On 24 Dec 07, I paid a deposit of $250 to have my car shipped from CA to TX. I scheduled a pick-up date of 2 Jan 08. On 4 Jan 08, I received a message on my phone from a "driver" saying that he was in the area and could pick up the car on 2hrs. I was at work in TX. I had explaint all this to the sales rep 'Clint'. I was never given notice that the car could be picked up on the 4th and was never asked if I would be available to hand the car over. I have not heard from the company since and I was told that since I was not there to hand the car over I will not get my deposit back. There was never any confirmation that I would be available to hand the car over on the 4th.

In the end I had to fly to LA and drive the car to TX, something I was trying to avoid. I still beleive I am entitlted to my deposit back. The pick-up date was scheduled for the 2nd not the 4th and I was never contacted by the company or the driver.

I buy and sell classic cars for a hobby, and I use shipping companies all the time.

First of all, you must read your contract. I only use a couple of companies, because they are fast, cheap and reputable. My contract with either company states that the driver of the truck will contact me 24 hours in advance. I have been in your situation, and have told the driver that it is impossible for me to get the car to him, and that has been fine. Another truck would show up eventually, or the driver would wait for me until I got off work.

Also, you need to find the clause in there that states when they can pick the car up. They usually don't give you a specified date, unless the car is going to a facility to wait for a transport. They will approximate the date. However, you still need to be available around that time, and the contract will state the time frame you have to be available.

Good luck, you do have a case. I would call your credit card company and dispute that charge, you will win.
