In 2003 I had my taxes done by H and R block. They made an error in what I could claim. I asked them about it, they said it was perfectly legal. Then they asked me about purchasing Peace Of Mind Insurance, that covers any expenses that would effect me if they make an error in filing my taxes.
In 2006 I recieve a letter from IRS stating I owe 1382.00 for the item claimed, that could not be claimed as I had told them in the first place could not be claimed. I filed a complaint with them for 1382.00 and they decided to only send me a check for 178.00 for interest and penalties for the error and refused to send me the full amount. 178.00 was not the amount of my claim 1300.00 was. I am totally ticked off, because not only are they ripping me off, it took me almost a year to get them to do anything about it.
If I knew people who had the same problem, I would file a class action law suit against them right now. So, if there is anyone out there whom this has happened to with H and R Block let me know and if there is any attorneys reading this and want to take on this case by all means contact me.

Sherri writes three confusing items:

Here, she states they ASKED her about purchasing the insurance, she didn't say she did purchase it.
Later she notes:

What paper, I never signed any paper for insurance so they stated. I kept all my tax records for that year and it clearly states they will pay up to 5000.00 if an error is made by them.
So, here she says so they stated, making me think that she believes she DID purchase the insurance, and H&R Block is saying she didn't.
The third post states:
THEY AGREED THAT IT WAS THEIR ERROR SO THEY WERE REIMBURSING ME THE PENALTY AND INTEREST FEES, BUT BECAUSE I SUPPOSIDLY DID NOT PURCHASE THIS PEACE OF MIND INSURANCE, I WAS NOT ENTITLED TO THE REST.
So, is the ripoff that she DID purchase the peace of mind insurance, and now, H&R Block says she didn't?
I'm very interested as I have used H&R Block in the past, though I was never aware of this type of insurance being offered, but if I purchase a guarantee that they will later state I didn't, well, yeah, I'm a bit concerned. Thank you.

They paid you interest and penalties--that is called the "Standard Guarantee" and there is no additional charge. You get it automatically. The "Peace of Mind" you pay for.
In the event a tax preparer makes an error on your return OR the IRS disagrees with something on your return and you end up owing taxes, H&R pays up to $5000.00. I suggest you look on your income information worksheet in your papers and the charge will be there if you chose to purchase it. Sounds like you declined. You would have had to sign a paper if you bought it. Good luck to you.

"Under the "Peace of Mind" guarantee, the company will pay up to $5,000 in additional taxes owed by a consumer if those taxes are the result of a tax preparer's error. "
The taxes the IRS is asking are not the result of an error in your tax return. They are taxes that are due. The error was that you didn't pay them.
If HRBlock is fighting on your side and gets the IRS to allow the deduction, then they've won you money. If they don't win the fight, they haven't cost you anything.
I don't see a rip off, just a disputed item on a tax return. And if your IRS is anything like Canada Revenue, I'd put even money that HRB is correct.

What is it you were trying to claim?
If you knew it couldn't be done why did you sign the return? It's the responsibility of the TAXPAYER not the preparer.
They are not liable to pay additonal taxes that you owe, if they made an error they can pay for the the P&I but not your taxes.
It still hasn't been told what type of "claim" was done

Also, the 2003 Peace of Mind contract (if you purchased it -- check -- at storefront offices, there's an additional charge -- its included in the fees at premium offices), did guarantee that Block would pay any additional tax IN ADDITION to any interest and penalties that you were assesed because of a preparer's error. If you purchased the Peace of Mind guarantee, the only way you could lose this protection is if you waited more than 30 days to contact Block regarding the IRS letter (which I'm guessing, from the tone of your letters, you didn't)
Block's standard guarantee will pay any interest and penalties, which pretty much would leave you exactly as you were if the return was prepared correctly.
Fight the good fight!
BTW -- to the guy who suggested you were trying to rip off H&R Block . . . you paid good money for extended protection and you deserve to get what you paid for.

I PUT EVERYTHING I WAS SUPPOSED TO INCLUDING EXACT WAGES AND NORMAL DEDUCTIONS, I DID NOT DODGE ANYTHING AND NO I AM NOT TRYING TO SCAM H AND R BLOCK.
THINK ABOUT THIS, IF I WAS SCAMMING WHY WOULD THEY BE PAYING ME ANYTHING BACK AT ALL? THEY REVIEWED ALL THE PAPERS AND ALL THE PAPERS I SENT I RECIEVED FROM IRS, THEY AGREED THAT IT WAS THEIR ERROR SO THEY WERE REIMBURSING ME THE PENALTY AND INTEREST FEES, BUT BECAUSE I SUPPOSIDLY DID NOT PURCHASE THIS PEACE OF MIND INSURANCE, I WAS NOT ENTITLED TO THE REST.
EVEN THOUGHT THEY ADMITTED IT WAS THEIR ERROR, THEY STILL MADE ME RESPONSIBLE FOR THEIR MISTAKE. I HAVE EVERY YEAR PAID MY TAXES AS I SHOULD HAVE AND AT 42 YEARS OLD THIS IS THE FIRST TIME THEY HAVE CONTACTED ME FOR ANY REASON.
SO PLEASE REFRAIN FROM ACCUSING ME OF ANYTHING IF YOU DO NOT KNOW WHAT YOU ARE TALKING ABOUT.

They filled out a tax return with a claim that you knew was going to be disallowed. You remitted less tax than you thought you should have to.
The 'dodgy' claim was disallowed.
IRS asked for the taxes that you still owe, and some interest.
HRB paid the interest.
You still are responsible for paying your taxes.
If anything, you are trying to rip off HRB to get them to pay YOUR taxes.

The "Peace of Mind" insurance will ONLY pay the penalties and interest. It NEVER pays your tax.
This is also clearly stated in writing on the document.

I did review the form and I did tell them I could not do that and then she went off to tell me if I paid ex amount of dollars I could claim it, she said people do it every day and it is perfectly legal. I figured she was a professional and knew what she was talking about. I am not a professional, so I entrusted my taxes to someone I thought was.

When you have your taxes prepared it is the responsibility of the customer/taxpayer to review the return. If a deduction/claim was made just as you admitted "couldn't be done" you should of never allowed them to put in on the return. When you sign the return you are agreeing to it. It's not really their fault when it comes down to it.
