On November 3, 2007, at approximately 1:00 pm, my wife suffered a horrible single vehicle accident in which she barely escaped with her life.
The vehicle, a 2007 Chevy HHR, was completely destroyed and is a total loss. This vehicle was purchased brand new six weeks ago from date of accident from a car dealership (Tipotex in Brownsville, TX). One of the requirements for obtaining this vehicle was have full coverage insurance.
We chose Fred Loya Insurance.
After submitting a claim for the accident, we received a letter from Fred Loya Insurance denying the claim. It was indicated that because the accident occurred in Mexico (more than 25 miles from the border) the vehicle was not covered by the comprehensive insurance that we purchased.
Vanessa Miranda, the claims adjuster told me that the associate at the local office should have given us a copy of the contract, along with the insurance booklet that explains various details, including traveling in Mexico. This did not happen.
I looked through paper work we received and, also, through the faxed copy of the entire package. Nowhere in the paperwork did I find ANY information with regard to driving in Mexico.
Nor did I find any acknowledgement receipt that shows that we received an insurance booklet (we were not asked to sign an aknowledgement form nor de we recceive one). Had we known at the time of purchase we would have obtained insurance to cover the vehicle in Mexico.
We left the office thinking that our vehicle was covered under the comprehensive insurance. Due to being mis-informed by an associate of Fred Loya, I now have a non-usable vehicle that was damaged through no fault of ours and a wife that suffers internal injuries.

I AM SORRY TO HEAR THAT YOUR SPOUSE IS SUFFERING INJURIES AND THAT YOUR FAMILY IS AT LOSS IN COVERAGE FOR THE VEHICLE BUT THERE IS A MEXICO COVERAGE ENDORSEMENT ON ALL TEXAS PERSONAL AUTO POLICIES. THIS ENDORESEMENT BEGINS WITH A WARNING. THE ENDORSEMENTS STATES THAT YOU WILL ONLY BE COVERED IF YOU MAKE INFREQUENT TRIPS INTO MEXICO AND ONLY 25 MILES INTO MEXICO FROM THE NEAREST US BOUNDARY.
Some U.S. companies provide a free endorsement extending your policy's coverage to infrequent trips of up to 10 days and as far as 25 miles into Mexico. You can buy coverage for longer stays, but it is usually valid only within 25 miles of the border. In addition, these endorsements might not meet Mexican legal requirements. You can buy Mexican liability insurance from Texas agents who specialize in it. Check your phone book for listings of insurance agents who specialize in auto insurance for travel in Mexico. Your local agent also might be able to help you find coverage with a Texas-licensed Mexican company.
YOU CAN LOOK THIS UP ON THE TEXAS DEPARTMENT OF INSURANCE WEBSITE.
THIS INSURNACE COMPANY DID NOT DO ANYTHING THEY WERENT SUPPOSE TO DO. THEY ARE HOWEVER, SUPPOSED TO PROVIDE YOU WITH A DENIAL LETTER IN WRITTING. AS FAR AS THE POLICY, YOU SHOULD HAVE OBTAINED A COPY OF THAT WHEN YOU PURCHASED THE POLICY. SOMETIMES THIS IS MAILED TO YOUR RESIDENCE A FEW DAYS AFTER TH POLICY PURCHASE. I AM INSURED THROUGH ANOTHER CARRIER AND I RECEIVED THE POLICY IN THE MAIL AND IT IS VERY LONG. THIS ENDORSMENT IS FOUND TOWARDS THE END. WHEN I READ IT, I WAS SHOCKED TO HEAR OF SEVERAL LITTLE DETAILS ONE IS NOT AWARE OF. ANOTHER DETAIL ALOT OF CONSUMERS ARENT AWARE OF IS SPECIAL EQUIPMENT, FOR EXAMPLE YOU ADD CUSTOME WHEELS, OR AN AUDIO EQUIPMENT, THIS IS NOT COVERED UNLESS YOU REPORT THIS TO THEM AND PAY A PREMIUM FOR IT. IF THEY ARE STOLEN, YOU WILL ONLY BE COVERED FOR ORIGINAL EQUIPMENT.
EXCLUDED DRIVERS IS ANOTHER BIG ONE. IF YOU LEND YOUR VEHICLE TO SOMEONE NOT LISTED IN THE POLICY AND THEY ARE EXCLUDED FROM THE POLICY, THERE IS NO COVERAGE. MY FRIEND HAD HER SON TAKE THE VEHICLE WITHOUT PERMISSION AND HE HAD A WRECK, HE WAS EXCLUDED AND SHE ASSUMMED BECAUSE HE DID NOT HAVE PREMISION, THAT HE WOULD BE COVERED.
THE ONLY REASON I AM BRINGING ALL OF THESE UP IS BECAUSE IT IS IMPORTANT TO HAVE ALL CONSUMERS AWARE OF THEM AND THAT EVERYONE IS EDUCATED OF THE EXCLUSIONS THAT POLICIES HAVE THAT CAN CHANGE A PERSONS LIFE.
I CAN ONLY RECCOMEND TO SPEAK TO THE LIEN HOLDERS AND SEE WHAT CAN BE WORKED OUT. I AM GUESSING YOU WILL HAVE TO CONTINUE TO PAY THE NOTES BUT THEY MAY WORK SOMETHING WITH YOU AS TO ADDING THE BALANCE TOWARDS ANOTHER PURCHASE BUT YOU WILL ONLY HAVE A BIGGER NOTE OR A VOLUNTARY REPO. CHECK FOR YOUR OPTIONS. I AM SORRY AND I HOPE YOUR WIFE GETS BETTER.

I sympathize with your position. You can file a complaint with the Texas Department of Insurance. Here is their website tdi.state.tx.us
On that site (above) is a form you can fill out. Living so close to the border in Brownsville and Fred Loya Insurance Company should have informed you about traveling to Mexico. The more compliants they get, the more the Department of Insurance will go after them.
