Well about 3 months ago I ran into some financial trouble and was able to work something out will ALL my creditors BUT Direct merchants bank. YOu see thay have this hardship program and I applied figuring hey I';m in trouble and I want tocontinue to pay so I'll try.

What a waste of time! after listing all my debts and stating my income she says"you don't qualify becuase you don't have enough income" no s**t, thats why I called to tell you. she tehn states that they are the more important company to pay and I Should cut down or refuse to pay other creditors in favor of them? What type of s**t is that!anyway after they refused to help the phone calls started at least 16-20 times a day and sometimes tihin 5 minutes of each other. I sent a cease and disist letter and after a few weeks the calls stopped.

I then get a letter stating that since I sent them a cease letter they will now refer the account to an attorney to sue me. What the hell is going on with these people. They would not help me when I needed it they would not take my partial payments so they figure suing me is the best option?!? I wanted to pay and keep thins cool with this company but since they could care less then I don't either. I mean I can only give so much and they obviously think I'm joking when I say I no longer have a steady ful time job just a basic run of the mill psrt time gig but it pays just enough for me to handle the basics.

I'm seriously thinking of filing bankruptcy or lawyering up to fight these guys if they do sue so any help from other victims of this company as to what I should do would be appreciated.

Contact DMCCB for assistance such as what you said the hardship program and if that doesn't work out there are very few options remaining unfortunately. I'm happy you were aware of your rights and exercised your Cease and Desist rights.

I read your update as well and am happy you settled. One thing though, a matter of correction really. you are not being reported by DMCCB for being 30 days late. That's purely internal. It does become a matter of credit bur. reporting if you become 60 or more days delinquent. i'm not sure if thats the law or if thats industry practice or just DMCCB. Please check with all your banks, good information to know. Again happy to read you;ve settled and good luck on your future. Peace be with you.

since dmb has sent this matter to their "attorney" I have since spoken with the "attorney" and have worked out a payment schedule for 60 cents on the dollar. S instead of dmb getting the full amount as they had hoped and working out a payment plan (as their "attorney" did) they will be getting much less. Although my credit has been shot from the 30 day late hit I will be done with these fools in a little over two years and will gladly wish them and their "collection attorney's" good riddance.
