My mother was looking for a great pre-owned vehicle as her last one was totaled out by a Jeep Cherokee that rear ended her 2000 Pontiac Grand Prix. Well anyways we looked for a few weeks and ran across this 2003 Pontiac Grand Prix GTP, that Legend Nissan had advertised on the internet for $6,000. We both went wow that is a pretty good deal. They had the car fax posted online which showed it was a one owner with 21,917 miles on the odometer. So we decided to give them a ring and a guy named Michael Hall picked up the phone. He told me they still had the car and like any good consumer I tried to negotiate them down lower for my mom. Well we finally agreed on a price of $6500 with me paying most of the shipping. I was told not just by Michael but Cristine that the car was PERFECT and needed nothing.

Buying a car with a hair under 22,000 miles on it I did not doubt it. So after a day of thinking about it I called them back and decided we were going to buy it. I however wanted a "Guarantee" of some sorts that the car was mechanically sound. They said okay, we will sell you the vehicle with a New York State Inspection. I looked this up on the internet to see what was checked under New York law and said they pretty much check everything over and felt comfortable to agreeing to those terms. So the next day 1/23/13 we go to the credit union as they have a fax machine to get a check. I call the dealership several times after 9 am trying to get a hold of them and nobody picks up. We said to ourselves maybe they are closed or the power went out?

So anyways we decided to get the cashiers check and mailed it to them. Finally at around 12:30 EST I gave them a ring back and Cristine picked up. I told her I tried reaching you guys from 9 am -9:40 am and nobody picked up. She said she has been there since 9 am. So anyways we agreed to to fax the paperwork back n' forth the next day. So I called them on 1/24 and said I and mom would be at the credit union at 4 pm to do the paperwork. So after faxing the paperwork back n' forth I thought everything was all good. I was told that is all they needed and we left the credit union. Well about a half hour or so later I get a call from Michael saying they needed our initials on a couple spots on the buyer order and if I didn't get it initialed they had 2 interested buyers on the car and it would be sold out from underneath me. I was like WOW, really? So mom and I drove through a snow storm to Staples and take the paperwork with us that was initialed to fax them back. One of the things she initialed was the New York State Inspection that the car was supposedly sold with and they would not be able to ship the car until the check cleared. 

So the following week a couple days go by and I heard nothing from them. I dropped them an email asking if the check cleared and heard nothing back. Finally the next day I think it was a Thursday I was told the check handn't cleared yet. I emailed them everyday asking and finally the next week early February the check cleared and they were going to make shipping arrangements. They said I would have it here on Tuesday. So to make a long story shorter Tuesday rolls around and I get a call saying due to the snow storm my car would not be delivered. I asked where my car might be? They told me they didn't know. (I personally believe it never left the dealership) and found out later from the shipper he hadn't even picked it up yet. So they were lying to me about that. They also told me they would make contact with me and didn't when the car would be here. So frustrated beyond belief with how huge of a hassle I was getting all the phone calls and emails exchanged chalked this up to the worst buying experience ever.

BUT IT GETS MUCH WORSE!!!! The car was finally delivered on 2/8/13 in a snow storm and the car is anything but perfect. The first thing I noticed as 4 bald tires and a ABS light that was on. The car had a aftermarket Magnaflow exhaust system, but was a lot louder than I thought was normal. The drivers seat was very worn but the rest of the interior seemed pretty mint. The body was in good shape but did have some paint flaws like stone chips on the black trim and the bumper had some touch up work done to it. I also noticed underneath the spoiler a small chunk of paint was missing. So I tried the sound system out and I get no sound. It was an aftermarket Kenwood receiver and chalked it up that I must be doing something wrong. So I waited for my brother and his friend to take a look at it and they could not get it to work. I recall looking in the trunk a few days before and saw wires hanging down but thought they just went to a sub box. Well our family friend who does music took a look and said your sound system is disconnected and probably will need some major wiring work. I was like great! What else could be wrong? I sent Cristine an email and told her the car is FAR from PERFECT and thought they should compensate me for these unforeseen repairs. I asked her why would you lie to me this bad and tell me the car was perfect and needed nothing when I already know it is going to need 4 new tires and I have a ABS light on that I can't get rid of. She told me it might just be the cold.....I emailed the pre-owned used car manager Cross and he emailed me back saying the car was sold "As Is".....I said that is true but I have on the Buyers Order the car passed New York State Inspection which isn't true and you lied to me. What are you going to do to make this right? I said you have 5 business day and today is the 5th business day and I've heard nothing back.

So anyways the next week I take the car to my oil and fluid shop here in Wyoming, MI and they told me the car has a quart too much oil and if I didn't get it drained the seals could be blown. They at the time could not drain it as they were closing but could not believe a dealership would be so incompetent that they would put a quart too much in it. I said they must of changed it as it is not that dirty. The oil life read 97% and it was light brown color. So the next afternoon I already had a tire appointment scheduled at Berger Chevrolet and asked my friend Mark when they had the car on the hoist if they could drain a quart of oil out of it. He said no problem. So he came to me later and told me you have 3 cracked lug nuts on the wheels and 5 lug nuts missing. He said you are honestly lucky the wheels did not come off while you were driving the car. I was like WOW!!!! He said didn't you say this car was state inspected? I go supposedly. He said there is absolutely no way this car could of passed a state inspection. He said come with me and I was like what? He said we have your car on a hoist and I want to show you the soft ball size hole in your exhaust. I was like OMG! So I went with him and yes a softball size hole was indeed there and was pretty corroded. He said this alone would not pass an emissions inspection. I said I would have my other mechanic repair that also. He said your front headlamp bulb is out and a rear tail lamp bulb is out as well as your fog lamps do not work as well. 

So I got in contact with my buddy Rob who is a backyard mechanic who can tear a car apart and put it back together again and told him everything that was going on. I took the car to him and after 25 hours of rewiring and making repairs on the car he said your ABS Control Module is what is keeping the light on. He said I had my buddy come over with his expensive scanner and that is what is keeping the light on. It is shot and if we got one from a dealership it would run you about $1500 for the part and installation. He said check online for what they cost. I did and they are about $800 dollars for the part. I have already stuck $600 dollars into it for new tires and lug nuts, $400 in rewiring the electrical system which got my driver information system back working, fog lamps working, new head lamp bulbs, and rear tail lamp bulb, and a sound system that works. I as I'm writing this will have to pay for the ABS control module, new exhaust pipe as well. My future costs will be re painting the trunk and trim, new drivers seat, for a total of around $9500 or so in the car. So I will have around $3,000 of unforeseen repairs in a car that was supposedly PERECT. 

I am beyond angry and do not want anyone to make the same mistake as I did. Do not buy a car you have not driven or had your mechanic look at first. Do not buy out of state as your recourse options are limited. Do not support liars and scam artists like Legend Nissan, because the deal they are giving you is too good to be true!

Reached a settlement

Legend Nissan fired the Sales Manager and the General Manager over the way we were treated and finally after 6 months, I was able to speak to the owner of the dealership and we reached a settlement. It was not nearly as much as I wanted or probably deserved but something is better than nothing and more importantly, we were apologized to by ownership several times both verbal and written. That means a lot given how much stress this has caused us. 

So I will close by saying you can sometimes find justice if you fight hard enough for it. It took me 6 months to find out the owners name and contact information and he was not even aware of the issue because the people below him kept him in the dark. I also want to say thanks to the New York Attorney Generals Office for helping in this matter.

I actually did not get hit with a $795 fee. It was waved. I sent them a check for the car and shipping for $6500 which was the price we agreed too. That included shipping. As far as Carfax goes if the information reported on there is indeed not accurate they have a "buy back" guarantee but we already dumped $2 grand into it so far well I would not want them to buy it back unless they included the money we have invested in it. I was suppose to get a car fax sent to me but I'm yet to get it from the dealership. I may have to call Carfax and see if they will send me one if Legend isn't going to follow through. My only hope at justice really is the attorney general. I am going to call Nissan North America today and let them know what happened. If I was a brand, I would not want these type of scum bags ruining my reputation.

There are soime points we agree on here and some we don't.  First off..YES...every car dealer should be a model of honesty and integrity for every business.  However, that simply IS NOT the case!  The Sleazy American Car Business has a well deserved reputation for deception and fraud.  That's exactly how you were victumized by them lying to you about how great a car this was and as you can see, it wasn't.  If they would have bragged about it, then you went out into the lot to see it first hand, you would have walked the other way!  Oh but they played even another game with you...did you check your paperwork?  As per their own website they hit buyers up with a completely PHONEY, completely BOGUS add-on fee!  $795???  Car fax...anybody who knows anything about carfax is 100% positive they are NOT accurate!  Yes, buying ANY used car is a risk...that's why a smart consumer DOES NOT buy the car until and unless it is PROPERLY checked out and checked over.  You don't properly CHECK OUT AND CHECK OVER a used car that you buy sight unseen!  The bottom line here is it is absolutely correct they should have been 100% honest with you regarding the exact condition of the car.  There is no question about that...none at all!  However, they LIED to you.  These slimeballs should have also been honest in the price.  Instead, they LIED to you about the price too and then SCAMMED you by adding on a BOGUS, ADD-ON, PHONEY fee.  But lying and bogus fees is a mainstay in the SLEAZY car business.  On the other hand you were correct and doing the right thing in trying to get a decent car for your mother.  However, buying ANY used car, SIGHT UNSEEN, is completely opposite that motive as you don't know and cannot guage reliability and marketability of a car you haven't the slightest clue as to its exact condition but you buy it anyway.

"Yes I have made on line purchases but ONLY for items which are new!  Everybody knows about the problems of buying a USED CAR...any used car whether you buy it locally from a dealer or locally from a private owner.  In either case, the smart consumer does all the checks I mentioned above and then has their own mechanic check the car over BEFORE obligating themselves."  

I read the New York DMV check list online prior to purchase. I told them I would not agree to the purchase without is passing the New York Vehicle Inspection. They said fine and put it in writing on the Buyer List that it was indeed state inspected. Well the other day I spoke with the New York DMV and they told me it failed the state vehicle inspection so I believe I have some recourse. The NY attorney generals office said I have a good case because they lied about the vehicle passing the state inspection which it did not. 


"Just because something can be done on-line or by a computer DOES NOT MEAN its a great idea.  If you would have seen this thing in person with a worn seat, bald tires and an ABS light "on" would you have bought it?"  

I might of still bought it but I would not of paid $6,500 for it. Again it being sold with the state inspection sealed my confidence that the car was as good as they claimed. I know a lot of people who buy cars online but most name brand dealers do not have an integrity problem. I could see if I bought this car from a "B Lot" but I purchased it from a huge Nissan dealership in Long Island, NY. My last car that was totaled I purchased from a dealership in Florida, and the car was mint. Never saw the thing besides pictures. Not all dealerships and sales people have no integrity. I know people who've purchased things online both new and used and it not be what they claimed. They made them take it back or it was discounted. 



"They say this car has less than 22k miles on it.  Really...with a worn out seat???"  

The Carfax shows a 1 owner car with 21, 917 miles on it. The only seat that show wear is the drivers seat. The passenger seat and back seat are mint. I would assume the former owner was morbidly obese. My mechanic says the cars mileage appears to be accurate based on looking over the parts. He has been working on cars for 30+ years so I have a lot of faith in his assessment.  


"You don't exactly live on the moon.  There are no dealers in your part of the world???"  

I looked for 2  1/2 weeks straight in my local area. Went to at least 35 dealerships and checked online including craigslist, cars.com, auto trader. Cars here are higher priced than other states. I looked at an 05' Grand Prix GT with 99,000 miles on it and they wanted $9,999. I was having a difficult time finding something in the budget that wasn't worn out or over priced.

"Many sellers of used cars are just waiting for someone to come along and throw common sense out the window and buy their junk cars sight unseen.  That's exactly what you did!  Should they have represented the car honestly?  Of course!  They should have been honest with you.  But they weren't and besides that you would have had no way to determine that because they have your money and you have a car you bought without even seeing it!  You fell right into their hands like everyone else does who buys a used car sight unseen and finds out they bought junk.  In all probability that car had much more than 22k miles on it...you would have seen the dicrepancies and certainly would have your mechanic.  This isn't rocket science here...used cars can be a problem and are risky to buy.  Buying any used car sight unseen is just plain stupid."

Buying a used car you've seen and driven is a risk. I use to sell cars in a former life. A coworker sold a Grand Am to a couple and a week later the engine blew up. Another co worker sold a vehicle to a guy who said the car never been in an accident and 3 weeks later the paint is coming off the door. Both vehicles were sold "as is" and in both cases our General Manager paid for the repairs because we had a rock solid reputation we had to live up to. So seeing and driving a car isn't a guarantee either. You can take a scanner and cancel off the service engine soon light temporary. At some point integrity and reputation should come into play or should we live in a society where that doesn't matter anymore?

I am thankful I have a friend who is a mechanic and owes me a favor and isn't charging me full price on labor making the necessary repairs. I did not expect the car to be brand new but the mechanical problems like a softball size hole in the exhaust, 5 missing lug nuts w/ 3 of them cracked, 4 bald tires, lights including fog lamps both front and rear not working, would not pass the NY DMV Inspection. They should be liable for those things on that list. I guess I will see what the attorney general does once I receive the paperwork to fill it out and mail back?

The risk I assumed would be pretty low on a car with 21,000 miles and coming from a large dealership in Long Island, NY I would assume they would not put a car in this condition out on the lot. Where does integrity come into play? I've bought a couple of automobiles out of state in the past and never had a problem. When a dealer lies and says the car passed the state inspection and you find out from the DMV it failed there has to be some recourse, no? They are essentially not just lying to me but the state of New York. They told me the car passed inspection before it was sold to me and is noted on my buyers order where my mother initialed. I would of not of agreed to buying it without the inspection. So please Jim spare me the sarcasm. I guess you have never purchased anything online before?
