Conn's Appliance Collection Department

RE: Acct. # 1683226:30

On September 29, 2004, we purchased a home entertainment center from Conn's. Salesman, Christopher Keller was the representative that sold us this item from the 9960 Katy Freeway, Houston, TX 77024 store. At this time, Mr. Keller did not explain the contents of the contract. We were not told that we would receive a refund for the insurance we were charged if the loan was paid within the one year no interest term. Since that time, we have made all payments in a timely and advanced manner.

In order to receive the benefit of the one-year no interest we were obligated to pay in full by September 29, 2005. During the duration of the loan, not only did we make a timely payment of 87.60 per month, but an extra 112.40 per month, making advanced payments on a monthly basis. On June 25, 2005 a check in the amount of 403.49 was issued to Conn's for part of the remaining balance due by September 29, 2005. This amount not only paid for the month of June, but also, July, August, September and part of October if we chose to pay them the interest due. On August 25, 2005 the last check in the amount of 300.00 was issued to Conn's for the pay-off of this loan.

As of September 21, 2005, the check had not cleared the bank. On September 21, 2005, we phoned Conn's to find out the status of our payment. Since we were all involve in Hurricane Rita, I was told, by their customer service department that my check washed away with their building in Beaumont. My questions was, Why had the payment not been posted before the hurricane? It had been almost a month since they had received the payment. The customer service representative that I spoke with said she didn't know why it took so long and they would not be able to get back into their building for three weeks and that my check had been washed away in the flood. I was asked by this rep to stop payment on Check #2272, dated August, 25, 2005 and to give her my checking account information over the phone and they would deduct it from my account. I was told they having to do everything by hand and was assured be this rep that it be taken care of in a prompt manner.

During the time we were paying on this loan, we had to send a letter each month stating, Please do not sit this payment on someone's desk for three weeks, and deposit immediately. Our payments were not being posted in a timely proper manner throughout the duration of the loan. On October 6, 2005, they posted the last payment that we paid on August 25, 2005. On December 14, 2005 the collection department called and tried to collect the interest due in the amount of 980.00 because they did not post our payment in a timely manner. Once I told them the situation, that they had made a mistake, they put me on hold for 10 minutes and came back to the phone.

A very rude supervisor, that would not tell me his name, and then told me that we only owned 40.86 for the interest due from September 29 to October 6. After arguing with him for an hour and disrupting our evening and holiday, I gave him a card number for the 40.00 just to get him off the phone and to quit calling. Apparently he did not write the number down, so they can continue to harass us via telephone every evening. Since we have another loan with this company, on December 20, 2005, I called to make sure that a payment had been posted to the new account promptly. I spoke with a rep, named Melanie at 3:10 p.m. to make sure they have posted the 500.00 payment that was sent on December 7, 2005 because of the situation with the other loan.

At this time, I asked Melanie why they were still calling about the other loan because according to their contract we should receive a refund for the insurance that was adding without our knowledge and they are still trying to collect 40.00 for their negligence in posting our payments late. I explained to Melanie that a rep on September 21, 2005 told me to stop payment on check #2272 in the amount of 300.00 and give her the info on the phone. Melanie then told me that you should not have stopped payment on this check. We did what we were instructed by a Conn's rep on September 21, 2005. It seems there was a little silence in the conversation at that point and she stated that interest was still accruing on this account. I then told her that we were being charged because they did not post payment promptly and she then said she sent it to research and the calls would stop until further notice. I told her there should not be any calls at all and that we were due back 295.94 for the insurance we were charged because we paid off the loan prior to the terms of the contract. Again silence. She told me again she is sending it to research and to have a nice day.

At 8:15 p.m. on December 20, 2005, we received another collection call in reference to this so-called interest due. This situation is getting out of hand at this point. According to the contract we are due a refund for paying prior to the due date. We do understand the hurricane problems, as we were also involved. Conn's is using the hurricane for an excuse to collect money from decent paying people. All of this complaint has documentation available. Not only do we not owe them money, we were charged for some insurance that we should receive a refund for. Salesman, Chris Keller, did not make us aware of this charge and we were not required to take this insurance. It was added to both loans.

Please contact us if you need further information for this complaint. All documentation can be forwarded to you at your convenience.
Your help would be greatly appreciated.
