Hometown Wholesale Furniture ripoff, using money to finance business, not refund yet, unavailable item is still being manufactured Sherman Texas

Ordered the Bellagio bedroom set in August via a win on an EBAY auction, it was promised by 1st of Oct. When it didn't arrive, started calling (only getting the answering maching) and e-mailing. Finally recieved an e-mail in Nov informing me they could no longer obtain the set and would send a refund.

Started getting mails from other EBAYers who informed me they were in the same boat, paid for the merchandise, it never showed up and are now STILL awaiting long promised refunds. I sent a fax informing them I would contact the police, BBB, Chamber of Commerce and my attorney if they did not contact me with a date I could expect the refund.

They returned my call 10 minutes after sending the fax to inform me, hold on. They would not be able to send the money as they were needing to use it to build up the $100K needed to secure their credit card business! They indicated that if all goes well, they might be able to send a refund at the end of November. Personally, I'm not holding my breath.

I know that at least 7 folks have filed police reports with the Sherman Police Department, I would recommend all do the same. I am contacting the Attorney General to initiate a class suite (Fraud). Oh by the way, that set it STILL being manufactured by Samuel Lawrence and is definitely AVAILABLE!
