In order to get $7000 in builder incentives you have to use their mortgage company. I was quoted a payment (good faith offer) of $1,700 a month. Three months later just before closing they told me payment was going to be $2,200. They also falsified my loan application and stated that I had $3.4M in assets. Totally False. I could'nt afford the increase in payment and they told me "too bad" and kept my $3,000 deposit.

Mortgage fraud

Report builders' mortgage fraud to the Office of the Inspector General of the US Dept of Housing and Urban Development: hud.gov/offices/oig/index.cfm HUD is losing money because of all the bad loans builders' in-house lenders made during the boom years. Now a lot of those loans are in default. It is illegal for builders to require you to use their lender, it's a violation of the Real Estate Settlement Procedures Act (RESPA). They can offer incentives to use their lender but many are crossing the line and violating RESPA rules. I believe the RESPA regulation is at 24 CFR 3500-15 or somewhere in that general area of the Code of Federal Regulations. Do not let builders tell you that you have to use their lender...and report them if they try to force you.
