This is Scott and I am more than happy to discuss this situation with anyone. The reason I wrote this ripoff report about Kerstin Fossen, now KFossen and KFossen.com, is to shed light into the way Kerstin Fossen conducted business with me. I am not suggesting that she is like this with all of her clients. I am simply sharing my experience with her.

In addition to not holding up her end of the agreement, Kerstin has now also written false statements about me. I am writing this rebuttal to address these statements. I stand by my word and am more than happy to answer any of your questions.

1. If anyone is defaming someone, it is Kerstin Fossen defaming me. Kerstin has made false statements about me, posted links to my websites, social media and contact information. The things that I wrote about Kerstin were all true. It seems like Kerstin seems to have a bad memory with the way this situation really went. I paid $2,000 and did not receive the work that was agreed upon. At the end of the day, I lost money and did not receive what I paid for: a new website. 

2. The designs were late. I did not expect Kerstin to take calls after business hours. I respect peoples personal time. Kerstin said that she works from home every day and that it is ok to contact her any day of the week. Kerstin was non existant on the telephone. As much as I am ok with communicating through email, some things are best to be discussed over the phone or in person. Kerstin even mentioned that she regularly talks with clients on the telephone. What she said and what she did was not consistent.

3. Kerstin absolutely did not render my request for a website. I have hired many many creative professionals and web designers and have never had any issue with any of them except for Kerstin. I understand the creative process and am also well versed in customer service and professionalism.

4. The product previews that Kerstin is posting here were not provided to me until after I filed a claim. They are actually pretty good. The reality of the situation is that Kerstin sent me one design preview that clearly demonstrated that she did not read our creative brief carefully. This was a waste of our time and we did not want to continue working with someone who did not read our instructions closely. And it was late with no explanation as to what was taking so long. We did not feel like continuing to work with someone who misses deadlines. We did not abandon any project. We chose not to work with Kerstin because we were not satisfied with the way she conducting business. We think she is talented, but we do not have the time to work with people to fail to communicate, miss deadlines, and not read or acknowledge our specific requests of service.

5. Kerstin may guarantee her works, but she clearly did not read our creative brief. We put a lot of effort into filling out the creative brief. We feel that Kerstin did not put in the necessary effort in reading the brief and implementing our comments in her design preview. When we finally received the one design preview, after the deadline, we chose to not submit our edits because we did not want to work with Kerstin at the point in time. No one demanded anything except for a refund.

6. I only called Kerstin over the weekend because she specifically said that she works on the weekends and said it was ok. She actually said she enjoys working on the weekends. If Kerstin was off on certain days, and mentioned this to me, I'd have respected her time and not contacted her on those days. 

7. Kerstin claims that I was not available for her. I always called Kerstin back within 24 hours. It was Kerstin who did not return phonecalls or emails in a timely manner. It is comical that she is trying to spin this on me.

8. Kerstin keeps referring to this is an abandonment of project issue. A terms and service agreement takes two to tango. Kerstin did not hold up her end of the deal so we terminated our working relationship with her. Kerstin keeps suggesting a credit with KFossen.com. We do not want a credit as we do not want to work with KFossen. We have already hired a new web designer. We are very busy and try to only work with people who meet deadlines and communicate clearly. It is not in our best interest to work with people like Kerstin. It is nothing personal towards Kerstin. It is just what is best for our company. Maybe Kerstin needs to look at herself a bit more honestly and recognize that she did not hold up her end of the agreement. It is not a surprise that another unhappy client also posted a bad review about KFossen on here. She will probably suggest that we are the ones at fault however. 

9. The launch date was absolutely an issue. I did not make up my own mind about a timeline. We agreed on a timeline and Kerstin missed deadlines. Kerstin refers to the project as being "on track" but that was not the case. Kerstin did not even email or call with an explanation. If she did, I probably give her a chance and stick with her. It was the lack of communication that made us pull the trigger on this working relationship. 

We do not doubt that Kerstin has a lot of ability with graphic designing. The point here is that we felt that it was in our best interest to work with Kerstin based on the things that I have mentioned in this rebuttal. I filed this report about KFossen.com to better inform other business owners about my story.

These clients decided to cancel a job and demand a refund of custom work and hours spent. This guarentee protects clients so they KNOW they will be happy with their product. Scott Fishman (comment 1) decided to abandon and threaten with blackmail of bad reviews to get a refund. KerstinFossen.com does not tolerate this attempt to collect funds on a project which was ordered, started, booked, and completed. It was the clients choice to "quit" the process. A credit of the sum they paid for the project ordered is open for use. The so called "ROBBERY" is not at all what it is, it is a custom product which the client agreed to commit to - and then they abandoned. The sums are due, and when the client decides to complete the project they booked in - they can contact kerstinfossen.com

TIMELINE: The timeline would easily be hit, if SCOTT FISHMAN from ALL AMMERICANACADEMIES worked with me. He claims the designs were late... they were not. It was over a holiday weekend. He expected KerstinFossen to take calls after business hours as well as on weekends... I did try several times outside of business hours which made him think... this was normal and ok. Instead it was a gesture to go above and beyond the call of duty.

TEMPLAGE vs. CUSTOM:
The client states I did not render his demands, this is untrue. I offer a guarantee that he will LOVE the end result. He saw a 1st draft and pulled the plug. This is outrageous! You have to have the chance to see all the options and make changes pick it apart, and such. All my clients when they give feedback are happy! Its a work in progress, not a one shot wow factor.

NOTE: I guarantee my works. This means if the client does not like what they see, I edit until they are happy! This client decided to not put effort into the process. He submitted NO edits at all! Demanded to talk outside of business hours it was nonsense.

CALLS
Again - Scott Fishman was trying to call over the weekend, after hours and  such. I called him back EVERY time... as well as sent emails stating "I gave you a call - let me know when you are ready."

Everytime I called, he did not answer. He then would call back and yes I do have other calls coming in or was out of the office due to 9-5 (Monday thru Friday) workday.

CHARGE OF CARD
In the terms and services - ordering a custom product means you are committing to the project. Scott Fishman abandoned this project. The credit sits here at KerstinFossen.com for him to use towards the project. This is very clear on the phone and during payment that when you sign up to complete a project you are committing to a contract which states you plan to complete the project as well.  This client choose to abandon.

LAUNCH DATE:
Again - the launch date was no issue. It was the clients own ideas of what dates items should happen and he made up his own mind that the timeline was not on track... that is not the truth of the mater.  This project was on track and would be a WOW factor design if Scott Fishman wished to continue on it.

This client also seemed to leave out a name and company. I find this odd to not be proud of the statements you claim online to push a company in the mud yet not leave a name. Mark Singleton with SEX POODLES started a job which then decided to just place on hold. This went from weeks to months then he lost interest completely on the 9th month of on hold status.

He decided to abandon the project and it is a sad attempt to blackmail for a refund. Mark Singleton was a client since MAY 2011 which in December contacted me after 5 months of silence and out of the blue stated the designs and programming he had approved needed to start at ground zero That of which was already 3 months of work which was approved by Mark Singleton himself.

There were endless amounts of wireframes, client calls, planning, project management, to get him to the stage of his companys identity which he came to today The direction and consulting of KerstinFossen.com was worth more than the project was bid He was a client for 9 months on consultation progress with a request for a full refund after abandoning the project. All clients are under the terms and services at KerstinFossen.com which is why it is openly discussed. It is a two way contract for all jobs which states YOU as the client will be happy with what you order, and WHAT YOU ORDER must be paid for This is only good news for a serious business owner who orders a product as you know you will be happy with the end result!  Wow,  I have all the same complaints.  I am seven thousand dollars into a project with nothing more than a web design that I could have created myself.  I paid her with a bank to bank transfer and did not use her site to make payment.  She claims that I am still bound by her contract which I was never made aware of, I did not sign a contract click to agree.  Ive read it because she has recently directed me to it because i am very disatisfied with the work that she has done.  By her own admission she had done 1600 dollars work which is questionable........But I have paid 7000 dollars and she wants more.  I wish you could see the work she thinks is worth 7000 dollars ....its criminal in my opinion.   I am motivated to make sure that this does not happen to another consumer out there.  I have tons of e-mails that support my position and would love to recoup my money.  I even recieved details for someone elses website in an e-mail from her,  now that bothered me because i had her sign a NDA before sharing with her my website details.

I PAID HER $1,000 AND FILLED OUT HER DESIGN BRIEF FOR MY NEW WEBSITE. SHE WAS SUPPOSED TO DELIVER THE FIRST PREVIEW A WEEK LATER. ONE WEEK LATER, NO PREVIEW. DAYS AND DAYS WENT BY WITH NO COMMUNICATION. NO RETURNED PHONECALLS AND NO RETURNED EMAILS. A WEEK LATER, SHE EMAILS ME. SHE SAYS
THAT SHE WILL HAVE THE PREVIEW READY IN ANOTHER WEEK. I SAID OK. ONE WEEK LATER IS WHEN I LEARNED THAT I DID NOT WANT TO WORK WITH KERSTIN FOSSEN. THE COLORS WERE WRONG. IN THE DESIGN BRIEF, I WROTE THAT I WANTED THE SITE TO BE BLACK, BLACK, BLACK, RED AND METALLIC BLUE. HER DESIGN TURNED OUT TO BE GREY WITH A TOUCH OF WHITE. I PROMISE YOU THAT ANYONE WITH NO DESIGN SKILLS CAN CREATE A NICER PREVIEW THAN WHAT SHE SENT ME. I HAVE WORKED WITH MANY DESIGNERS BEFORE AND I AM WELL AWARE OF THE CREATIVE PROCESS. I SET ASIDE ANOTHER 30 MINUTES FOR HER. 29 MINUTES LATER, I GET A VOICEMAIL FROM KERSTIN FOSSEN. NO MISSED CALL. SHE SENT A VOICEMAIL AND DID NOT ACTUALLY MAKE THE CALL. YES YOU CAN DO THIS. I IMMEDIATELY CALLED HER BACK AND SHE DID NOT ANSWER. I LEFT HER A NICE MESSAGE TELLING HER THAT I AM HERE WAITING FOR OUR PHONE MEETING. NO CALL BACK. 30 MINUTES LATER I RECEIVE AN EMAIL FROM HER. KERSTIN SAYS THAT HER OFFICE JUST CLOSED AND SHE CAN NOT CHAT. AT THIS POINT IN TIME, I MADE THE DECISION THAT I CAN NOT WORK WITH SOMEONE WHO AVOIDS DIRECT COMMUNICATION. I ASKED HER FOR A REFUND FOR MY DOWN PAYMENT OF $1,000. NO RESPONSE. THREE DAYS LATER, I LOOK AT MY BANK OF AMERICA BUSINESS ACCOUNT AND WHAT DO I SEE? NO REFUND. TO MAKE MATTERS WORSE, SHE CHARGED ME AN ADDITIONAL $1,000!!!!!!!!!! SHE HAD THE NERVE TO RUN MY BUSINESS CARD, A BUSINESS THAT PRIDES ITSELF ON HARD WORK AND VALUES,AND ROB ME FOR AN ADDITIONAL $1,000. SHE USED HER BAD SERVICE AS A WAY TO GAIN A FASTER PAYMENT, WITH LESS WORK, FOR HERSELF.

TO MAKE MATTERS WORSE, SHE CHANGED HER TERMS AND CONDITIONS WHEN SHE FOUND OUT THAT MY LAWYERS WERE GETTING INVOLVED. WHEN I MADE THE DOWN PAYMENT WITH HER, HER TERMS AND CONDITIONS BOX WAS INACTIVE. NOW SHE IS CLAIMING THAT I SIGNED SOMETHING THAT I NEVER DID. I READ EVERYTHING I SIGN. IN MY ENTIRE LIFE, I HAVE NEVER FILED A COLLECTION SUIT AGAINST ANYONE. I TRY AND GIVE PEOPLE THE BENEFIT OF THE DOUBT. HOWEVER, IN THIS SITUATION, I WAS BLATANTLY CONNED, ROBBED, AND IGNORED. I KNOW THAT MANY GRAPHIC DESIGNERS ARE GREAT COMMUNICATORS, SO I AM NOT TRYING TO DISRESPECT THE GRAPHIC DESIGN COMMUNITY. IN THIS SITUATION, KERSTIN FOSSEN HID BEHIND HER COMPUTER AND VOICEMAIL CHARGING MY BUSINESS CARD FOR WORK SHE DID NOT DO! AND THEN SHE FORGED HER TERMS AND CONDITIONS AND TRIED TO PUT THE BLAME ON ME. I AM OUTRAGED TO SAY THE LEAST!

AGAIN, I WAS ROBBED $2,000 BY KERSTIN FOSSEN AND FOSSLOUNGE, LLC. THIS IS THE FIRST TIME I HAVE EVER LAUNCHED ANY SORT OF WEBSITE LIKE THIS. IF YOU KNOW ME, YOU UNDERSTAND THAT I AM A TEAM PLAYER AND WORK WELL WITH OTHER PEOPLE. THIS IS NOT A CASE OF BAD CHEMISTRY. I LITERALLY SPENT DAYS AND NIGHTS PREPARING THE CREATIVE BRIEF AND CONTENT FOR KERSTIN TO READ AND APPLY TO THIS PROMISED CUSTOM SITE. I HAVE SPENT WAY TO MUCH TIME TRYING TO BRING HER TO JUSTICE AND I AM SICK AND TIRED OF THIS NONSENSE.

I AM DEEPLY SADDENED BY THIS AND AM TRYING TO RECLAIM MY MONEY. I HAVE WASTED FAR TOO MUCH TIME ON THIS ALREADY. I AM TRYING TO MOVE ON, COLLECT THE MONEY I WORK HARD FOR, AND HIRE SOMEONE ELSE FOR A NEW WEBSITE. OUR ORIGINAL LAUNCH DATE OF 1.1.2012 IS NO LONGER A POSSIBILITY. THIS IS EFFECTING OUR BUSINESS AND I AM VERY UPSET. OH WELL. WE LIVE AND WE LEARN. I HOPE THAT BY LAUNCHING THIS SITE, YOU WILL NOT MAKE THE SAME MISTAKE I MADE.

IN A RECESSION, PEOPLE TALK ABOUT WALL STREET ROBBERY. THIS IS PROOF THAT THIS GREED IS GOING ON AROUND THE COUNTRY. NOT JUST ON WALL STREET. WE NEED TO STOP THIS!
