My BowFlex payment was due September 11, 2006 -- a WEEKDAY. I submitted by payment ONLINE via (((ROR redacted link))) ON THE DUE DATE of September 11, 2006. I was subsequently called AND charged a $39.00 "deliquent" fee because they are saying that my payment was late. I called on October 9, 2006 to find out why I was charged this fee in September and the customer service representative stated that because it takes 2 business days to draft the payment from my bank account (they drafted the payment from my checking account on October 13, 2006), the payment was considered late. I asked her that if I would've mailed a CHECK and they received it ON the DUE DATE, would it be considered late? The answer was no, so why is it any different for the online payment process?!?!?

The ONLY disclaimer on their website about online payments is:

"When making your payment, please, remember the following:
o If you make a payment less than the minimum payment due,your account could be subject to a delinquency charge.
o If you make a payment more than the minimum payment due, you will still be required to make a payment in the next billing cycle.
o A minimum payment is due each billing cycle.
o Payments can only be drawn on a checking account.

Payments processed through this website are usually credited within two (2) business days after receipt of the authorization. However, credit for payment may be delayed up to five (5) days if payment is made at any location other than the designated payment address printed on your statement."

There is NOTHING there stating that if a payment is made ON THE DUE DATE, a late fee will be incurred because it takes 2 business days to draft the payment from the bank account. And since I made ANOTHER payment that was DUE OCTOBER 9, 2006 ON October 9, 2006 via their website, I'm sure that they are going to try to charge me ANOTHER late fee.

This is misleading, POOR business practice AND a rip-off. They are CLEARLY taking advantage of people who are attemping to establish credit. I've already reported them to Better Business Bureau Serving Eastern Oklahoma.

CORRECTION: The September 11 payment was drafted from my checking account on September 13. I was charged ANOTHER Delinquency Charge for my October 9 payment, which was drafted from my checking account on October 10. They are charging me delinquency charges even though I submitted my payment on the DUE DATE. There is no disclaimer on their payment website that supports these charges.

I reported them to the Better Business Bureau (which I recommend EVERYONE that has had a problem with them, do. Here's the website: http://www.arkansas.bbb.org)

Here's PART of the drawn-out response I got:


1) For security purposes, we use a third-party internet payment processing vendor to capture and then process online payments. Unfortunately, we do not have immediate access to payments as soon as they are AUTHORIZED online. Once payments are AUTHORIZED online by our card holders, then they are processed and RECEIVED by us when funds are forwarded to us by the third party. A payment cannot be considered "made" until we receive the money. This can be the next business day - or perhaps on the second business day after the consumer authorizes payment, as disclosed on our website.

In summary, the website clearly informs users that payments are usually credited within two business days. Therefore, any website payment needs to be AUTHORIZED at least two full 24 hour business days prior to the date on which a consumer intends to "MAKE" a payment. This is important to avoid late fees, and because any special or promotional terms a consumer may have on his/her account terminate immediately if a payment is not received as agreed.

I hope this clears up the misunderstandings.

They DID credit me ONE of the two late fees back and I FULLY intend to pay the full balance of this card off on my THIRD payment because I REFUSE to give them anymore of my money -- in interest OR "delinquency charges". SPREAD THE WORD ABOUT THESE JERKS!!!
