In 2008 I purchased a car from Greenlight Auto Sales in Canoga Park, CA. In the sales contract I had included in the total purchase price, gape insurance for $500.00. One year later I received a letter from the gape insurance company stating that they could not approve the insurance because Greenlight Auto never sent in the paperwork.
For an entire year I believed I was protected under the gape insurance. I contacted Greenlight Auto and was told that they had sent all the paperwork and the letter was a mistake. Then I was told that a credit for the $500 would be issued to my finance company. I have yet to see any credit. When I call I'm told the person I need to speak with is out a few days or they will call me back (which they don't).
I'm sure that I'm not the only customer that has been ripped off by Greenlight Auto for false representation on a purchase.

I hear about a lot of dealers doing this. They just keep the money you paid for gap insurance and hope for the best. For the purposes of this response, I'm assuming that the car was totalled and now you owe the lender the difference between what was paid by insurance, and what you still owed on the car.
If I were in your shoes, I'd head for the local small claims court and file against the dealer. You have a contract that states you bought the insurance from them. Don't accept $500 if the amount you still owe on the car (which would have been covered by gap insurance) is more than that. Sue them for the amount that the gap insurance would have paid you if the dealer would have actually submitted the policy instead of just pocketing your money.
