12/27/06, at Nassau, Bahamas, we were told the Festiva Resorts "Adventure Club" was in business for 7 yrs (it actually started 9/06).

We explained to them we were mainly cruisers, they showed us their website w/pages of cruise rates based on per cabin, not the usual p/p. We questioned them, but they guaranteed us their site was accurate. This was a big selling point for us, as we cruise every year and these were great prices.

When we came home, we couldn't get through on their web-site, so we tried to book a cruise with their agent, she said it was always p/p, not per cabin, and their prices were more expensive.

We had concerns upon return home on 1/3/07, we called many times and were told that the person we needed to speak with was not available & we never got a return call or e-mail. I finally reached someone on 1/19 and told them I wasn't happy with them not responding & the deceit of the cruise rates. I told them I wanted to cancel, I was informed that "you can't cancel, figure out a way for it to work".

We had looked on the BBB and saw many claims against Festiva for the same reasons. We knew we had a big problem, they had taken a $2,615 deposit, our drivers license, credit card and access to our personal info. We even had to cancel our credit card in Feb to avoid them taking anymore money (they set up auto w/d for an additional $20,000)and were not responding to any of our calls.

Festiva promised us a bonus wk w/them for 2007, but when we tried booking the Bahamas, they wouldn't confirm the reservation or call us back. Only after I cancelled the credit card in Feb, Festiva sent us a confirm for a bonus wk, but not the wk we had asked for.

We contacted Visa, the Credit Bureau, and filed a claim with BBB. The only calls or letters we get from Festiva are for additional payments. We have tried settling this with them, they won't budge, all they want is more money.

We want our money returned, and our contract cancelled, as our signing of the contract was based on lies. I do not want to pay them another cent. Does anyone know what they can do with us, besides bad credit, if we do not pay them anymore, but they don't cancel our contract?
