When I got laid off from my job in April 2002 I also lost my health insurance because the company had not been paying the premiums and was not offered COBRA. The agent at the time said that FORTIS short term health was the way to go. We reviewed the FORTIS insurance application together and I revealed my past medical history to him because I was concerned with pre-existing conditions. He assured me that nothing in my past medical history would prevent FORTIS coverage. I had the coverage for three months until I got a new job with insurance. Unfortunately during the three month period I had a kidney stone attack which put me in the hospital for a overnight stay. The bill came to $8,000.00 and FORTIS refused to pay and even rescinded my insurance.
They said that I had lied on the application about my medical history and therefore was not eligible for the short term policy. I had not had any previous kidney stones but they said that a visit to a cardiologist for a heart checkup was a pre-existing condition. They are a big, big rip off as I discussed everything in my medical history with the FORTIS agent when he issued the policy. Can anybody suggest which way I can fight FORTIS on this. I just refuse to let it go.

Almost without exception, this type of thing happens because the consumer, in this case the insured, has absolutely no clue about their coverage and assumes there will be no problems. I am an independent rep for Fortis (now Assurant) and have one of their policies. What I see time and time again is people complain about how much they have to pay, so they compromise on benefits, and then when they have a claim it is all the big bad insurance company's fault.
There are unethical agents out there, but with this exception, if you purchase a policy without understanding exactly what it is you are getting, then you have no basis to complain. Would you handle a complex legal case on your own? probably not. You would engage the services of a professional. People in these situations always think everything is covered. I make sure my clients know exactly what they are getting, offer supplemental coverages to handle things that are not covered under the health policy, and insist they call me first before they have any procedure done.
So, to all of you who think insurance agents are unethical and avoid them like the plague, you are in for a surprise when you need someone on your side in a situation like this.
Buyer beware.

I understand your frustration concerning this situation, but I must say that the insurance company is not the one that is at fault. It sounds like the agent is the one that misrepresented you on the application. Did you actually look at the application that was submitted?
When you received the short term medical policy you should have also received a copy of the application as submitted to the insurance company. It is up to the consumer to verify this and make sure that it is correct, as what is stated on the application is what the health insurance company bases their underwriting on.
My suggestion is to go after the agent that wrote you on the policy and either a.) file a claim against the agent's Errors & Omissions insurance if they have it or b.) file a claim directly against the agent. This situation is not simply a Fortis problem and does not make Fortis a bad company.....ANY insurance company would have done the exact same thing.

The short term application you signed has a question similar to this "in the last 5 years has any person to be insured received any abnormal test results, or medical or surgical treatment, or CONSULTED a health care professional for heart"...
I hate to say it but most Americans don't go to heart specialists for a "checkup" without reason. So although I don't know the specifics of the case. Your visit to a cardiologist apppear to have put you in an ineligible class of person for this type of policy.
Just a thought and not based upon the specifics of this case.

Just go to your state government's website and you can file a complaint with the insurance commissioner in your state. Unless they required you send your entire medical history you can fight this! No one can condense their entire medical history on a few lines of an application. Fight this tooth and nail and if you must find a lawyer and let them know you are suing. They might end up paying your legal fees after it's all done and said. Insurance companies are out to make profits not serve the consumers. That's why we need health care services like Canada.
