 Consumer Fraud - I would like to report that we put a $7,000 down payment on a new home with Fulton Homes after we got preapproved for a mortgage. We wanted this home more than anything in the world because it was going to be our retirement home.  We are both retired, I am disabled and my husband has health problems as well. We bought the house for $186,000. We kept going back and forth from New Mexico to Arizona to put money down on each stage of the building. When we signed the papers for the house, we told the salesperson that we filed bankruptcy and he assured us we had nothing to worry about. But we couldn’t use his mortgage company because they wouldn’t even talk to us because of the bankruptcy. One month before we were to close on the house, we were told we couldn’t get the mortgage. We tried hard money lenders (which our salesperson sent us to because he said there were other customers of his that went through the same thing as us) and now Fulton does not want to return our money. After talking to attorneys they say what it would cost to use them would be more than what we have to get back from Fulton. We talked to a mortgage company and they said that there should be a financial clause in the contract. After examining the contract, there is NO financial clause in the contract regarding loan qualification. There are many people buying homes from Fulton and probably don’t even realize there is no financial clause in the contract. I believe Fulton homes are deceiving consumers. We sent a letter to the Attorney General’s office, numerous e-mails back and forth with our salesperson, and we sent two letters to the sales manager begging for our money.  The money we used was from our life savings and like we said earlier we would not want to back out of this deal if it was up to us, this would have been our dream home for retirement.
