Event Tickets - Ticketsmyway Takes order, charges credit card, then. no tickets week of show Las Vegas Nevada

On 1/25/08 I ordered two tickets to Wicked in Cleveland for the 2/14/08 performance. The tickets totaled $329.00 and my Visa was charged the same day.

On Monday, 2/11/08 I still have not received my tickets. I check my order status on their website and find it is cancelled. I call the number listed, and after about ten minutes on hold, "Brandi" picks up the phone. She tells me that the old crew there had a habit of selling the same tickets multiple times, and that they all had been fired. Unfortunately, my tickets were no longer available, and my money will be refunded. It will take a few days for the refund to post to my account. I can call back and ask for her if I have any more problems.

Wow - that kind of honesty in customer service can't come cheap!

After reading other complaints regarding this company, it appears to me a pattern has emerged. Event Tickets - Ticketsmyway will sell advance tickets to prospective buyers, charge the prospective buyers credit card, then hold off on shipping the tickets in hopes of receiving a higher offer. If they receive a higher offer for the tickets already sold - they sell them again and notify (maybe) the first purchaser that the tickets are no longer available. This way they secure at least the agreed upon minimum price from the ticket seller, and then maximize the exposure of the tickets to the market, hoping to increase their margin.

I can't say for sure if any laws are broken by this arrangement. But debiting charge accounts with no intention to fulfill the obligation, if proven, is fraud.
