind faith and are willing to wait, within reason (you know I waited 10 weeks before I gave up), for our items- as long as we got them.  If money in hand was the issue, we would not have spent it!

The package didn't arrive for Mother's Day (the package has never arrived despite you stating on here that you shipped it on June 18th) which, although not a huge disappointment, was a disappointment anyhow. I waited weeks for your response on emails; waited weeks for the order; worried it was lost since you were repeatedly claiming to have shipped it; then when I questioned you on it, you blamed me for your issues and then threatened me with harassment for simply trying to get my money back. You then tried to silence me and forget about me by deleting me from the Claire's page thinking I'd just go away. I had to file on Rip Off Report to get my money back; you never offered or initiated anything. You did it so I would remove your name from Rip Off Report. Heck- your husband has even contacted me with an antagonistic message....and I'm supposed to be satisfied with a refund- for all that?

Every time my name has been given to someone who believes they are the latest victim, I always say the same thing. "I don't know if the other stories are true. I can only tell you mine."

And while my story may end with a refund, I'm not 'happy' with it. I am simply happy that I no longer have to deal with you, Amiee, or Claire's Bowtique.

I have been ignoring these but your LIES are enough! I sent you the check as I stated I would and it is 2595. I am posting a pic of the duplicate and another check from the same book with MY NAME AND ADDRESS on it! Keep lying and you will be seeing some information about the seriousness of purgery!

Just to clarify.. the personal check I received.  Has only her name listed on the check.  No address/phone number/etc.  AND, it is only like check number 43. (Don't have it in my hands to verify whether it was 43 or 44.)   Most stores won't even accept checks that are from such a newly opened account.

Amiee,

Just do the right thing and refund my money through PayPal.  There is no reason why you can't, you just don't want to.  I paid through PayPal, refund it through PayPal.  You're right, you should be sitting on a bunch of cash from your wonderful business.  Your checking account SHOULD be nice and full.  But, for some reason the whole thing just seems fishy to me.

Scam with no money hmmmmm

So again I would love to know how I am a scam with everyones money but my check is going to bounce? If you dont want to cash it that is not my fault. You had to be issued a refund check I was not about to risk sending you a paypal payment so you could say that was not your refund. In any other situation I would have but you telling me I am a scam and then that you cant cash my check pick one!

Verify funds with her bank

As a seller I know you can verify the funds with her bank prior to cashing the check, go to her bank directly and hand it across the counter, you will not be charged a fee if it bounces and they will in return stamped the check Insufficient funds. If that happens, contact the police department in her area and file a complaint. It is against the law to pass bad checks knowing there is no money to cover it! Don't just "let her win", 54.00 is not a small amount and it is your money, not hers. The whole process will just take a little time, but nothing compared to the months you have already wasted with this seller!

Oh, my apologies.  I forgot the S, when I typed the USPS earlier.  I did finally receive your "personal check." And, I guess you win... because I am not willing to take the chance of your personal check bouncing on me.  You have screwed me in absolutely ever way possible and I would hate to have to pay the penalty on a bounced check.  My husband is unemployed and we can't take the risk.  So, I guess you win the battle!  Congrats!  I hope you feel good about yourself and that you have accomplished your goal.  I am out $54.  I just hope everyone knows how horribly you run your business!  I certainly wouldn't recommend you to anyone!


Sure would have been nice if you would have sent me a certified check or a money order!

First of all I do NOT ship UPS I ship USPS which would be why you couldnt read the tracking. If I sent you a paypal "payment" you could say that was not your refund so in order to protect myself from you I had to send a refund check. What cracks me up is you think I am such a scam with all this money but your afraid to cash my check? Make up your mind! lol

You sound ridiculous.  To be perfectly honest, yes I was stupid to believe YOU that I would receive my product in 6 weeks.  I certainly should have ONLY given you 45 days to get me my product, instead of believing you that it was "On its way!"


I have asked you for the last month for a refund and I certainly haven't received one.  If that isn't refusing to give a refund, I don't know what is!!!!  And your promise to send me a check in the mail is insane.  I would be out of my mind to cash a check from you, god knows it would bounce.  But ithe check you promised also has not arrived.  So, I am sure I won't have to worry about that either! 


As for the shipping number... ummm, well I am quite confident that whenever I try to look it up all I get is "This tracking number is invalid" from UPS.  So, I am not sure how you can possibly say that proves you shipped it.  Especially considering it has been a week since you sent that and the product certainly hasn't been received it.


And since you have recently closed your Facebook account, I am assuming your own bad business has caught up to you there.  I am not sure how you can live with yourself knowing that you have scammed so many people out of their good money.  I know if I was you, I would certainly be ashamed of myself and never be able to sleep.

Show me where I refused a refund to you? SHOW ME! I have never refused a refund from you and any person that uses payal knows they have 45 days if you get to day 40 by all means FILE A CLAIM! All I have to do is prove shipping and its done it NEVER bothers me when someone files a claim! I invite them to if it makes them feel better! YOu people say I string people along past the days that just sounds stupid! I have never told anyone not to file a claim and if I was the customer and I was concerened that is what I would do myself. My wait time is 4-6 weeks and 6 weeks is 45 days so please by all means I would never suggest someone not be protected anyway I sent you tracking on your refund today and I will be waiting for that proof you have that I refused to refund you. Thanks!
