I purchased a $1200 mattress in July 2006 with a line of credit issued by GE Capital under their "24 Month 0 Interest Promotion" if everything was paid in full within the 24 month period and the minimum monthly payments were made.

However, I NEVER received a phone call or any mail from them regarding any bills for the mattress until yesterday, which is about 9 months from the date of purchase, from a collection agency. I am still living in the same address the mattress was shipped to and I never received even 1 statement from GE! I had forgotten that I even owed them money since they never billed me. As a result, I never made the minimum monthly payments, so now I owe them about $1700+, that's $500+ on interest charges and $1200 on the original mattress purchase.

I called GE Capital and was told that I should have contacted them a lot sooner if I never received any statements from them. Fair enough, I believe that we are both at fault here, however, I believe that GE Capital are scammers since they intentionally never sent me any billing statements for the debt.

I am in the midst of filing complaints with the FTC, NY BBB, NYS Attorney General, and possibly small claims court. Any suggestions or comments about my situation? Thanks for reading!

P.S. I have near perfect credit history and never had an delinquent account until now.

I think Jimmy is right on this one, you forgot, you didn't see a statement, so you didn't pay. Well, what if you purchased a car and it was on a promo, No Payments until 2008. You didn't make your payment in Jan, Feb, or Mar of 2008 because you didn't see the mail. The repo man comes and takes your car, it isn't the bank's fault you didn't see the mail, especially if they didn't get returned mail, or you didn't have it forwarded.

There are only about 200 posts on Rip Off Report about GE Capital (GE Money, GE Consumer Finance), considering they are a huge global bank with millions and millions of customers, that's pretty good. There will always be people out there to complain about something.

I certainly will pay for cash next time if I can afford it after this bad experience. I never had a bad experience like this in terms of credit and just thought that after I searched on the internet regarding GE Capital, I thought there was a pattern of bad business practice that should be made aware of for other consumers.

In regards to your statement about wasting taxpayers money with these agencies examining "pointless disputes" like mine, there is a WHOLE LOT of worse things that taxpayer money is being used towards that you may or may not be aware of. Taxpayer money for examining consumer disputes is relative small with respect to other areas I don't have time to mention.

Try Paying in Cash

If you are unable to keep up with the due dates and terms of your credit obligations - try paying in cash. This will eliminate all possibilities of a conspiracy against you and will save the agencies that tax payers fund from having to investigate meaningless disputes. Speaking of taxpayers - if the IRS does not send you a bill are you still responsible to file a yearly tax return ??? The one thing that all debtors have in common is the fact that they all - once - had "perfect credit." "The big print giveth and the small print taketh away." Take time to read the fine print.

No, I am living in the address where the mattress was shipped to and this is address where the collection agency mail was received. So they have my address correct if the collection agency mail was received here.

Predatory lending is NOT just picking people with bad credit. It can also be where the creditor makes it difficult for the the person borrowing money to pay back the debt such as never mailing billing statements to claiming payments were never received when they actually were.

I do acknowledge partial fault that I did not notify them that statements were never received in the first place, but it is also bad business practice that they never sent out statements to me in the first place. As said before, I have never had used a credit card where the company never mailed me statements.

It is unfortunate that you never received a bill, but it was your responsibility to make good on that debt, regardless. Being someone with perfect credit, you should've realized that you hadn't received a bill and found out what was going on. How could GE know that you weren't receiving a bill if you never called them? I am pretty sure that GE didn't single you out and say "this one looks good, let's screw HIM!" You say that you were moving, is it possible that they had the wrong address on file, or the address got mixed up, etc? I also find it hard to believe that they are "predatory lenders", as most people with poor credit can't qualify for a 0% interest deal for 24 months. I am sorry for your miscommunation with GE, but there really is no ripoff here. You really have no case.

I purchased this mattress along with a whole bunch of other things as I was moving at this time, so it is very easy to forget which items you purchased with cash or credit.

I never had a credit card company that did not send you billing statements monthly to collect their debt.

In my opinion, GE Capital is very fraudulent and is notorious for predatory lending as evidenced here and other complaints from the simple google.

How does one with 'perfect credit' SLEEP on the mattress you didn't pay for every night for the past 8 months or so and you don't realize you didn't pay for it? How is it possible you forgot? If you indeed have 'perfect credit' you would have read the paperwork that came with this financing and found that statements and bills are generally given as a courtesy, but it is YOUR RESPONSIBILITY to pay regardless. How is it you are certain that GE 'intentionally' didn't bill you? You don't see GE posting nasty notes about you on here that you INTENTIONALLY slept on the unpaid mattress for months without making a single payment.
I think your complaints to the FTC, BBB, Attorney Generals etcetera should all go to the round file which is apparently where GE's bills went.
There's no fraud or scam here.
