The corporate office advertises "$5.00" fill-ups, a meal consisting of an entree, a cookie and a drink for $5.00.  This restaurant and KFC's in the area, charge $5.49.  When we complain they say it is because of the increase in the minimum wage in California.  I'm fine with paying the $5.49.  However, I am not fine with having it advertised for $5.00 and then having to pay a higher price.  We have complained to the manager with no success.  The owner refuses to return phone calls.  The corporate office refuses to do anything about it and will no longer take my phone calls.  It's really a simple matter - they need to charge the same price that is advertised.  if they want to charge more, they can and should change their advertising.  Otherwise it's called "fraud".

I am not going to scan for every single ad that they may have published or posted for the last year. I am not going to debate what you claim they may or may not have said to you.

But if you are claiming that they do have ad's that do not specify it is for participating resturants or something similar, then take a copy of that ad along with your receipt showing the higher price and find a good attorney.  Where you can have them sue for "False Advertising".    If everyting is as you say, especially if you have proof that the reason they gave you for not changing their advertisement is because it costs to much, this should be an open and shut "slam dunk" case for you.

Even the corporate office doesn't say it's "at participating restaurants."  The only excuse or answer we've been given is that it costs too much to change their advertising.  The problem is that some of the advertising has changed several times in the past year or so since this price chane was made but the price difference has not changed.

I can just about guarantee you that EVERY advertisement has some statement or line that says something similar to "At Participating Resturants". Meaning that you may not see that price at every resturant. The only situation you would have a case is if inside of that specific location the price on the menu or signage states it is $5.

However, if you have an issue with the price you should not brush it off.  Instead of showing you don't care and buying it anyways you need to not give them your business. You need to let the management at the store respectfully know why you are not patronizeing their store.
