I would like to begin a CLASS ACTION SUIT against Countrywide Home Loans, and their subsidiarys. This company is acting fraudulantly and denying homeowners their housing rights.
The CLASS ACTION SUIT needs to consist of homeowners that have entered into LOAN MODIFICATION AGREEMENTS with this lender.
My story is below:
I fell behind on my payments in October 2007 due to family illness and other hardships. I requesed a loan modification in February of 2008 to come current on my mortgage payments. I was told that I was pre-approved for a loan modification. I kept weekly contact with the lender until May 2008 when it seemed as though I was getting no where.
I then hired a "modification company" to get the loan modification to go through. They were having issues with Countrywide Foreclosure department as well. In August, the company I hired was told that the modification had been denied. After hearing this, I was frustrated. I called Countrywide on my own and was told the same.
However, a week later, I received loan modification documents in the mail. I quickly put together the $6000 to send the signed and notarized paperwork back to the company. The paperwork stated that my first payment would be due on October 1, 2008.
On September 30, 2008, I overnighted a payment for the month. This payment was sent back to me on October 20. The payment came back with a letter stating that the funds were insufficient to bring the loan current. I called Countrywide and was told to re-send the payment. I did so, and again it was rejected. I have been going through this process with them now since them.
Recently they have told me that the loan modification was cancelled. I have called them on the acceptance of the funds and that they accepted these monies and entered into a legally binding agreement with us. They are now telling me that they can offer us no assistance and will continue to persue the foreclosure avenue.
I need others homeowners in the same situation, win or lose. We need to come together and put a stop to Countrywide's FRAUDULENT bu8siness practices.

I am facing a very similar situation in Texas. It started over a year ago with the "modification" where we were told we would get a packet through some government program and because they were restructuring the loan we were not suppose to make a payment until it was complete. Over a year and a million of the same conversations with Countrywide reps they pop up demanding $11,000 up front saying modification was denied and refuse to except any payments even though its not officially in foreclosure and we have tried to make very reasonable arraignments with them to catch up quickly. They have also said we were suppose to be making payments this whole time which is funny to me because I have never heard of ANYONE getting away with not paying their mortgage for a year without a word from the lender, it just does not happen. My husband and I are getting a divorce next month and I really do not want my two young sons to also lose the only home they have ever known but they will absolutely not work with us. ANY ADVICE WOULD BE APPRECIATED.

I have been trying for several months to get someone to answer me and help my family. We bought a home through Countrywide Home Loans, we are behind due to loosing our jobs. I have contacted them several times over and all they can say is they are sending out the paper work to help us. We have not seen a thing. Our home was not inspected properly by the VA inspector so now we have a house that has 2 bathrooms we can't use till fix and our water/septic empties into our basement floor. I have contacted lawyers and they feel we have a suit, but I cannot come up with the money to obtain them. I have also contacted numerous government people in my state to help and all Countrywide/Bank of AMerica can say they are not at fault. Well someone is at fault, for giving my husband a loan even though we had a bankruptcy in our record and turning down the loan at first then, calling back days later and saying hey we'll use his overtime to get the loan through. It didn't work for he lost his job and we lost our job again to down sizing in Feb. All we asked was for help to get the loan lower so we can pay for it, and they will not return calls but send out guys to make sure we are still living here? THen we find out recently that there is a coal mine coming in about three miles down the road. Yeah people are selling their homes here and noone is buying. We can't sell our home when it's going to take over 50000 to get the drainage and water problems fixed, so who is going to pay 160000 for a house when you have to add another 50000 on top of that. They are aware of this going on and said they don't care we lost our job and something has to be done. THey want 12000 up front to even go forward. These folks are fraud and I really wish someone would step up and help us. Take our cases and help us get these guys. Does everyone think because they changed to Bank of America they are different? THey aren't because Bank of America is also under investigation so they are all the same. So if there is anyone out there that can help my family, I'd appreciate it.
