Another Rip off in Colorado!! I went to G/E on a Saturday in July 2002, got the usual 2-3 hour presentation like all the rest who have reported rip offs. They ran my credit card 4 times to see what they could get, settled for $3k.

Then when I refused to sign it, she said it was already done. With some more badgering on her part and working all the angles. I decided to sign to get out of there and deal with it later, WRONG. No dealing with it later because of the NO REFUND policy, one of the little initial areas on the back of the contract. Says they don't provide refunds or will you ask for one, Basically NO REFUND!! NO Cancellation. So deal with it then or forever hold your piece.

I signed the membership on a Saturday and Cancelled on a Monday.

I took them to court in January of 2003. Small claims and lost due to the lack of legislation.

I also contacted the following agencies to report them but this didn't help at all.
Attorney Generals office
Secretary of state
Small Claims court office
Dispute Settlement office of the court
Office of consumer fraud
Better Business Bureau VISA dispute department at my bank

Now it's 2 years later and I have not used the service or has G/E provided me with any services and to date, G/E has not occurred any expenses except for the time they spent on that Saturday.

I decided to see if I could do anything about it so I contacted the Attorney General - attorney.general@state.co.us and the Consumer Protection - stop.fraud@state.co.us

Attorney General's office replied that they couldn't do anything but the Consumer Protection trying to stop fraud pointed out some consumer laws that might benefit me in an appeal in court. Colorado Consumer Protection Act, 6-1-101-- 908 CRS

Within this Act there is an article that points to a subject called BUYERS CLUB. 6-1-102. Definitions. As used in this article, unless the context otherwise requires:
(2.7) "Buyers' club" means any person engaged in advertising or selling memberships that provide an exclusive right to members to purchase goods, food, services, or property at purported discount prices.
This Act also points out that if they are considered a buyers club you can cancel a contract within a business day for any reason.

Now I need help to provide information that will convince the court that they fall under this category.
Does anyone know of any special services, maybe trips, special events held by G/E or any goods they sell or advertisements. Think of it like a SAMS or COSTCO, by being a member you get deals that you don't get on the street.

If I can prove this I will take them back to court. I believe I can win using these laws and maybe someone else can do the same. Thanks for any help!!

Maybe forfeiture is the answer?

I have been reading a lot of these! And for many of you that have done absolutely NOTHING with the organization of the scam artists that sucked you in, and you aren't just a "disgruntled participant", then the courts are seeing that the contract was not a "meeting of the minds" and a contract where "forfeiture" was done is not a contract! Read some of the stories in here and if your financial exposure is within the guidelines of small calims, take them to court and do it on the principle of forfeiture! And please post your results so more can know what happens!
