I satarted lease with JB Hunt in May 2006 and worked for first 30 days and set my off time for 10 days. Came home and took my off time. Came back from my off time and JB Hunt had picked up truck and empty trailor and penalized me for another month before they would allow me to go back to work. They completely terminated my employment and required me to completely requalify to go back to work for them. I felt as if I was a convict.
Beakeven mileage was 2150 for me. Actual times ever reached breakeven mielage was seldom. My average mileage while employed by JB Hunt was 1700 miles per week. My term of employment with them was 19 months and for the past 8 months did not receive any funds. All earnings went to pay fuel, truck lease payment, etc.
I became ill and was off for approximately one month and got deeply in debt to these people and unable to get mileage to catch up. The company initially offered a loan to pay the amount of expense in excess of income so that I could start receiving a pay check each week. After signing a promissory note agreeing to pay back a small amount per week, the operations manager decided that it would be handled differently after the amount being borrowed had been given to me. The amount being borrowed was taken in a one time payment instead of the agreed weekly payment. That put me further in the hole because JB Hunt would not give me the mileage to get ahead.
I too hope an attorney sees this and will act upon it and will gladly give any information needed.

Determination of Employee Vs Indepedent Contractor

Actually you may want to refer to the IRS rules on what determines an Employee Vs Independent Contractor - With an employee you are told where to go, what to do, use the company's equipment, are trained by the company, etc.
There is a fine line between this determination and you can actually file a form with the IRS to let THEM make the determination.
JB is good for getting rid of people for very idiotic reasons........what do you expect when you have people that are hired without a lick of any transportation knowledge.

Until these rip off companies are unionized and forced to pay employee's correctly, they are going to keep pulling this s**t!! Get out of this stupid go nowhere industry now. I talked my boyfriend out of becoming a driver and now he is a welder, happy and making a lot more money than if he had wasted time doing this!!!

Until these rip off companies are unionized and forced to pay employee's correctly, they are going to keep pulling this s**t!! Get out of this stupid go nowhere industry now. I talked my boyfriend out of becoming a driver and now he is a welder, happy and making a lot more money than if he had wasted time doing this!!!

Jimmie,
First of all, you need to understand the difference between being an "employee" and being an "independent contractor".
When you "lease" a truck, you are NOT an employee, therefore you cannot use the term "employment".
You were an independent contractor, which means under the law and the contract you signed, you were self employed.
Nothing illegal here. Unethical, for sure, but not illegal.
You need to thoroughly understand what you are signing BEFORE signing it.
