Express Flooring salesman gave us a bid of $7,000 for tile in our home, 8-23-12. We did not give the sales man a deposit. 

The next morning, 8-24-12, my wife called to cancel the contract. She talked to the salesman.  He said to call the office.
 She called the office and said, "I want to cancel  the contract". The gentleman at Express Flooring urged and advised me to put the contract "on-hold", instead of canceling. So, she agreed to put the contract on "Hold". We heard nothing for 2 weeks.

On 8-31-12: My wife called GE capital and canceled the credit card sent to us for the loan.

9-6-12: I gave what she deemed a "courtesy call" to Express Flooring to get our order off their books, again thinking "there is no contract without a deposit." The supervisor, Henry, called back to say "There is a binding contract, even without a deposit, and you owe us 25% of the total price of $7,000, which is $1,750.  It will go on GE Capital and you can make payments on it."

My wife was furious...saying, "I had called to cancel the contract but was talked out of it!" "Henry, you knew my intent, I had even called the salesman to cancel the agreement the very next day!"  "The salesman had told me to call the office and cancel...however, the supervisor, Henry said 'you didn't cancel by written notice."

My wife called GE Capital again and asked if Express Flooring could put $1,750 on that account without our consent.  They said no...the account is closed, as you requested.
