I have had the misfortune of trying to help my mother deal with Hawk Security.  She has been on one security contract for 12 years.  Over the 12 years the company changed ownership several times until it became HawkSecurity.  My mother is a single 68 year old woman who can barely read regular print, let alone ultra fine print.

Anyway they got her to sign a contract in January of 2008 giving an incentive to sign.  She had previously signed a contract in 2004 with them.   She is now moving and studying new local monitoring systems and when she went to cancel her contract was completely caught off guard to find out she is still in contract with Hawk.  Well evidently they have an auto renew contract that renews for a year unless you give 30 days written notice prior to cancelling.  This is in ultra fine print.  Our printer can not print such fine print clearly for me to make it all out, but squinting I can partially see where it says that it does renew. 

However this company did not provide any notice written or otherwise that the renewal was to take place.  According to Texas Legislature Act HB 1702 Section 1 Title 4 Chapter 51 this is an act of Deceptive Practices.  This covers any contracts written after September 1, 2007. 

I tried to plead with the customer service agent Denya but she had zero power, ability, or desire to help.  She told me that there is no one of authority there at 5pm.  I am told someone will call me. 

Now I know the law and I encourage anyone else effected by this to make complaints against them for deceptive practices. 

If they will do this to my mother, they will do it to yours.  And there will be many out there taken advantage of without anyone to stand up for them.  Help me not let this company get away with this.

Update to my earlier report. 

After having frustrating dealings with the first levels of Hawk Security, I have been able to get the matter resolved.  The fact that the issue is resolved is a good thing, however I do believe that there are many out there that are not good with confrontation and just pay their way out of what here in Texas is not a valid contract. More on this in a second...

How was the issue resolved you ask?? no?  Well I will tell you anyway.  I received a response via my facebook as I had written them trhough facebook as well as posted a comment.  Their comment to me was that they will be getting in touch with me shortly.   Later that day my mother received an email from what I am to beleive is a supervisor.  This email said that after reveiw they will go ahead and let my mother out of her contract and hope that we choose to use them in the future.  It is a bit of "a little too late for this", but I appreceiate the tenacity.  All we had to do was write them a letter for the file to cancel the service / contract.  Which we did with haste!

Then the next day I did receive a call from another supervisor out of Dallas who called me to apologize for the situation.  I respect this.  It is not easy to call a customer whom you know is "out for blood".  I accepted his apology but informed him that the contracts they are using are currently "according to Texas Legislation on auto renewing contracts" deceptive practices as of Sept. 1, 2007.  He genuinly thought their contract was the same as all other alarm contracts; I then explained they are not.  My mpther had signed one with Monitronics the previous night which after the 36 month term continued on in a month to month term.  The agent from Monitronics told me the auto renew is not allowed in Texas.  Confirming my earlier findings. 

I ended up giving the Supervisor some leads on how to find the information on the auto renewing contracts and he said he will look into them and pass them back to the corporate in St. Louis.

I know it is a long shot, but if this is a reputable compnay that cares about their customers and compliance, they will reveiw the facts and act according.
