Glacial Energy, a company headquartered in Texas, but doing business in 6 other states, hires employees and independent contractors to sell their electrical energy services to small to large sized businesses.
As an independent contractor, I submitted contracts that I had sold to Glacial Energy in return for commissions based upon the monthly electrical usage of the business. All commissions are to be paid on the 15th day of each month, by direct deposit as stated in the Agent's Contract & Agreement.
Since September of 2007, Glacial has either refused or ignored the payments due on each due date. Only after repeated contact with the company and its local and national representatives, were payments made. Always late and in breech of contract. Most recently, the company has reduced the amount of commissions paid, by changing the terms of the Agent's Contract, after the fact.
Today, the 15th of January, dawns the same, with no commissions deposited.
To future individuals who might consider employment with this company, beware that they have committed multiple offenses, including fraud, theft of service, misrepresentation, and at least 2 instances of breech of contract.
This is not an individual complaint. There are numerous other individuals who are suffering the same actions.

The following lawsuits for fraud filed against Glacial Energy and its founder Gary Mole are consistent with the conduct described in Brian's complaint. Note that one of the lawsuits for fraud is also filed against the company's former outside counsel Charles Kaplan and his son, Glacial Energy's former VP of Sales Justin Kaplan.

I also have worked for this company or really I should say I have worked on behalf of this company. I also have known many, many employees who have worked for them multiple states. I am not currently being paid by them but I felt I needed to be another voice that would stand up for them. I worked with them off and on from February 2007 until June 2009. I have to say all of my dealing have been above board and I am terribly surprised that there would be anything bad going on. The company always seemed more than generous and they really, really believe in their model. They have decided to use many independent contractors just to help get the word out and help to defray normal and ordinary marketing costs. They also have a small army of full time employees that keep the everything humming and keep your lights on. They of course are not the only major company using independent contractors. Many companies are using independent contractors these days. Of course, using independent contractors creates a different situation than your normal employees situation. Especially after the relationship between the parties has ended. I have known other independent contractors that worked for this company and that were happy with the way that they got paid out and it just doesn't make sense that a company of this size and scope would deliberately not pay what they owed. I am glad to see it was settled and the "former employee" now seems to be content with the current situation. I just hate that this stuff just lives on and on the internet and I hope anyone reading at least notices the important part that the company and the former employee have called some sort of truce. So sorry for writing a short novel here, but I just got very upset that the company probably can't or won't speak up for themselves because they just want the issue to die and go away so I figured I would speak up on there behalf. One final thought. I think it is interesting that the original person complaining in the original report talks about "numerous other individuals who are suffering the same actions." Well, it has been a quite a while since that first post yet I don't see anyone else complaining so that leads me to believe that this was a simple case of confusion or bureaucracy and not any really bad intentions. My advice is to be very careful what you post on the internet and me even more careful about what you read and how you perceive that information.

I also was an employee of this company based in Texas. I know many similar contractors that had no problem getting paid. I am very surprised to hear there were any issues at all like this case reported. As an independent contractor, I would help with finding potential customers for the this company but really never had any problems at all. I worked with them from January 18, 2007 until March 30, 2009. The only reason I ended the relationship was because I went to work for another company and I did not want any conflict of interest. Again, though I want to reiterate I had NO PROBLEMS whatsoever and my colleagues also did not complain of any problems like this. I am guessing there was just a mistake made and there was confusion rather than the company acting inappropriately. I hope the person making a report on the rip-off report first makes an earnest effort to work with the company that they are complaining about. I also should report that I was initially promised 'x' commissions and I always received 'x' commissions. My commission structure never changed. Also the date of the payout was always absolutely consistent and the amount of the commission was always absolutely consistent. I would recommend this company to future contractors and customers alike. I suggest anyone reading these complaints very seriously consider the fact that it is just one person's experience and one person's experience might be clouded and they just might just be confused. Sorry for the long rant I just hate for people to get the wrong idea about this company or for that matter any company at all.

"Brian", aka "Cal", is a disgruntled ex-agent of Glacial Energy. Glacial reserves the right to sever their ties at any time with any of its sub-agents due to misrepresentation, which was the case for Cal. Glacial Energy carries an extreme amount of cachet, delivering less expensive electricity for its customers, and prides itself on integrity and loyalty. If it was Glacial's customary practice to not pay its agents/employees, it would not continually be able to receive new licensing in opening markets. As director of the company in IL, I can personally attest that the aforementioned negative comments are inaccurate. We currently have the most generous commission/referral program in place, and take issue with such ludacrious accusations.
