ESelling Consultants Failed to refund for goods not shipped Minneapolis Minnesota

I ordered a DVR from them on February 13, 2009 they billed my credit card on February 15, and I received the following statement from them on February 27:

We have received notice from this manufacturers distributor that this item is no longer available and they are no longer making it for some reason or they are no longer carrying it. When this usually happens we strongly recommend that you stay away from this particular model. Rather than waiting several weeks or months we have issued you a refund via the same method you have paid for it.

As of May 4, they have not refunded the charge, nor have they responded to my e-mails. Their web site is still active, though it lists a disconnected phone number. Unfortunately, I contacted my credit card company a few days after the credit card company's "disputed charge deadline" and so don't have recourse through the credit card. eSC is a scam!
