ripoff: Discover failed to cancel card when requested on 4/17/02. Never responded to 4/17/02 request for cancellation regarding cancellation of card. We destroyed our cards and never used them again. Discover then allowed unauthorized charges for merchandise we had not ordered to a card we had cancelled.

In 2003 Discover sent us a bill for items that were not authorized by us. We sent them a letter contesting the charges and again sending them a letter requesting they also cancel card as asked to do in 2002. On March 27, 2003 we received a letter from Discover saying we owed $69.70 but they would cancel the card.

We sent them another letter on May 27, 2003 saying we had contested all the charges they kept billing us for and that we would not pay for any of it as they were all unauthorized charges on a cancelled card. They then sent us a letter asking for all the info on the disputed items. We advised we had already provided them this info. Then we got a bill dated June 11, 2003 stating we owed $36.00 (we don't even know what for) and then they added a late fee of $15.00.

We are at our wits end. It is a vicious circle and we can't kill it. We have not authorized any charges since 4/17/2002. Anything after that is unauthorized by us as we don't even have the cards.

What can we do to get this stopped? We have excellent credit and don't want it ruined by a company that doesn't care.

Please, please, please! For your own protection, don't list your full address and previous address on a public internet site! You've just left yourself open to fraud (if these addresses were, in fact, your true addresses!). Anyone with a computer and $30 can now find out everything about you from your SSN and DOB to the name/address of your employer as well as the names and addresses of all your creditors.

I sincerely hope those addresses were fake!

If they weren't, contact the 3 major bureaus: EQUIFAX, Transunion, and Experian and tell them you'd like to place a fraud alert on your file.

If you do this, it means any creditor receiving an application with your information will have to contact you either by phone or mail to verify whether or not you applied for the item in question.

Good! Another intelligent response that refers to the post.

You are right again. Sending items return receipt requested is the only way you can PROVE you sent something to someone. Burden of proof is always on the sender. Rightly so. Mail gets lost, misdirected, sometimes even chewed up by postal equipment.

That is not to excuse Discover Card. One attempt to resolve the situation (by mail) getting lost is one thing, but multiples are another story. Something is definitely wrong here.

Contact Discover by phone and ask what type of dispute was done in regards to the charges. We have two types: Customer Service level disputes and Fraud disputes. If you did not make charges, demand that Discover do a fraud investigation. If we did not already do one, we must do one now. This is pursuant to "Regulation Z". We are not permitted to refuse this request AS LONG AS WE HAVE NOT ALREADY DONE A FRAUD DISPUTE.

We will then have 90 days to investigate your claim. If it is resolved in your favor, the charges will be removed and we will "re-age" your account so that any derogatory information that has been sent to the credit bureaus because of non-payment will disappear as if it was never there in the first place. Any derogatory listings not related to the fraud dispute, however (such as if you actually were late and it wasn't because of this situation)will remain on file with the credit bureau as valid history.

A few suggestions... the abuse consumers are suffering at the hands of DIScover is apalling

I am sorry to hear of your situation. Unfortunately, the abuse consumers are suffering at the hands of DIScover is apalling, and rarely are the customers complaints handled propertly.

My suggestion would be to re-send everything again (always keep copies!), this time return-receipt so you know and they know it was received. Fax, Email copies to everyone you can at Discover. Also, send a copy of everything (a summary is always a good idea) to all 3 credit bureaus, return-receipt; this way if DIScover turns you into them, they at least will have your dispute and your side of the story on file. Consumers also have the right to have a statement of explanation incorporated into their files. You would do well to investigate and research this via the credit bureaus further - absolutely do NOT let it go.
