I am guardian over my mother's account. I have all cancelled checks showing where I paid in full her account. I advised a customer service rep that I could understand on August 12, 2008 that by the time mom's bill gets to her address and is then re routed to me from the post office I have only one week to pay the bill. The woman said she understood and would take off the late fees. My mother is disabled and in a nursing home, so I am paying her bills the best that I can. I have proof of paying the final 4 payments, and wrote on the last check that this is paid in full. It was cashed. Now the company wants to charge me $490 in finance charges, late fees, etc. because those last 4 payments were a couple of days late. I had explained this and called to get it straightened out again, but I cannot understand the foreign reps. and when I asked for a superior, it sounded like the same man with a new name! I give up. They also turned this over to a collections agency called ENCORE within one month of the first bill showing the finance charges. I will not pay this, and I see that there are LOTS of complaints against them. My mother has nothing, so they can take that from her.

It sounds like they forgave the late fee in August, but you're expecting them to forgive the late fees and finance charges for the four subsequent late payments? That's not likely to happen. Card companies are usually willing to forgive one late payment, but that's about it. It's still your responsibility to pay the bill on time. Everyone who pays late has a reason why, but if you think that will let you get away with paying late every time, you are going to be disappointed.

GEMB never takes their customers seriously and they will lie and say they will credit a charge and never do

You have to file with both AGENCIES!
