Okay here is the deal. Merchants Credit Guide Company sent me a letter claiming that I owed thousands of dollars. The named to which the letter was addressed has not been my legal name for 10 years; the credit cards that were in that name were cancelled in 1992.
If you are in Florida, try this: Send a letter to the
Attorney General, State of Florida, Charlie Crist, along with a copy of the letter from Merchants Credit Guide Company.

I also sent a certified, return receipt letter to Mr. Hughes, at Merchants Credit Guide, stating that I was unaware of any debt owed by me, with a copy of my letter to the attorney general. Requesting the name and acccount numbers of creditors and the dates that this debt was encurred.

I have received a response from the Attorney Generals office recommending that I contact the FTC, which I intend on doing.

The statute of limitations in FL is 5 years from date of last activity, which is usually considered to be the date of charge off by the original creditor. That is assuming the debt was originated in FL. If not, the state it was originated in is the one you use in most cases.

As far as the CEASE COMMUNICATIONS letter, you can get one for free at budhibbs.com, and be sure to send it by certified mail, return reciept requested. Be sure to put the certified# on the letter itself, and keep a copy for your records.

FYI..The FTC has all jurisdiction of enforcement on debt colectors, but they do not do individual enforcement. Individual enforcement can only be done through the courts. The AG can act only as an arbitrator, but has no legal authority to force them to do anything.

I too received a letter from MCG alledgedly from 1989, never on any credit report. Anyone know what the SOL is in Florida and anyone have a copy of a Cease $ Desist letter?

Mat,

Go to FTC.gov and file a complaint online each time they contact you in violation of your rights under the FDCPA. You can read and print this act while on the FTC site.

Also send a letter of complaint of MAIL FRAUD attached to a copy of the collection letter to the US POSTAL INSPECTOR. They are knowingly engaging in fraud attempting to collect a time barred debt, and are using the mail to do it.

Also go to budhibbs.com and read all about these lowlife. They are one of the worst. You can file a complaint there too.
