 Failure to honor money-back guarantees

Complaint: Client contacted network of associated to have us hire him to develop website search engine optimization program. ***** *** guaranteed a sales lead within 60 days of hiring him or he would refund our money AND still work for free the rest of the year (10 months). I gave him an initial $400 and he did nothing for me or to my website. I asked for a refund and he said he'd refund my money the end of September. Now he states he will not honor his guarantee and will NOT refund my $400.

Not a Scam, No money owed

AUTHOR: SmartCents - ()

POSTED: Tuesday, January 14, 2014

My name is Jason Cox and I own SmartCents Media, LLC.  I have numerous reviews that are all positive across the web, from Facebook to Google.  This client was a friends franchise, Whitewood Tax Solutions, in Richmond Virgina.  He wanted me to do his franchises a favor and offer them a mobile web site (because their mobile site was restricting them on how many page views they could get) and to redo their main site and add SEO.

This agreement had zero to do with Web Hosting or anything similar.  My guarantee was very simple and straight forward.  I told them to pay me half of the $800 down, which he did, and then pay the other $400 once the mobile & desktop sites were done.  I also told him their was a money back guarantee if, once both the mobile site and desktop site were redone, they did not generate $800 in revenue from these I would refund them back their money.

The issue is with their Owner of Whitewood Tax Solutions who failed to give me any log in access that would allow me to redirect their website to a different server.  They had numerous issues with their desktop website including zero SEO, no webmaster tools, no analytics, nothing.  After asking the Owner of Whitewood Tax Solutions for 2 months, this client decided to abruptly write this and cancel his contract with SmartCents Media, LLC.

I did in fact build him a custom Mobile Site, that was completely redesigned, that had click to call features, custom reporting, call tracking, and everything that I contracted them for.  He paid $400 for a mobile site, which is what he agreed, but the rest of the work was handcuffed because of his owner.  I did tell this client that I was more than willing to let him KEEP the mobile site, no additional charge as agreed, for the next 12 months and have me keep working with his owner to settle the desktop site.

He was rude, hung up, threatened to sue, and make false statements about my company.  I was baffled that a BUSINESS like himself did not think that a custom mobile site, with unlimited page views, call tracking, SEO, google/yahoo/bing submissions for $400 was beneficial for his company; all the while he was paying over $300 a month for his lousy site that only gave him 50 page views a month, no click to call button, no SEO, no search engine submissions; nothing.

This complaint is absolutely a farce, it's a company who cannot see the value in online marketing, and is obviously not financially sound enough to even be in business.  I am not refunding money as I clearly stated both items needed to be done for the guarantee to be in place and they weren't.

If this client is willing to work with me, I will be more than happy to AGAIN re build him the mobile site (no charge), do al lthe work as we originally agreed upon, do his desktop site to his approval, and then receive the final payment of $400.

Thanks
