Hello Everyone,

I fought the good fight against GMAC and won. I feel very blessed and fortunate that I was able to defeat GMAC and come away from the war with home, heart, and health intact. However, if I knew then what I know now the battles would have been easier and the victory would have been sweeter.

I did my case as a Pro Se without the benefit of counsel or legal representation. Was that a wise decision, I don't know, but it was the only option available to me at the time.

Whether you decide to represent yourself or hire an attorney I suggest that you become as knowledgeable as possible about the legal system. Do a web search on Yahoo for the Pro Se Handbook. I think most state have one. California's seems to have the most extensive and informative.

If you are filing for, or you are already in bankruptcy I recommend you research the purpose, duties, and obligations of a bankruptcy trustee when there is fraud and/or abuse involved in a bankruptcy. The following site is a real eye opener: www.wjfa.net/bk/manuals/bkfraud&abuseenf.pdf.

You should become familiar with the Federal Rules of Bankruptcy Procedure. The Federal Rules contains information about the codes, rules, and forms necessary to navigate the bankruptcy system. Also, obtain a copy of the Local Rules from the Clerk of the Court. The Local Rules address issues specific to the court where your case will be held.

Folks, here's one last suggestion, it seems as though everyone has the same or similar complaints about their mortgage company or loan servicer. We all claim that they are intentionally trying to steal our homes by failing to keep an accurate accounting of our mortgage loan and escrow payments. What these companies are doing is pure and simple embezzlement, stealing our homes is just icing on the cake. Before you go to court have a CPA do an official accounting of your loan. If we are to prevail we must be able to present evidence to the court of the mortgage company or loan servicer's fraudulent and egregious behavior.

Do not allow GMAC to ruin your holidays. Be of good cheer and know that as children of God he will fight our battles and see to the ruination of our enemies.

Bankrupsty Manual

Marjorie,
The bankrupcy manual is not everything. There are tons of information that you will have to seek, read, and memorize. Do a search on th internet to look for the Pro-Se Handbook, Platoridge, HUD, FHA, etc.
The more you look, the more you will find!
GMAC is losing cases everyday in Federal Court! We can't stop now do the searches, you will find what you are looking for!

How exactly were you able to save your home looking at this extensive manual. I am going through a similiar situation as most in these reports about GMAC. GMAC didn't pay my homeowners insurance, didn't account for payments, didn't apply credits and now foreclosing on my home. I wrote to David Applegate but I have a feeling that will get me nowhere. I don't want to lose my home.

JUST WANTED TO WARN EVERYONE READING THESE COMPLAINTS IN CASE YOU WERE NOT AWARE DITEC .COM IS PART OF GMAC THIS LOAN DEPARTMENT WAS SET UP FOR PEOPLE IN TROUBLE WITH THEIR MORTGAGES IT IS DESIGHNED SO THAT YOU FAIL THEN THEY CAN FORECLOSE ON YOUR HOME IT HAS HIGH INTEREST ETC DONT DO BUSSINESS WITH THEM I KNOW THAT IN FLORIDA HERE THEY HAVE BEEN ADVERTISING LIKE MAD ON THE TV THEY KNOW THAT PEOPLE REFINANCED AND NOW CANT PAY BACK THE FUNDS I HAVE EVEN NOTED THAT SEVERAL OF THEIR ADVERTISMENTS DO NOT STATE THAT THEY ARE A GMAC COMPANY I CALLED THEM ON IT AND NOW THEY ARE SAYING IT MORE THIS COMPANY IS A MONSTER IT MUST BE DESTROYED PLEASE WARN EVERYONE YOU KNOW ABOUT THIS CORP AND WHAT THEY DO TO PEOPLES LIVES

Hello Everyone,

After reading Joe's rebuttal I just wanted to make it clear that I am not a lawyer, nor do I give legal advice. Please, if you need legal assistance contact a reputable attorney who has experience and is well versed and knowledgeable about bankruptcy and/or real estate law.

As far as I'm concern, GMAC is the Osma bin Laden of the mortgage industry and the treacherous foreclosure and bankruptcy attorneys it hires to carry out it tyranny is its Al Qaeda Network. What GMAC and all the other abusive and predatory mortgage company and loan servicers are doing to American citizens is much more devastating, disgusting and vile then what any enemy could accomplish. The embezzling scheme they have concocted and are executing with impunity against homeowners is destroying families, communities, and threatens the very foundation of our economy.

So, Joe, here's the answer to your question. I am, and will always be, willing to assist anyone who is being subject to GMAC's terrorist tactics and anti-Americanism. I love this country, beauty, beauty warts, and all. If it means staying up all night to assist someone in saving their home or their sanity it is the least that I can do to help keep America strong and the American dream of homeownership alive.

Folks I urge you to find a way to call or e-mail our Group. Just like GMAC is stealing from you right before your very eyes, so too is the contact link in this rebuttal.

Virginia knows what she is saying, trust me on this! My incompetent lawyer told me that I had a 30-day extension to find a place for my family, dogs, cats, and ponies, BEFORE my home was sold at a foreclosure sale. Then after the sale we would have about 60-days to remove our belongings from our home! My lawyer told me this around November 20. 2006.

On November 22, 2006 (per Virginia's request) I called my lawyer and asked for the information to be printed in black and white. On November 29, 2006 he came to where I worked to provide me paperwork in black and white showing that I had the additional 30-days to figure out something.
Yes, he brought the paperwork in black and white! It stated that the judgment came AUGUST 23, 2006, and the sale of our home would be on November 30, 2006; the day following my lawyer bringing me the paperwork!

I worked way through the night and Virginia worked the rest of the way to stop the sale of my home. Why Virginia did this I have no clue, but it does tell me that she has ethics and is willing to help those of us that are willing to help ourselves.

The information that Virginia provided on this report, I used and it worked! The information continues to help me fight GMAC while staying in our home.

Will I continue the fight? Yes I will! I will go to my grave fighting GMAC to stop their predatory lending practice's on everyone.
If you want to keep your home listen to Virginia's suggestion's, and do the work needed to keep your home, if not why are you reading this?

Virginia, I just want to thank-you in public (so to speak) of how great full I am, of the help and advice you've given me. Without you I would have lost my home in 2004!
