I hired Gary Lively in April 2017 to clean and put in a new vinyl liner in my dad's in-ground pool in Plano, TX.  He sent me an email (April 13th) with the contract, I told my dad to sign it.  (My dad has dementia and Gary understood everything would have to go thru me, for any decision and any payments)  Gary received the 1st draw for pool  with my approval.  He was a no-show quite often and said in the hospital or some other excuses not to complete the job.  He did receive the next 2 payment from my dad without my consent.  I told him that the pool had to be completed by July 1st, which it was not.  (This gave him 3 months to complete the job)  I had to hire someone else to complete the job. I still do not have the Polaris booster pump and cleaner that was stated in the contract.  I called and texted several times and come to find out he block my phone.  I had my brother call him and asked him about the contract and Gary told him he would bring the Polaris by in a couple of days.  This has now been 3 weeks and we have not seen anything from him.  My brother called one more time and told him that we would take legal action if needed. He just wanted him to drop off the Polaris and told him he was already been paid. At this date 7-20-17 we have not received this item.
