I recieved a letter stating I owed a $4,039.39 debt to LLC, Bally's and the Law Office of Mitchell N Kay, P.C. waso ffering me an :opportunity to settle the account (which does not exsist) at 40% of the balance due 1,615.76
I called the compnay and begane suspicious when they had my social security no. but not my correct address. I sent the law office a letter stating a wanted a copy of the agreement.

You need more than just your address

I am just writing my comments to advise this person that in collections the burden of proof is not only on the agency but also on the consumer.
You mention that they have your correct social, but not your correct address. You need to be more clear on this matter;maybe you moved within the last 3 or 5 years? Did you ever had an account with the client ? Not having your address could be as simple as you moving to a new address and the client never got an update on your address.
I notice that you didn't say, I never had an account with the client. Could it be that you are trying to hide an old bill under the status of limitations or pehaps is an old bill that you don't remember, which by the way you would still legally owe,but they cannot persue you legally to collect the bill.
In other words, you don't owe the bill if you can honestly say that you never opened the account,and just found out about it recently. Sometimes is a legitimate case of fraud but many times is not. But I don't think that you can assume that the Law Office of Mitchell Kay is ripp off material (at least in your case) by not having your correct address!
