I agree with the Ft Myers person about 5/3rds ABUSE of overdraft fees! I have complained to my husband for years now about this. As of this writing, I am sitting here looking at a statement obtained directly from the hands of a teller at 5/3rd, and I am appalled.
The first thing I notice is a $111 overdraft fee on 3/25/09. I look all through that day, to see if there is any overdraft. Curiously, the ***DAILY BALANCE*** says our account has $169.95 on that day(3/25/09). HMMMM, not overdrawn on 3/25, yet somehow you are charging me $111? WTF???!!!
Of course, the next day there are some small things coming through, $14.15, $9.95, $30.00, $40.00...which wouldn't have taken it over the limit, since we HAD $169.95 on 3/25. Oh yea, thats right, for some unknown reason, 5/3rd subtracted $111 from our available $169.95, leaving us with $58.95....HMMMMMM. So now, on 3/26/09, when the above amounts go through totaling $94.10, NOW we are overdrawn -$35.15. And, curiously enough, we get another $111 overdraft fee on top of that. This statement continues on in the same insane manner over only a 4 day period. At the end, the fallout is $973 in OVERDRAFT FEES!!!!
In 4 days time, Fifth Third had taken just short of $1000 from me. WOW. And it all started with a $111 Overdraft Fee for NO REASON AT ALL.
Yes, I know, some of you smug individuals out there are thinking, well, theres just more to the story this chick isn't revealing. I wish there were.
Even the tellers at my bank could not explain the $111 fee. They all stood there whispering and dumbfounded. Did I get back my $973? Nope. Did I get back my $111? HA. Yea, right. They are deciding on that, and even if they credit me back that money, they said it could take 10-14 days to show up!!! WTF???!!! You can take it in a moments time from me, but I have to wait 10-14 days for it to be credited back????!!!
This insanity and ABUSE of OVERDRAFT FEES and other fees MUST STOP! We are allowing banks to be un-policed institutions in this area, and its not right! Other banks do similar crap.
Don't stand for it.

...to my last reply..reply # 3. Read what I posted..click the link..and perhaps you will see why a COURT OF LAW, did indeed find the bank GUILTY of fraud.
No one in the case against the bank asked or wondered how an overdraft occurs. What they sued and why is clearly explained it the Courts Order so no need for me to type it all out again on this site for the hundredth time.
If anyone disagrees with the courts verdict, direct the rebut to the Federal Judge. If anyone feels the current lawsuits against most of the big banks did not have just cause or proper "cause of action" which apparently AGAIN gained class action status, in which the defendants (Banks) were denied when they tried to squirm out of it during the dismissal stages...rebut it with the Federal Judge in Miami.
I am simply stating the FACTS, and I agree with the Judges decision on the recent Wells Fargo lawsuit and consider it a victory for the plaintiffs who many were as much as some of you hate the term...VICTIMS..unless you can find a better word for those who were fleeced by the banks manipulations and deceptions, and the current lawsuits which have consolidated all the "thieves", I mean banks into one Court to conclude the rest.

There wasn't a "fee for no reason." The reason was probably due to something held against available balance when other things posted. They should explain this to you a bit better.
You CAN argue that posting order (biggest first), and courtesy overdraft are wrong. That's one thing.
However, a bank isn't just going to look at say "well he looks nice and poor lets charge him some fees."
It doesn't work that way.

Why is it that EVERY SINGLE overdrafter goes right for the "they charged me overdraft fees for no reason" bit? People, banks don't just charge fees for no reason. That's called fraud. Something had to have happened on your account to make your available balance go below zero. Again, that's the available balance, not the account balance.
Ok, you talked to some tellers. I got that. You claim that they couldn't figure this out. Ok, let's explore that. If they can't explain it, I see no reason why they wouldn't refund the fees. After all, why wouldn't the bank refund fees that were charged in error? Granted, you might've gotten a teller that was new, or just plain dumb, but you really didn't give me the impression that you went the extra mile to figure it out with them. Why didn't you ask for a manager? You should've demanded an explanation or a refund. If I was charged $973 in error, I wouldn't just throw in the towel. No, I think you really knew that you overdrew and you're just trying to make yourself out to be the "helpless victim".

...apparently a register would not have told you that the bank was able to take ONE legitimate overdraft fee, and turn it into as many as 10? I guess the register would not have told you that if you made a human error, that the debit card POS and ATM withdrawals would still be approved?
Fortunately due to recent regulation changes, the banks can no longer force you into overdraft coverage with the debit card..so as long as you do not fall sucker and sign up for it..there is little chance you will overdraft by mistake, and you will not have to worry about the banks tactics. Of course you should keep a register, but whether you did or did not, does not take away the legitimacy of the report, and does not excuse the bank for swindling it's loyal customers.
Granted, I noticed this report was originally lodged back in April of 2009, so perhaps you were not aware.
Recently Well Fargo lost a lawsuit in California for doing this and was court ordered to cease the transaction posting time manipulations, and to pay back anything they stole in fees that were not legitimate overdraft fees.

There is an identical lawsuit against many banks (it was concluded around 25% of banks were doing this), and the class action lawsuit is covering many states. There were so many they decided to condense it to one case which is being conducted at a Federal Court in Miami, Florida.

I am interested in finding out if anyone is aware of a 5/3rd class action suit? I would definitely sign a petition to get one started. Still so unhappy with the poor cs of 5/3rd. They are criminal in their theft of customers money.
