I met Marina in 1989. She managed the Merry Go Round then. We dated for awhile, I sold her a car. I"ll Leave out details of our relationship, but I was seeing 3 girls then. My roommate at the time who had introduced us informed her of this and she moved on, she wasn't hard to replace. End of story, not hardly. For a few month's now, her ex-husband has been house sitting next door with his fianc. Frank Testagrossa.

While waiting for his latest criminal trial, he was arrested in front of my house last week. He was on a drug and alcohol binge. Going house to house asking for money. An elderly neighbor called the sheriff. As they cuffed Him and put him in the squad car, I asked one of the officer his name, as I had only said hello in passing. He also said he was a cockroach, and was wanted for a parole violation. So my wife was worried that we had A neighbor with a criminal record, so I looked him up. I see Marina Spagnolo aka Testagrossa no way I said. Going back I see she was married again, now Marina Bander. So here I am after 20 years later with an incredible tale. What are the odds. Only comment is I punished her, In every hole, and she loved it. In fact She took me to Orlando to look at her parent's land. They had two lots side my side, one was for us when we got married. Guess I got off easy.

Thats really more than I needed to know.  Maybe court dates, and such are not needed?  A lot of things can be settled by mail, and out of court without the costs to you or her.  We all know too well that only the lawyers make out here.

Maybe you can make a "lump sum" settlement with her for arrearages with what you said you already paid taken into consideration????  Just a thought.

Though it may indeed be correct, that money paid outside of support, cash, gifts,etc do not go towards child support. Checks written that are specifically for child support, and cash deposited directly into an account that also are specifically for child support do go towards support, especially when the checks are noted as for that purpose, and there are reciepts for the cash.

Once again you speek in generality without knowledge of the facts. Obviously, if both parties are getting along, and there is no income deduction order at my employer, the only way to pay child support is to make payments directly to her. It was her idea to give me deposit tickets for her account so I did not have to mail the payments to her when I resided in Brevard county.

When you and her broke up,She called me and asked me to help her and accelerate the arearage that I was paying $100.00 a month. I gave her 2 checks, one for $5000.00, the other for $2500.00. Both were marked and accepted as child support, not a gift. What is so nafarious is that she had knowledge that none of those payments are notated at child support enforcement, and also knew that I did not have that knowledge. Fortunately, they will accept cancelled checks and reciepts, and we are going back to court again.

You are also incorrect that the court has sole discretion. The child support enforcement has told my attorney that if she acknowledges those payments in writing, we do not have to go back to court. That also saves her a trip from North Carolina to Ft. Lauderdale.

You also stated incorrectly that the court alone sets the amount of child support each month. Well, in her kitchen at her townehome in Parkland, in November of 2007, We agreed and signed an agreement for the current amount of $1100.00 a month. She then had it recorded with court. No judge or court determined that amount. She again could agree to a new amount. The correct amount based on my current income, and save me substancial legal fees and her a trip to Florida, but she does not, because she knows that it takes time and money(my money) to get back into court, and she is enjoying the windfall as long as she can.

Its very nice that you can afford extra's like bday's lessons, etc. If and when my child supoort is modified to the correct amount, I will have an extra $6240.00 each year. With that, I will be able to do the same.

Well, I am not privy to the latest since I am not in contact with her, but I also pay child support and know that the arrearages and future payments are determined by the courts, not either parent.  Money paid outside of support in the form of gifts, cash or otherwise are not counted as support payments>  I learned this the hard way myself.

My advice to you is to move on and do whats right.  In the end, its all about the kids, isnt it?  I pay my support and also give for the extras, lessons, bday gifts etc...

I also agree that I purchased 2 Mercedes. I also agree that I spent way too much money on cigars and scotch. I was immature, impulsive and made mistakes. The biggest of which was not appreciating her.

That said, since the divorce, it would be very difficult for me to conclude anything other than her having an insatiable desire to get money fom me, regardless of fiarness, or honesty. She is well aware of the times we were getting along and I paid her child support either directly to her or made deposits directly into her account.She gave me deposit slips from her account so I could make them instead of mailing them to her when I lived in Melbourne.

She even e-mailed me on Sept,28th,2008 acknowledging the correct amount of arrearage. If she is truly honorabe, why, in this extemely difficult economy, is she not coming forward and agreeing to the not only the correct amount of support esch month, but the correct amount of the arrearage.

I have had to borrow money from my 401k to pay a family attorney (they are quite expensive) to file a motion for modification, and to reconcile the correct amount of arrearage. Pay to have her served in North Carolina, and go back to court again. This when she is keenly aware of what I make and what the correct amount should be.

So I will grant you that she is a great mother, and even that she was a great wife. I will even agree that it was me and my behavior that caused the failure of our marriage. But she has been cunning and dishonest, and taken advantage of the situation, in her handling of child support

Though I do agree that She is a good mom. I doubt seriously you would have factual knowledge either way.No where did I state that she was not a good mom. As far as child support is concerned, this is where her nefarious, cunning and insatiable desire for money is most apparent.

For 3 years I paid child support directly to her. We have been to mediation over this, and she still owes her attorney for his fees. Fortunately, cancelled checks and bank deposits are very good proof in court. What she knew, and I did not, is that unless it is paid thru child support enforcement, or Fl. Dept of Revenue, they don't have a record of it in their tally. She knew this very well when collecting directly from me. Though the wheels of justice are slow, they are usually fair, and 2010 will be the year that she has the opportunity to answer under oath about the support payments she recieved directly from me.

In addition, child support fortunately is not determined by the discretion of the judge, but by statute, based on income. The $1100.00 she continues to get is based on twice the income I am earning, and she is well aware of that. So yes, she does get more than she deserves. Not based on what I think or say, but on the statute created by the Florida Legeslature.

As far as the most down to earth frugal person. Its quite easy for someone outside a marriage to make comments about one side or the other. Its quite difficult however for that person to even have a clue of the facts of what truly went on in that marriage. I am sure you were not there when she begged  for an H1 Hummer at $80k in 1998. Or the $75k 2000 S420 Mecedes that I bought for her. I don't think you were privy to the conversation that led me to purchase in 1998, a 5000 square foot home on 1.78 acres in Parkland. I don't think any of those were frugal.
