Iron Planet Undisclosed machine condition Pleasanton California

Bought a John Deere 655C track loader at online auction.  They advertise an iron clad assurance inspection with many pictures for the buyer to observe with details of machine condition.  After winning bid I proceeded to drive to machine location for a personal inspection.  Mostly correct on details except hydraulic tank was about 20 gallons low,(it has clear site glasses easy to see to verify oil level, don’t know how inspector missed??), bucket pivot pins were in need of repair ( loose and worn) and inspection report listed 3 out of 4 stars, and left track chain had been welded together.  Called ironplanet about misleading information and undisclosed welded track chain and was told i was not to inspect the machine until after I paid for it, only after paying for and receiving machine could I file a dispute?  I stated that I was not paying for until the deficiencies were addressed.  

After several calls and 7 days later I received a call from the senior manager, (at this point I was in their default of payment time frame).  I stated that this could be a safety issue if the track were to brake apart, he stated they don’t know each states safty regulations and that they weren’t responsible to keep up with them.  I was told that they represented the machine accurately, I asked about rescinding my bid but was told it would cost me $5000, and they possibly would extend the default period.  If the track chain were to break to unexpectedly it could be disastrous!  I had my local dealer quote me on repairing the track and asked to split the costs with iron planet and was rejected.  I don’t think a judge absolve them if that happened.
